Practising as a physician, especially during the pandemic, was of interest to the legislator several times due to staff shortages and more. The pandemic also forced changes in many paradigms of providing healthcare services. One of them, con-tained in the so-called ‘Special Covid Act’, was to simplify the acquisition of right to practise as a doctor by a foreigner who is not a citizen of a European Union Member State. The study focuses on one of the facilitations introduced: relinquishment of the four-stage examination on knowledge of the Polish language in favor of submitting a statement on the command of the Polish in speech and writing to the extent neces-sary to practise as a doctor, i.e. resignation from an objective, verifiable assessment, in favor of a civil law declaration will, in principle not verifiable at the time of sub-mission. This solution raises a number of doubts and carries the risk of a medical error. First and foremost, a medical interview, one of the key and initial stages of treatment initiation, becomes impossible to conduct. Secondly, it is also difficult to communicate with other medical personnel. Thirdly, it is doubtful whether another statutory obligation will be fulfilled, namely providing information to the patient about their state of health and obtaining consent for treatment. The mechanism of supervision by another doctor who speaks Polish should also be considered insuf-ficient, as due to the lack of such personnel, it will often be impossible to meet this condition. These and other reasons support a negative assessment of the solutions introduced. A much better solution would be to provide intensive learning of the Polish language, a solution that is proven and used successfully. Referring to the language of the EU directives on the recognition of professional qualifications, it is a “reasonable and necessary” direction.

The SARS-CoV-2 coronavirus pandemic has changed how almost every sphere of our lives functions. Its greatest impact can be seen in the functioning of the health care sector, whose task was not only to care for the sick or people suspected of infection, but also to take all measures to prevent the spread of infections. The imposition of a state of epidemic threat in Poland, and then the state of epidemic, provided a basis for imposing a number of restrictions that had a significant impact on the realisation of patients’ fundamental rights. The purpose of the considerations is to present and analyse the limitations of selected patient rights during the SARSCoV-2 pandemic. This article first presents issues related to patient rights in genere, emphasizing their importance for the proper functioning of the health care system in the country. Next, the limitations of selected patient rights, which unquestionably occurred in the era of COVID-19, are presented. It is shown that the rights indicated were not only limited, and sometimes even excluded. The article also presents an analysis of the annual reports of the Patients’ Rights Ombudsman, which in their content confirms the great increase in the number of violations of patient rights in the period of SARS-CoV-2 pandemic. Consequently, this resulted in a far-reaching negative impact on the perception of the health care system in our country.

Pursuant to Article 68(3) of the Constitution of the Republic of Poland, a pregnant woman is entitled to special care from the State. Therefore, it seems extremely important to indicate uniform, universally binding standards in order to improve the quality of services provided and to respect the fundamental rights due to women and their children in maternity care. Unfortunately, as the analysis and reports concerning the observance of patients’ rights during the perinatal period show, the current standards are not always properly implemented by medical institutions, and the legal guarantees of observance of perinatal care standards are not sufficient. The aim of the article is to discuss the legal regulations in force in the field of perinatal care, to indicate their subject and subject scope and to conduct a legal analysis of the proposal of new organisational standards of perinatal care, which are to enter into force as of 1 January 2019. The basis for the discussion is the presentation of the legal form of the existing standards of perinatal care. It is extremely important to answer the question whether the principles of medical knowledge should be enacted in the form of standards of medical procedure in the form of universally binding normative act, or whether they should constitute guidelines and recommendations that are legally non-binding. Perinatal care standards in the context of the duty of doctors and medical staff to apply current medical knowledge and to act with due diligence deserves additional attention. The article contains a detailed analysis of the proposal of new standards and presents de lege ferenda postulates, especially in the field of legal guarantees of observance of perinatal care standards in Poland.

The right to use health services, including spa treatment, is one of the basic patient rights. The specificity of the issues undertaken stems from at least two sources. First of all, patients are a special category of people, because human health, as the highest value possessed by every human being, is subject to legal protection and requires their rights and freedoms are guaranteed. Secondly, spa treatment, which is an integral part of the health care system, corresponds to art. 68 of the Polish Constitution, assuming the fundamental principle according to which every citizen has the right to health care. On the other hand, this treatment means providing health services, which are conducted only in a separate area of the spa commune – a spa and in specially adapted medical entities – spa treatment centers. The study covers the concise genesis of patient rights and the notion of the patient in terms of doctrine and legislation. Moreover, it contains the basic concepts related to spas. Recognition of the health needs of society is associated with a presentation of the individual types of spa treatment centers and spa treatment facilities, as well as the necessary conditions that they should meet. Due to the existing different status of patients in spa treatment institutions, the analysis covers the basis for admission, for referring and qualifying patients to these centers, and also the rules for using services guaranteed in the field of spa treatment. The patient’s right to health services is also examined in the context of using these services. Despite the fact that patients’ interest in this form of treatment increases every year, as is shown by the available data, there are a number of legal and organizational problems related to access to treatment as part of spa services.
