Opis:
The aim of this case comment is to discuss whether it was justified that the General Court in its judgment dated 9 February 2022 in the case Sped-Pro (T-791/19) annulled the European Commission’s Decision No. C(2019) 6099 final dated 12 August 2019 r. (case AT.40459) connected to the potential abuse by PKP Cargo of a dominant position on the market for rail freight in Poland. In this judgement, the General Court argued on the basis of the rule of law principle and applied analogically the judgment on the European Arrest Warrant. In this regard, the analysis starts with the rule of law principle, the judicial independence of courts and administrative authorities, the obligation of loyal cooperation between European Union and member states to ensure fulfilment of the obligations arising out of this Treaty, both in the light of Union law and European courts case law.The next part of this case comment attempts to assess whether the General Court was justified in analogically applying the judgement dated 25 VII 2018 r. C-216/18 PPU Minister for Justice and Equality on the European Arrest Warrant in the field of European policy on competition. The analysis ends with the description of the practical consequences of the Commission’s finding that the President of UOKiK and the Court of Competition and Consumer Protection are not independent. In the last part of the text, the author also indicates the consequences of the proper implementation of the Directive ECN+ for analysing the scope of independence of the President of the Office of Competition and Consumer Protection. The author indicates the necessity to separate in future analysis the issue of the independence of the President of the Office of Competition and Consumer Protection (national administrative competition authority) and the Court of Competition and Consumer Protection, which in Polish is a common court.

This article concerns the legal institution of observations submitted in civil proceedings by the President of the Office of Competition and Consumer Protection (hereinafter: President of the UOKiK). This institution is analysed within the framework of the hitherto practice of the Polish courts and the President of the UOKiK. Significant legal issues linked with the submission of the said observations and the way they are processed by the courts are presented, and premises for submitting these observations by the President of the UOKiK described. It is pointed out that submitting an observation is contingent upon the existence of public interest as well as occurrence of a significant question which is relevant to the case. Such a question needs to deal with the widely understood protection of competition and consumers. It is also noted that observations may only be submitted with regard to an actual case heard by the court. It may be addressed to either general, administrative or arbitration courts as well as to the Supreme Court. The article contains a description of the procedure of submitting observations, taking into account the settled practice of the President of the UOKiK. Within that scope issues concerning an application for submitting observations and formal requirements that such observations need to satisfy are also discussed. Furthermore, an attempt is made to determine the legal character of the said institution, taking into account the views presented in caselaw and literature. In that context a possibility of qualifying these observations as evidence has been excluded. Finally, the principles that need to be adopted by the courts when they examine the observations are discussed and the fact that courts have no competence to verify the observations submitted by the President of the UOKiK in respect of formal requirements and conditions for submission is stressed.

Opis:
On 23 March 2017, the Act on mortgage credit and supervision of mortgage credit intermediaries and agents was passed, which implements Directive 2014/17/EU of the European Parliament and of the Council of 4 February 2014 on credit agreements for consumers relating to residential immovable property and amending Directives 2008/48/EC and 2013/36/EU and Regulation (EU) No 1093/2010. The Act on mortgage credit under examination contains consumer protection standards for mortgage banking services, which can pursue objectives and perform macro-prudential functions in the fi nancial system. The Act also provides for the supervision of mortgage intermediaries and their agents providing mortgage credit services, rightly considering that since this is a matter of macro-prudential substance and capable of having an impact on fi nancial stability, a comprehensive supervision of the activities of mortgage intermediaries and agents is justifi ed. The aim of the study is to (i) examine the provisions of the Act on mortgage credit from the perspective of its macro-prudential content; (ii) reconstruct this potentially macro-prudential content; (iii) assess the regulatory arrangements for credit intermediaries and residential immovable property agents adopted by the Act; and (iv) address the issue, relevant to the theory of fi nancial market law, of the interference between private and public law rules in terms of their macro-prudential content and macro-prudential policy. It is also intended to perform a comparison of the provisions of the Act on mortgage credit with selected recommendations of Recommendation S of the Financial Supervision in order to assess their macro-prudential nature and the appropriateness of the regulatory solutions adopted by means of an act or by means of national soft banking law to which Recommendation S belongs.
