One of the main directions of activities conducted by the Agricultural Property Agency is to support agricultural farms. The most significant manifestation of such activities, aimed at supporting this objective, is the sale of land from the Agricultural Property Stock of the State Treasury to individual farmers who wish to enlarge their family farms, under a restricted tender procedure. Although the Act on the Management of the Agricultural Property Stock of the State Treasury also provides for other categories of entities – i.e. other potential participants of such restricted tenders, the procedures aimed at individual farmers are of the greatest importance in the Agency’s activities in this field. However, it should be noted that the statutory regulation concerning tenders for the sale of land with a view to supporting family farms is not complete and does not provide for any legal instruments designed not only to ensure that the land will be acquired by persons with adequate qualifications, but also that such land will be used by the purchaser for the conduct of agricultural activity. Therefore, the Agency introduces appropriate clauses into agreements with such purchasers in order to ensure that agricultural activity is conducted on the land acquired by them. However, the acceptability of such clauses may raise reasonable doubts.

On 1st January 1992, the Act on management of agricultural land owned by the State Treasury of 19th October 1991 (hereinafter referred to as the Act) came into effect, which introduced new legal regulations concerning the principles of management of property owned by the State Treasury with reference to agricultural land and other kinds of real estate as well as property left after liquidation of state agricultural enterprises (Polish: państwowe przedsiębiorstwo gospodarki rolnej; hereinafter referred to as ppgr), real estates which on the day of the Act’s coming into effect were under management of state organisational units as well as real estate in perpetual usufruct by natural and legal persons; in usufruct or beneficial estate by natural persons, legal persons and other organisational units; in the State Land Fund. With this Act the process of changes in the structure of ownership of agricultural real estate began, real estate that had been taken over to the benefit of the State Treasury on grounds of the decree on agricultural reform of 6th September 1944, as well as on grounds of other legal titles (e.g. in exchange for allowance or retirement pension, or taken over by the state by way of other titles on grounds of later legal acts). In order to accomplish the goal of introducing changes in the structure of ownership of agricultural real estate by virtue of the Act of 19th October 1991, the Agricultural Property of the State Treasury Agency was established. The Agency was invested with attributes of a state–owned legal person, which the State Treasury in accordance with art. 5 of the Act entrusted with exercising ownership rights and other property rights to the benefit of the State Treasury in relation to the aforementioned property. As a consequence whereof, on the day of the Act’s coming into effect, i.e. on 1st January 1992, the Agency entered into possession of elements of property of the State Treasury it was entrusted with (above all property left after liquidation of state agricultural enterprises), and exercises on its own behalf the rights and obligations related to them towards third parties, as well as on its own behalf exercises public law liabilities related to these elements, and liabilities resulting from administrative decisions. The Agency also inherited the liabilities of ppgr, what is to be considered an exception to the principle voiced in the Civil Code that state–owned legal persons are not responsible for the liabilities of the State Treasury. Thus the Act on management of agricultural land owned by the State Treasury, being a unique legal instrument, modifies the ruling of art. 40 § 1 of the Civil Code. The Agency is only a trust institution of the State Treasury, an institution which is the administrator of the right the State Treasury is entitled to. In no way is the Agency entitled to property rights in relation to property entrusted to it, whereas the State Treasury in no way ceases to hold ownership of the property entrusted to the Agency. However, one has to assume that the Agency is entitled, in relation to the property entrusted to it, to any and all rights listed in art. 140 of the Civil Code. The activity of the Agency as trustee constitutes, in a sense, a statutory specification of tasks of the administrative body that the Ministry of Agriculture and Rural Development is. However, describing the Agency as a unique state–owned legal person seems most appropriate, a state–owned legal person executing statutory and public administration tasks, including appointed to it public administration functions. Executing the tasks imposed on it by the legislators, the Agency not only makes use of civil law, but also of administrative law mechanisms.

The article discusses the evolution of the legal status regulating management of agricultural property owned by the State Treasury. It presents this evolution as the consequence of multiple, often provisional actions of the legislator conditioned by changing political objectives, which results in an incoherent model of Agricultural Property Stock of the State Treasury aiming to serve the development of a specific agricultural system in Poland. The incidental nature can also be attributed to the regulations used as grounds for establishment of the National Support Centre for Agriculture in 2017. These provisions were supposed to implement the longdemanded closing of the Agricultural Property Agency. However, this demand was previously associated with the need for definitive distribution of the Agricultural Property Stock owned by the State Treasury through the completion of its restructuring process and ultimately its privatisation. Meanwhile, the establishment of the National Support Centre for Agriculture only means that the past activity of the Agency will continue under a new name and that the Stock will function as property used exclusively for restructuring purposes in the near future. Such legal conditions make it difficult to achieve the main objective of state agricultural property management, which is to facilitate access to agricultural land for farmers with respect of their economic interests.

The subject of discussion in this article are the processes of progressive emancipation of state public bodies(organs) in the agricultural economy. In particular, we show that it is necessary to make a partial contemporary observation, which should strive towards establishing a better research tools to study the functioning of government agencies in the agricultural sector. After a nearly 20-year period of the legal mechanisms for the management of state agricultural property there is a need to summarize the state policy in this sector.Choosing this theme, in light of recent amendments to the Law on Management of State Treasury agricultural property is not only necessary but urgent.

In the nineties of the last century there was a return to the traditional distinction between private property and public property, which is the division derived from the basic division of private law and public law. At the same time there was retained the subjective diversity between state agricultural holdings, cooperative agricultural holdings and individual agricultural holdings. Each agricultural holding as set of factors of agricultural production, which is organized as economic unit, does not serve to realize the interest, or the public purpose, therefore in the property classification into categories of public and private property, agricultural holding should be ranked as private property, regardless of the legal nature (legal entity or natural person) of the entity who is its owner. Among the total number of agricultural holding there must be extracted the following categories: individual holdings run by farmers –individual natural persons; holdings belonging to the agricultural producer groups; cooperative holdings, run by agricultural production cooperatives, and state holdings.

The article deals with the issue of using on a non–contract basis properties from the Agricultural Resources of the State Treasury managed by Agricultural Property Agency. Above–mentioned problem is regulated in the art. 39b of the act on management of agricultural property owned by State Treasury. General provisions regarding to the problem of payment for using thing without contractual basis is governed by Civil Code, but the legislator introduced that special provision referring to the legal consequences of possessing state–owned properties. Author states that the result of the literal interpretation of art. 39b leads to unjust results and violates axiological values associated with this regulation. There are no axiological justification to assume that the possessor acting in good faith should be treated in the same way as possessor acting in bad faith. Only the result of functional interpretation is acceptable, because it leads to conclusion that possessor acting in good faith is not obliged to pay for using property without contractual basis.

The main tasks of the Agricultural Property Agency have been changed during the last eighteen years. These tasks are defined in art. 6 of the act on management of agricultural property of the State Treasury. The most important changes in this respect were made in 2003 as a result of regulations introduced by the act on formation of agrarian system. In particular the Agricultural Property Agency is obliged to carrying out of the privatization and restructuring of the agricultural properties owned by the State as well as to support improvement of family farms structure. The Agricultural Property Agency, carrying out its tasks, sales and leases the state property by using the tender procedures. To improve family farms structure, the Agency was granted with a statutory pre–emption right as well as with a right of acquisition of agricultural property. However, the final results of its activity are not satisfactory, as in the Agricultural Resources of the State Treasury still remains 2,6 million hectares of land.
