Biometric data processing and related data protection issues have gained importance as a result of a wide use of technologies using such data for the identification and verification of data subjects. Problems may arise due to the lack of awareness of the need to comply with the provisions on the protection of personal data. Such a problem could also have arisen in Poland. The Act on personal data protection, no longer in force, did not refer literally to any of the provisions on biometric data. This potentially could raise doubts, inter alia, with regard to the application of this Act, especially since only the General Regulation (Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) introduced a definition of such data and classified them in special categories of personal data, the processing of which will require one of the conditions set out in Article 9(2) of the General Regulation. Such singularity of biometric data results from the source of their acquisition (physiological, physical and behavioural traits). This, however, should not be seen as an argument for the limiting of the processing of biometric data. It is nevertheless important that the processing of these personal data is in line with the principles set out in the General Regulation. The use of biometrics is likely to become more widespread in the long term. This trend is already taking place, but there is a noticeable concern on the part of the data subjects about the collection of these data. The legal provisions repealed in the context of the data protection reform in 2018 have also been taken into account in the deliberations.

Over the several decades of her scientific activity, Professor Teresa Rabska played an outstanding role in the formation of Polish administrative law, particularly during the political and economic transformations of the late 1980s, when Prof. Rabska was actively involved in the field. Within public economic law, the role of the state and its tools for influencing the economy have evolved fundamentally. In this area, the administrative sanctions with which administrative bodies were equipped have developed profoundly and taken on an important function. Undoubtedly, the European Union plays a significant role in the development of administrative penalties. Penalties are imposed in the form of administrative decisions, issued according to procedures governed by the Code of Administrative Procedure. This Code and other laws enumerate the prerequisites for assessing a penalty. Among these, the omission of the element of guilt must be a cause for concern. Consequently, particularly in the case of penalties imposed on individuals, the penalty may be imposed on a person to whom no fault can be attributed in the violation of the law that caused the punishment. The system of fines thus arouses great dissatisfaction among market participants. An analysis of the system of administrative penalties in Poland raises the issue of harmonizing solutions on the scale of the European Union, as it is expected that penalties should be of similar size in all member states. However, the statutory enshrinement of high penalties in the current legislation does not prejudge the practice of imposing them. Given the smaller revenues generated in Poland, the penalties imposed should be proportionately lower. Moreover, the law does not categorically require the imposition of high penalties. The legislation often uses the word “may,” from which some people draw conclusions about the imposition of penalties under administrative discretion, which is not legitimate.

The article presents selected problems concerning instructions in public administration. First, attention is paid to the official instruction. It is issued in service relationships, which differ from employment relationships. By issuing an official direction, the service superior obliges a subordinate employee to perform a specific official activity, including to submit a declaration of knowledge on public issues. An official direction is an individual administrative act.These official instructions are issued when it is necessary to correct the performance of public tasks by a subordinate employee. The obligation to comply with an official instruction is not absolute. The addressee of the instruction may raise objections and even refuse to execute an unlawful official instruction.Instructions issued by a superior authority to a subordinate authority constitute a separate group. Such an instruction is an internal act. It may concern the method of performing tasks or taking specific actions within the scope of operation of a subordinate authority. Instructions issued between public administration authorities are aimed at adapting activities to the directions of public policy and correcting the manner of performing public tasks. There is no appeal against an instruction issued by a superior authority. These are binding.The last category concerns intervention orders. The intervention order does not result from organizational superiority or official subordination. This is a request addressed to the public administration authority to take action to abolish the danger in emergency situations. Intervention orders are issued in particular in matters of protection of life, public health, property, protection of civil rights, maintenance of public policy.

The discussion in this study deals with the legal form of conservation recommendations. This concerns documents issued by conservation services, which define the way of using the monument, its protection and performance of conservation works, as well as the scope of permissible changes that may be introduced to this monument. In simple terms, the conservation recommendation is a “monument operating manual”, which is issued individually for each building by the competent voivodeship historic preservation officer. The legislator did not specify the legal form of this document. Therefore, in numerous studies one can find a number of standpoints on this issue. Undoubtedly, such discrepancies are not conducive to implementing the principles behind the adoption of the regulation on conservation recommendations, i.e. effective protection of monuments. This article analyses the concepts that dominate the doctrine. This is primarily a matter of accepting that conservation recommendations are issued in the form of an administrative promise or an act of knowledge. The concept according to which there is no single legal form appropriate for all conservation recommendations is also examined. At the same time, an attempt is made to discuss the most frequently negated assumption, according to which conservation recommendations could be issued in the form of administrative decisions. The discussion is conducted on the basis of the legal text and academics’ analysis of the doctrine. An important element of the discussion is that it compares the characteristics of the administrative decision with the properties of the legal forms in which, according to the doctrine, conservation recommendations are issued. The conclusion that can be drawn from the analysis presented here is that it would be appropriate to classify the conservation recommendations as administrative decisions.

The article reflects on the issue of the research method in public economic law.     In the first part, the concept of science is explained, which can be understood as     a process consisting in the systematised pursuit of knowledge of the truth for idealistic or utilitarian purposes. The starting point is K. Jaspers’ definition, according to which the concept of science contains three elements: methodical cognition (1), certainty of knowledge (2), universal validity (3). Each of the elements indicated    is then considered. Methodical cognition is to be distinguished from thought. The former is cognition of reality presupposing an awareness of the research method and its limitations. The latter is driven by intuition. The use of the method should be strongly linked to the research objective. The author then refers to the second defining element: certainty in the science of law. In his view, certainty is sought    in answers to questions about the content of the law in force. Secondly, certainty   is sought in the criteria evaluating the law and the results of this evaluation. The third element, i.e. universal validity, is related to the generally accepted methods of interpretation and the fundaments of law lying in human rights and the human dignity that is their source. The second part of the paper focuses on defining the research objective and  the adequacy of the method, referring to the dogmatic, historical and comparative methods that should aim at determination the law in force and its evaluation. In the third part of the article, a proposal for a research method in public economic law is presented, which consists of three elements: presenting the context of the research objective, applying the dogmatic method, and evaluating the law in force. In the last part, attention is drawn to the need for uprightness of life, and therefore ethos, as a condition for the ability to recognize what is just.

The premise of this text is to analyze by means of selected examples the issues related to the broad definition of security, and modern and developing terrorist migration. Moreover, the aim of this paper is to approach the subject in question from the perspective of the current legal state by means of the formal and dogmatic method, but also by means of the method of criticism and analysis of the literature, which will allow a full understanding of the shape, functioning and causes of errors of modern security bodies. The above will influence the formulation of de lege ferenda postulates in the conclusion. The European Union is based on solid foundations. So how does globalisation, in its broadest sense, affect the world around us and the elementary values of the modern world? Modern terrorism, which strikes at the security of developed countries, is undoubtedly a global phenomenon that also sows fear for normal existence in one’s own country. Unrestricted, cross-border terrorist activity is leading to intra-community division. This is the result of internal conflicts over common values. The surveillance and detection of migrants from outside the European community who are criminals is becoming a more difficult task with time. This is due to the fact that terrorist organisations operate according to a well-defined plan, creating extensive networks and recruiting new members for their groups in many countries simultaneously. The fight against terrorism is being waged on Europe’s streets and in the homes and schools of its citizens. The struggle for security begins at the borders of European countries. What is crucial in this fight is the latest equipment and cooperation between security bodies, including the special services of all the countries of the European Union and NATO. It is essential to introduce appropriate legislation to limit the free movement of people who commit crimes and to develop methods to distinguish terrorists from economic migrants or refugees. The state must guarantee the security of its citizens and combat terrorism effectively.
