Over the several decades of her scientific activity, Professor Teresa Rabska played an outstanding role in the formation of Polish administrative law, particularly during the political and economic transformations of the late 1980s, when Prof. Rabska was actively involved in the field. Within public economic law, the role of the state and its tools for influencing the economy have evolved fundamentally. In this area, the administrative sanctions with which administrative bodies were equipped have developed profoundly and taken on an important function. Undoubtedly, the European Union plays a significant role in the development of administrative penalties. Penalties are imposed in the form of administrative decisions, issued according to procedures governed by the Code of Administrative Procedure. This Code and other laws enumerate the prerequisites for assessing a penalty. Among these, the omission of the element of guilt must be a cause for concern. Consequently, particularly in the case of penalties imposed on individuals, the penalty may be imposed on a person to whom no fault can be attributed in the violation of the law that caused the punishment. The system of fines thus arouses great dissatisfaction among market participants. An analysis of the system of administrative penalties in Poland raises the issue of harmonizing solutions on the scale of the European Union, as it is expected that penalties should be of similar size in all member states. However, the statutory enshrinement of high penalties in the current legislation does not prejudge the practice of imposing them. Given the smaller revenues generated in Poland, the penalties imposed should be proportionately lower. Moreover, the law does not categorically require the imposition of high penalties. The legislation often uses the word “may,” from which some people draw conclusions about the imposition of penalties under administrative discretion, which is not legitimate.

The aim of the article is to explain the reasons for the introduction of mediation in administrative law. Mediation is presented in the light of the Recommendation of the Committee of the Council of Ministers R (2001)9 of 5 September 2001 on Alternatives to Litigation Between Administrative Authorities and Private Parties. The adoption of this act was justified by the situation of administrative courts in the member states of the Council of Europe. The common problems in the area of justice were the excessive number of court cases, excessive formalisation of court proceedings and a dispute resolution model that would disregard solutions that could satisfy both parties to the administrative dispute. It was also stated that these problems might have a negative impact on citizens’ access to justice and lead to the violation of the rights of the parties to court proceedings, referred to in Article 6 par. 1 of the Convention for the Protection of Human Rights and Fundamental Freedoms. The measures that may constitute an alternative to the judicial resolution of administrative disputes in the Recommendation include: internal control of administrative acts, amicable proceedings/conciliation, mediation, settlement and arbitration. This Recommendation has shaped the Polish solutions in the field of introducing alternative dispute resolution methods to administrative law. However, in the realities of the Polish legal conditions included in the Recommendation, the proposals have become an incentive to introduce only the institution of mediation. First, it became part of the court-administrative proceedings, and then it was introduced to the administrative proceedings. Currently, when after the introduction of mediation to the Code of Administrative Procedure, the use of ADR methods under administrative law has again become the subject of a broader interest in the doctrine, it is worth recalling the reasons why in 2001 the Council of Europe recommended introducing alternatives to national legal orders.

Within the legal system applicable in the Republic of Poland, it is the Act on cosmetic products of 4 October 2018 that regulates the supervision and supervisory measures in the market for such products. The domestic scheme of market supervision in respect of cosmetic products involves the competencies of the State Sanitary Inspectorate and the Trade Inspectorate. These bodies have been equipped with supervisory measures in the form of administrative sanctions, the most severe of which are financial administrative penalties imposed on business entities under their administrative criminal liability. The ratio legis of this legislative act is based on the premise that the appropriate level of protection of public interest (consumer health and life protection) may be best achieved through the preventive and repressive character of fines. The article substantiates the claim that effective supervision (which provides an appropriate level of consumer health and life protection) determines that supervisory bodies employ financial administrative penalties in judicial matters only if the directives on the penalty extent are understood correctly. This article constitutes a dogmatic and legal analysis of the statutory premises which determine the extent of financial administrative penalties imposed by supervisory bodies (the so-called ‘directives on the penalty extent’) on entrepreneurs within the cosmetics industry under the scheme stipulated in the Act on cosmetic products of 4 October 2018. The article aims to present how these premises are understood and applied in judicial matters by the State Sanitary Inspectorate and the Trade Inspectorate. It is the correct understanding and application of these premises (directives) for the extent of financial administrative penalties that result in the appropriate behaviour on the part of the entrepreneur during the course of the proceedings. This, in turn, is a direct consequence of the extent and severity of the administrative monetary penalty, as it has a preventive and repressive function.

The article considers the issue of sailing licences which include: a sailor licence, a steersman licence and a captain licence. The legal character of sailing licences and the procedure in which they are issued is analysed. The judicial control of sailing licences is also considered. The granting of a sailing licence is an act confi rming that a person indicated therein has certain qualifi cations required for sailing. The legal character of the licence is similar to an administrative certifi cate. Granting the sailing licence can be conditional upon passing a formal examination by a person requesting the licence to be issued. The examination itself is regarded as an administrative act in law. The study proves that the Polish Sailing Association performs a function of a public administration unit issuing sailing licences. This means that it acts as a an administrative body in a functional dimension.The sailing licence is granted in the form of a declarative decision issued by the Polish Sailing Association. The proceeding for issuing such a decision is an administrative proceedings governed by the Code of Administrative Proceedings. The actions of the Polish Sailing Association as well as its failure to act are controlled by administrative courts.

Within the administrative construction of legal forms of public administration activity developed by the doctrine of administrative law, one may distinguish both a civil-law contract (private-law), as well as an agreement having certain features of a public-law contract. The German doctrine of public law, has long been struggling with problems of legal qualification of contracts used as legal forms of action by public administration entities. As part of the work undertaken by the German doctrine of public law, a two step theory, a concept of contract law in administration and a model administrative contract have been developed. Approximation of these theories allowed the Polish doctrine of public law to identify the most important features, which should characterise the theoretical construction of a public-law contract concluded with a citizen or an administrative contract. First of all, it should be concluded by a public administration entity on the basis of its competence. The administrative agreement should concern the relationship between the administration and the citizens. Secondly, the subject matter of the contract should be governed by public law and relate exclusively to the performance of public administration tasks. Thirdly, disputes arising from an administrative agreement should be submitted to the jurisdiction of administrative courts. The article shows that from the point of view of legal protection of the individual this is a crucial matter. Although the legislator has not decided to introduce an administrative agreement into the Polish legal system, many of the contracts already in operation under Polish law have certain features which at least in part resemble the administrative agreement described above. Such an administrative agreement often concerns the relationship between public administration and the citizen and is concluded in connection with the performance of public tasks. De lege ferenda the conclusion of an administrative contract should be subject to review by the administrative courts.

The formulation of legal provisions by the administration does not have to take the form of administrative decisions. One of the legal forms of the administration is public-law contracts. This is one of the forms of administration which still requires a further scientific analysis. Contracts are useful instruments, and therefore it may be worth looking at their different types and construction. They may be classified according to the parties to the legal relationship created. There are two types of contracts, i.e. between administrative bodies and between an administrative body and an entity. The doctrine refers to contracts of the latter type as administrative and legal agreements. Such agreements have developed in the Polish legal order after the systemic changes. Unfortunately, the legislator has not provided their legal definition, they are regulated in special laws, most often by indicating contractual provisions constituting essentialia negotii. The doctrine does not explicitly define the character of the contracts concluded by the administrative body and its contractor, nor has the final characteristics of the content of contracts in the administration as a whole been made. There is still a lack of consensus as to the construction of public law contracts and the rules governing them. There is an urgent need to regulate the essence of administrative contracts, and in particular to indicate their construction and legal nature, in order to better protect legal entities entering into them. The purpose of public-law contracts is to improve the quality of administration, and increase the efficiency of administrative activities. More administrative contracts also mean higher decentralisation of the state. Moreover, the idea of extending the use of public-law contracts is consistent with the principle of the participatory role of citizens in achieving public effects. The Polish legislator may draw on the regulations of other countries, for instance Germany, where public-law contracts have received legal definitions.

Opis:
The Act on Administrative Enforcement Proceedings was adopted on 17 June 1966. The Act constitutes the basis of enforcement proceedings in administration and has been in force for the last fifty years. Despite many political and socio-economic changes during that period, the national legislature decided not to introduce any new legislation but simply modify the existing regulations. This study aims to describe and explain the amendments to the law on administrative proceedings which came into force on 1 January 2016. These amendments are connected with the solutions worked out in the model structures of tax administration organisations resulting from the enactment of the Act on Tax Administration of 10 July 2015 and require extensive discussion as they change the essential components of the procedure i.e. initiation of enforcement proceedings by creditors, exclusion of the Minister of Finance from the jurisdiction in the second instance in individual cases of enforcement procedure, the possibility of authorising local governments own organisational units to exercise the rights and obligations of the creditor and the enforcement authority, postponement of enforcement proceedings or enforcement actions, mandatory elements of an administrative enforcement title, the procedure adopted by an enforcement authority at the stage of examining the admissibility of an enforcement order, information rights of the enforcement authority, recognition of complaints regarding enforcement actions (general and connected with applying a specific enforcement measure) as well as the excessive length of proceedings and elimination of enforcement costs if creditors are tax offices or customs chambers.

The Board of Appeal (BoA) of the Agency for the Cooperation of Energy Regulators (ACER) belongs to the category of appeal bodies hearing appeals against the deci-sions of EU administrative agencies. ACER BoA acts on the basis of legal framework dedicated to the Agency, while the rules of conduct before the Board are regulated by internal rules of procedure. These regulations are practically the only legal acts regulating the procedure before the BoA, as the EU has not adopted a single ad-ministrative code that would regulate the procedure before such bodies, inter alia. The BoA is a specialised body responsible for adjudicating complex cases in the field of the EU common energy market related to the implementation of European network codes. The CJEU (General Court) sought to dispel any doubts concerning the rules of adjudication of the BoA in the ACER v. Aquind judgment by expressing a number of views on the scope and standard of adjudication, but even in the light of this judgment, a number of matters remain unclear. Consequently, it is all the more urgent to adopt a clear procedural and systemic framework governing the functioning of the BoA.

The purpose of the article is to present the competence of the administrative court indicated in Article 146 § 2 of the Act of 30 August 2002 – the Law on proceedings before administrative courts (LPAC). In accordance with this provision, in matters concerning complaints against an Act or an action related to public administration referred to in Article 3 § 2 point 4 of the LPAC, the court may recognize in its judgment a right or an obligation arising from the provisions of law and may issue a relevant decision in the matter if it first annuls the act or declares that the action is with no legal effect pursuant to Article 146 § 1 of the LPAC. It must be emphasized however, that Article 146 § 2 of the LPAC is not an independent basis for issuing a judgment and the doctrine often presents differing views. It should be assumed that the court may recognize the right or the obligation of an individual that arises from the provisions of law if the nature of the case permits doing so and when the facts and the legal framework of the case do not raise reasonable doubts. Unfortunately, judicial case studies show that this possibility is rarely used. Furthermore, courts encounter numerous problems in applying Article 146 § 2 of the LPAC, most probably because of the huge controversy regarding this procedural institution. Firstly, there is no consensus as to the function of the judicial decision based on the provision in question, and the interpretation of its facultative nature is also problematic. In the author’s opinion administrative courts should use the competence referred to in Article 146 § 2 of the LPAC more frequently. Such a change of practice would increase the effectiveness of judicial review of public administration as well as will enhance the level of protection of individual rights. The article also contains some interesting examples of the application of Article 146 § 2 of the LPAC.

The aim of this case comment is to discuss whether it was justified that the General Court in its judgment dated 9 February 2022 in the case Sped-Pro (T-791/19) annulled the European Commission’s Decision No. C(2019) 6099 final dated 12 August 2019 r. (case AT.40459) connected to the potential abuse by PKP Cargo of a dominant position on the market for rail freight in Poland. In this judgement, the General Court argued on the basis of the rule of law principle and applied analogically the judgment on the European Arrest Warrant. In this regard, the analysis starts with the rule of law principle, the judicial independence of courts and administrative authorities, the obligation of loyal cooperation between European Union and member states to ensure fulfilment of the obligations arising out of this Treaty, both in the light of Union law and European courts case law.The next part of this case comment attempts to assess whether the General Court was justified in analogically applying the judgement dated 25 VII 2018 r. C-216/18 PPU Minister for Justice and Equality on the European Arrest Warrant in the field of European policy on competition. The analysis ends with the description of the practical consequences of the Commission’s finding that the President of UOKiK and the Court of Competition and Consumer Protection are not independent. In the last part of the text, the author also indicates the consequences of the proper implementation of the Directive ECN+ for analysing the scope of independence of the President of the Office of Competition and Consumer Protection. The author indicates the necessity to separate in future analysis the issue of the independence of the President of the Office of Competition and Consumer Protection (national administrative competition authority) and the Court of Competition and Consumer Protection, which in Polish is a common court.
