The judgment commented on here concerned the issue connected with the period for filing an appeal. The view was shared that the period for lodging an appeal begins on the day on which the administrative decision is served upon the party (com- municated orally to the party) and it is at this moment that the period commences, although the day on which an administrative decision is served is not counted when calculating this time limit. Therefore, on the very day on which an adminis- trative decision is served, the party may submit an appeal against it, an application to reconsider the matter or waive the right of appeal. An appeal, an application    to reconsider the matter or a statement on waiving the right of appeal are legally effective, because they are submitted during period for the filing an appeal. not content of Art. 57 (1) of The Code of Administrative Proceedings, which regulates the way of calculating the time limit in days. Given the content of this provision, it cannot be assumed that the period for lodging an appeal commences on the day following the one on which the administrative decision is served.

In its judgment of 6 July 2016, I OSK 1516/16, the Supreme Administrative Court ruled that proceedings initiated by the complaint referred in Art. 68 of the Act on Vehicle Drivers by a person subjected to a driving test is an administrative proceeding for the invalidation of the state driving test, which, pursuant to Art. 72 Clause 1 of the Act on Vehicle Drivers, should be concluded by an administrative decision. This means that the test taker has the right to challenge the conduct of a driving test in jurisdictional administrative proceedings, because he or she is entitled to initiate proceedings for its invalidation. It is a new, precedent-setting and favorable view for the examinee. Although it is also socially significant, because it concerns a common matter, it is impossible to agree with it, because in accordance with the intention of the legislator, the examinee is not entitled to initiate such proceedings. He or she only can signal in the complaint procedure specified in Section VIII of the Act of 14 June 1960 the Code of Administrative Procedure to the voivodeship marshal the need to initiate such proceedings ex officio.

The cited judgment of the Supreme Administrative Court focuses on the meaning of the expression “access from the same public road”. The judgment of the Court of Second Instance deserves to be approved because the recitals of this judgment take into account the right to develop the plot to which the investor holds the legal title, the broad understanding of ‘neighborhood’, as well as the values that constitute the ratio legis of the Act on spatial planning and development.The rationale of the Supreme Administrative Court’s decision results primarily from the fact that a narrow understanding of neighbourhood which is prompted by the linguistic interpretation was not deemed sufficient. Referring to the jurisprudence, and above all the legislative activity of the Supreme Administrative Court and the doctrine of administrative law, it should have been concluded that the effects of the linguistic interpretation were legitimately checked from the point of view of the legislator’s goal when enacting the Act on Spatial Planning and Development. Therefore, it was necessary to make a purposive interpretation that justifies the need to take into account the right to develop a building plot, take into consideration values such as spatial order, sustainable development, ownership and public interest, as well as the interest of third parties.The position of the judgment under review is not uniform in the jurisprudence. However, it does take into account the need to weigh up the disputed interests. Although the right of ownership is significantly limited in the planning and legal regulations, it is unacceptable to deprive it of its use only due to the assumption that neighbourhood should be understood as the contact of two plots or their access to the same public road.

The gloss deals with an analysis of the provision of Art. 24f sec. 1 of the Act of 8 March 1990 on commune self-government (u.s.g.), from which it follows that councillors may not conduct business activity on their own account or jointly with other persons using the communal property of the municipality in which the councilor obtained the mandate, as well as managing such activity or be the representative or proxy in the conduct of such activities. Violation of this prohibition results in the loss of the ticket. The established anticorruption provision still raises many doubts. As a rule, it is assumed that due to its purpose and the subject and scope of violations, this prohibition is not absolute. Particularly controversial is the use of municipal property by the councillor on the principles of its universal availability, consisting in making purchases in the councillor’s shop, which do not require the use of public procurement. In order to clarify the essence of this case, the issues that do not raise doubts under Art. 24f sec. 1 u.s.g. and which entail the absolute necessity of terminating the mandate of the councillor are discussed first. Following this, judgments are presented in which administrative courts found that the use of property on the basis of general availability is allowed unless it privileges the position of the councillor and any purchases made in stores owned by the councillor do not result from prior arrangements or contracts. The development of this concept is dictated by the content of constitutional provisions and the ratio legis of Art. 24f sec. 1 u.s.g.

The gloss is devoted to the problem of the admissibility of validating the maintenance debtor’s behavior in the proceedings to recognize him as evading maintenance obligations in the light of the provisions of the Act of 7 September 2007   on assistance to persons entitled to maintenance. It also deals with the essence of the proceedings regarding the annulment of the decision. Although the court of first instance did not allow such a possibility, the analysis carried out in the paper shows that there are legal grounds for this. The paper concludes that if, after the explanatory proceedings are completed, but before the decision is issued, the maintenance debtor reconsiders and consents to a maintenance interview with  him and for a declaration of assets to be taken from him, the public administration body should take these circumstances into account when making a decision. There was criticism of the thesis that allowing for the validation of behavior contradicts the purpose of the introduced solutions aimed at mobilizing debtors to fulfill their obligations towards those entitled to maintenance. It is pointed out that such an approach from the authorities may have further undesirable consequences, as the effect of issuing a decision on the above-mentioned subject is to initiate separate proceedings regarding the suspension of a driving license. The study also analyzes the way in which the premises for initiating the above proceedings are understood, proposing a different understanding of them. It was concluded that the positive and negative premises for initiating proceedings should be understood by the authority in a functional manner. The position of the Supreme Administrative Court was deemed correct, namely that in nullity proceedings the assessment made by the authority concerns only the examination of whether the decision being contested  is affected by one of the defects specified in the Code of Administrative Procedure.
