The article focuses on the recent jurisprudence of the Court of Justice of the European Union in the context of the national criminal laws of the Member States, concerning the scope of application of the Charter. Drawing conclusions from this jurisprudence the Author answers the question when the Member State is 'implementing Union law' in the meaning of Article 51(1) of the Charter in the criminal law context. It is considered that Member States implement Union law when interpreting framework decisions (Lanigan, JZ, Vilkas), when assessing the conformity of the national measures with framework decisions (Jeremy F., Radu), when executing judgements in the framework of the mutual recognition (Aranyosi and Caldararu) and when assuring the effectiveness of EU law by enacting criminal sanctions (Tarrico). In addition, in some situations Member States may be considered to be implementing Union law while enacting national measures which may affect the rights derived from Union law (Delvigne). It is assumed in the article that CJEU is often called to strike the fair balance between the different (and sometimes diverging) interests of three categories of actors: interests of individuals (to have their fundamental rights protected), interests of Member States (to exercise ius puniendi) and interests of the European Union as a whole (to ensure effectivess of EU law).

Opis:
The aim of this paper is to show how the social legitimacy of the Constitutional Court in Poland is constructed. Social legitimacy is considered here in two dimensions. At the macrostructural level the socio-political processes, that led to the creation of the constitutional court are analysed. The microstructural dimension focuses on examining how the individual socio-demographic characteristics of the Constitutional Court’ judges (their scientific degrees, legal practice, political experience and institutions of power), contribute to the strengthening of the Constitutional Court’s position. Thus, the paper argues that the legitimacy of the Court is made by constructing the neutrality of the institution, in particular by locating it in opposition to politics and reinforced by the academic faction of the legal field. The study is based on the sociology of Pierre Bourdieu (and his follower Frédéric Lebaron), as well as inspired by Durkheimian sociology of religion.

Opis:
The author discusses an always relevant problem of the model of the procedure for dissolving marriage. The problem is analyzed from the point of view not only of law, but also social sciences, primarily, psychology. He observes a presence of a dominant tendency nowadays to deemphasize the meaning of marriage and family, and to succumb to crisis and file for a divorce for banal reasons. The so called pro-divorce mentality translates into a tendency observed among judges to favour divorce. On the other hand, the author assesses the legal acts referring to divorce cases as reasonable, i.e. neither favoring nor facilitating divorce. Therefore, a need is emphasized to change the approach to the family in a critical situation. He suggests that in a family court instead of settling family legal problems an attempt should be made to solve them. To this effect, in local communities, special groups comprising psychologists, pedagogues, lawyers, social workers and other specialists should be set up. The ultimate goal for the groups would be to try to reconcile the spouses, to help them solve their family problems, including assistance in dealing with all divorce procedures. People dissatisfied with the proposal suggested by such a group might have a right to file a case in court. In court the proceedings should be held in compliance not with the so far applied adversarial principle but with the conciliatory principle.

Opis:
The article presents the latest developments in jurisprudence and the law in relation to the role and the jurisdiction of courts in the antimonopoly cases. The basic assumption of the article is that there exist parallel jurisdiction of civil and administrative courts in competition cases and sometimes it is hard to determine which court is competent to hear particular competition case. The article begins with an analysis of recent changes in the law that influenced jurisdiction of the antimonopoly court. It is followed by the discussion of the latest Supreme Court jurisprudence concerning the role of the antimonopoly court. The next analyzed issue is the identification of all administrative acts issued by the antimonopoly authority together with determination which court is competent to hear appeals against each of them. It provides a good background for a detailed analysis of non-typical acts of the antimonopoly authority with an attempt to clarify which court has jurisdiction over them. The article concludes with critical observation that parallel jurisdiction of civil and administrative courts in competition cases is a source of constant problems. Especially civil courts tend to ignore the fact that administrative court do play a role in competition cases simply because civil courts do not poses legal tools to offer judicial protection for addressees of certain types of actions of the antimonopoly authority.

W artykule wykazano, że Międzynarodowy Trybunał Sprawiedliwości, wydając orzeczenia i opinie doradcze, przyczynia się do wzmocnienia i promocji koncepcji rządów prawa. W związku z tym, po pierwsze, wyjaśniono pojęcie „rządów prawa” oraz przedstawiono teorie formalne i materialne koncepcji rządów prawa. Ustalono, że idei rządów prawa w krajowych porządkach prawnych nie należy utożsamiać z koncepcją rządów prawa w prawie międzynarodowym. Następnie dokonano analizy wybranych orzeczeń i opinii doradczych Trybunału w odniesieniu zarówno do pokojowego rozstrzygania sporów międzynarodowych, interpretacji, jednolitości stosowania, rozwoju prawa międzynarodowego, jak i zachowania zasady równości wobec prawa. Stwierdzono, że poprzez pokojowe rozstrzyganie sporów międzynarodowych pomiędzy państwami Międzynarodowy Trybunał Sprawiedliwości przyczynia się do utrzymania międzynarodowego pokoju, przyjaznych stosunków oraz zapobiega wybuchowi konfliktów zbrojnych. Ponadto Trybunał w sposób jednolity, bezstronny stosuje, wyjaśnia i przyczynia się do rozwoju prawa międzynarodowego. Niestety, w postępowaniu doradczym dotyczącym rewizji orzeczeń trybunałów administracyjnych nie zagwarantowano jednostkom zasady równości stron. Zgodnie z art. 34 ust. 1 Statutu Trybunału jedynymi podmiotami uprawnionymi do bycia stroną w postępowaniu przed Międzynarodowym Trybunałem Sprawiedliwości są państwa. Jednostki nie mogą także uczestniczyć w postępowaniu doradczym. Jednakże w ostatniej opinii doradczej z dnia 1 lutego 2012 r. Trybunał stwierdził, że jest zobowiązany do zagwarantowania równości stron tak dalece, jak jest to możliwe.
This paper argues that by delivering judgement and giving an advisory opinion, the International Court of Justice contributes to enhancement and promotion of the rule of law. First of all, it was necessary to explain the term ‘rule of law’ and its formal and substantive theories. It argues that the notion of rule of law in national legal systems should be distinguished from this concept in international law. Then it analyzes some judgements and advisory opinions of the International Court of Justice with regard to peaceful settlement of disputes, interpretation, uniform application and development of international law, as well as equality before the law. It was established that through peaceful settlement of disputes between States, the International Court of Justice helped maintain peace, friendly relations and prevent violent conflicts. Furthermore, the World Court consistently and impartially applies, clarifies and contributes to the development of international law. Unfortunately, individuals are not on equal footing in the advisory proceedings concerning revision of judgements of administrative tribunals. According to Article 34 paragraph 1 of the Statute of the Court, only States are entitled to appear before the International Court of Justice. What is more, there is also absence of equality of the parties in advisory proceedings because individuals are deprived of any access to the Court. But in the last advisory opinion rendered on 1 February 2012, the Court argued that it is obliged to ensure that this principle is adhered to as far as it possible.

The aim of the article is to compare the way in which the issue of responsibility for violations related to the acts of unrecognized authorities claiming to be States is treated by the European Court of Human Rights and other international courts, particularly the International Court of Justice and the International Criminal Tribunal for the former Yugoslavia. The article considers in detail the relations between jurisdiction and responsibility, responsibility of parent States (including the concept of “positive obligations”) and responsibility of States which provide assistance to unrecognized regimes (with emphasis put on the concept of “effective control”). The results of the study indicate that the jurisprudence of the European Court differs in several important aspects from decisions of other international courts. These differences, while undoubtedly enhancing the protection of human rights in Europe, contribute to the process of fragmentation of the law of international responsibility.

Opis:
The concept of ius cogens norms is one of the most controversial issue in the international law. These norms were definied in the art. 53 of Vienna Convention on the law of treaties of 1969, according to which ius cogens norm it is a norm accepted and recognized by the international community of States as a whole as a norm from which no derogation is permitted and which can be modified only by a subsequent norm of the international law having the same character. This definition indicates that these norms limit the ability of States of creation or change the norms of the international law. However, the indicated definition does not include examples, scope and substance of ius cogens norms. In the commentary to the art. 50 of the draft articles on the law of treaties the International Law Commission stated that substance of these norms will be worked out in the States’ practice and in the judicial decisions of international courts . Contrary to International Court of Justice Inter-American Court of Human Rights (IACtHR), in its judicial decisions in great measure widened the scope and the substance of ius cogens norms. Consequently, IACtHR has developed a progressive case law in this realm. In separate opinion, in the case Caesar v. Trinidad and Tobago from 2005, judge A.A. Conçado Trindade concluded that the IACtHR, in identification of ius cogens norms, have done more than any other international court. In its judgements and advisory opinions IACtHR recognized that e.g. forced going missing, tortures, discriminations, extrajudicial executions are the infringements of ius cogens norms. Taking into consideration jurisprudence of the IACtHR it is hard to say on what grounds it was prescribed that a given norm is forming a part of ius cogens. This article analyses the way the IACtHR identified ius cogens norms. Therefore it was indispensable to define its competence ratione materiae. Next, taking into consideration the gravity and the nature of infringement and the fact that all infringements of human rights which have been described simultaneously constitute violation of other human rights, this paper is limited only to three of them. It also outlines what functions, in the jurisprudence of IACtHR, fulfil the attribution to the norms the status of ius cogens norms.

Opis:
The obligation to counteract gender stereotypes resulting in discrimination against women, including violence against women, was anchored in international law by the Convention on the Elimination of All Forms of Discrimination against Women of 1979. The article aims to demonstrate that although the relevant regulations are of a very general nature, the recognition of this issue in international law allowed the particular instruments which may counteract violence against women to be developed. The international output in this matter may be divided into two key stages – a stage of recognition of particular stereotypes in the case law of international human rights bodies and a stage of development of legal instruments aimed to counteract gender stereotyping. Thus the article attempts to link the stereotypes identified in the practice of the Committee on Elimination of All Forms of Discrimination against Women and the European Court of Human Rights with instruments developed in the most comprehensive international treaty concerning the violence against women, i.e. the Council of Europe Convention on preventing and combating violence against women and domestic violence of 2011.

The article analyses case law concerning national minority protection in the jurisprudence of the European Court of Human Rights and UN Human Rights Committee. The protection of national minorities is realized through protecting individual right of persons belonging to minorities. Due to significant amount of cases and given the importance of discussed issues, the analysis is restricted to three topics: names, education and political participation. The case law has set some important standards in those areas. In most of the analyzed aspects the approach of both organs has been the same, for example in regard to names and surnames of persons belonging to national minorities. The research also showed areas in which the case law was not consistent – while examining cases concerning the same French law regarding wearing of religious clothing by students in state schools, the UN Committee, contrary to the Court, found a violation by the state. However, in the vast majority of studied subjects, the jurisprudence of the Court and Committee is very similar and allows to formulate an international standard of national minority protection. Among national minorities indigenous people enjoy in some aspects greater protection than other groups, which is particularly evident in the Committee decisions.

The International Court of Justice (ICJ) is a principal judicial organ of the United Nations. The main task of ICJ is to settle disputes submitted to it by the states and is also entitled to give advisory opinions which are given on the motion of some United Nations organs and specialized agencies. The expression that ICJ is a “principal judicial organ of the United Nations” doesn’t mean that it is the only one judicial organ within the framework of the United Nations. The United Nations Administrative Tribunal (UNAT) was established by the legal force of the General Assembly resolution 351 A(IV) of 9 December 1949 r. The main purpose of the UNAT was to decide legal employment disputes between United Nations staff and the Organization. In 1955 the Statute of UNAT was amended and the Committee on Application for Review of Administrative Tribunal Judgement was competent to seek advisory opinion form ICJ and this opinion was binding. However Committee only in three cases requested the ICJ to give advisory opinion. Those opinions concerned inter alia the competence of ICJ to respond to the question, the right of Committee to submit such motion, the principle of equality of arms. In spite of that since of the 1st of July 2009 the new system of administration of internal justice was established – the United Nations Dispute Tribunal and the United Nations Appeal Tribunal, which consider the appeals against judgments rendered by the United Nations Dispute Tribunal, the issues discussed in advisory opinions of ICJ on the matters of appealing against a judicial decision of UNAT are still highly topical, especially in the context of the maintained in force competence of ICJ to review judgement of The Administrative Tribunal of the International Labour Organisation.
