Opis:: The subject of the study is to determine the principles of investment planning in rural areas with the participation of the European Agricultural Fund for Rural Development. The paper discusses the principles of programming financial perspective 2014-2020, taking into account the need to coordinate support from the European Agricultural Fund for Rural Development and the Structural and Cohesion Funds. Attention has been paid to the need to coordinate support from the European Agricultural Fund for Rural Development in territorial terms, taking into account the standards of planning. Rural development should address the concern of its multi – functionality, where apart from the production function development of other functions to ensure the environmental protection, to maintain natural landscape and traditional cultural values are also assumed. Such approach requires taking into account the role of planning in view both strategic and development as well as spatial aspect.

Opis:: This Article shall aims to show the normative form of rural development policy in the perspective of the years 2014–2020. The problem of the above issues was set out detailed in the comprehensive package of legislative proposals relates to supporting rural development, financing of agricultural policy and regulations in structural funds. The proposed changes of rural development are determined by several factors, in particular international context, height of the agricultural budget, the legislative changes introduced by Treaty of Lisbon and new global challenges, such a global warming, lack of energy sources, water shortage. It should be emphasized that new goals and priorities of rural development were set out in discussed legislative package. Furthermore the above sets out new legal measures regulating agricultural policy – aimed at promoting innovation, preventing adverse effects of climate change, increasing the share of renewable energy. In proposed arrangements, a far – reaching modifications of rural development policy’s instruments were set out, especially that which relates to agri–environment payments system (that is LFA payments). In connection with the appearance of various risks in the agriculture sector having natural, market and sanitary features, the legislative package also provides a new set of risk management legal instruments. Referring to the financial aspects of rural policy, it was pointed out to the fact that despite the planned extension of the scope of rural policy, current level of financial support for rural policy has been kept. This openes to doubts. It should be added that the increasing tendency of shifting the cost of financing the rural policy on national budgets, which in a single agricultural market will contribute to the diversification of the competitiveness of the agricultural sectors of each Member States of the EU – was also negatively assessed.

Opis:: The article presents the relations between the legislator’s activities aimed at the formation of the agricultural system structure and the instruments for the planning and spatial development of rural areas. The agricultural system may be defined as a set of internal and external legal, economic and social relations concerning the operation of agricultural farms. Among the external relations, an essential role is played by the relations resulting from the spatial situation of agricultural farms, directly associated with the use of land and other natural resources. During the interwar period these relations were structured correctly in both the constitution and statutory law. The structure of rural space was formed with due account of the interests of not only farmers, but also other users of the space, as well as the developmental needs of urban settlements. These relations were considerably disturbed during the communist era because of the concept of agriculture socialisation, which left a permanent mark on rural space. Liberalisation of agricultural property trading as of 1 October 1990 and unavailability of appropriate instruments in planning and spatial development laws supported the harmful phenomenon of rural space being used for non-agricultural purposes. Rural space shrank against the principle of sustainable development. The amendment of the Agricultural System Structure Formation Act, made on 14 April 2016, is an opportunity to bring back the proper relations between formation of the agricultural system structure and formation of the rural space structure.

Opis:: Space development has, in view of limited nature of the space and persistence of its effects, axiological dimension. The regulations governing development also intervene within the range of exercising property right, what is a source of conflict of interests and what touches the issue of justice. Development of a particular space can take place under one of two competitive legal regimes. One of the regimes is established by local development plans constituting acts of local law which is commonly in force within territories covered by such the acts. In a position of the absence of a local development plan the other of the regimes, determined by rules of the law of general public order, is applied. The referred rules make the basis for giving, under the administration procedure, individual decisions on determining conditions for site development. Agricultural lands located outside administrative borders of towns, constituting arable lands of I–III class, whose contiguous area purposed for change of development classification exceeds 0.5 ha are excluded from the opportunity to obtain such a decision (a permission for development). However, the exclusion does not refer to development which fails to lose agricultural nature of a land. The courts’ decisions represent the opinion that the surface limit refers to the area which effectively is to change the way of development, not taking into consideration the land from which it was earlier parcelled out, what without doubt decreases protection level of agricultural lands. Other dissimilarity connected with determining conditions for site development of agricultural lands is departure from the statutory rule of “good neighbourhood” in case of farmstead development in farms whose surface exceeds an average farm surface area in a commune.

Opis:: Measures implemented in Poland under the Rural Development Programs (RDP) can significantly contribute to improving the competitiveness of the polish agricultural sector. One of the factors affecting the effective implementation of the RDP are the legal procedures used for the granting of financial support. The article discusses the procedure for granting financial support from RDP adopted in the Polish legislation. The discussion leads to the conclusion that fully justified is the solution in which in some measures the financial support is granted on the basis of an administrative decision, and in another measures on the basis of agreement. The article criticizes the scope of changes to the provisions of the Code of Administrative Procedure, made for the granting of financial support. The above–mentioned changes on the one hand does not simplify the procedures granting of financial support, and on the other hand, definitely weaken the legal situation of the applicant, which is not justified by the principle of proportionality. The author concludes that the procedures adopted by the Polish legislator are mainly aimed at protecting the financial interests of the EU, but does not take into account the need to support the development of the competitiveness of the Polish agricultural sector.

Opis:: In the process of shaping the Common Agricultural Policy, there continues to dominate the search for legitimizing support, in particular for direct payments, as well as the need to achieve a political compromise regarding sensitive regional issues of agriculture and rural areas. This situation does not serve to improve the quality and transparency of law, understood in particular as preventing excessive occurrence of legislative changes and undue fragmentation of the rules. Also, as a result of the recent reform, it has been decided not to make any radical solution toward simplifying the most important instrument of direct payments. The indicated by the European Commission simplification elements introduced in the CAP after 2013, in comparison to the new complex solutions, are of a symbolic nature. The introduction of the multi-component system of direct subsidies, including payments for greening, will result in a significant increase in the cost of administrative services for the mechanism. Therefore, the demand to simplify the Common Agricultural Policy is still valid and urgent as the previous efforts aimed at its realization have proved to be counterproductive.

Opis:: The next EU financial perspective 2014–2020 will bring many changes in designing and implementing of EU aid in the area of the Common Agricultural Policy, especially in the rural development policy. These changes bind proposed mechanisms of the Common Agricultural Policy with the Europe 2020 Strategy. This strategy envisages greater integration of the objectives of the Common Agricultural Policy with the objectives of other EU policies (regional policy, social policy, cohesion policy, fisheries policy). Author of this article is not fully convinced of the effectiveness of these changes. This view results from decreasing aid measures for each of these policies. Moreover, the European Commission has been granted powers to determine the distribution of this aid measures without clear criteria. Execution of the Programme of Rural Development Area may be jeopardized because of the expected shift of some funds from the European Agricultural Fund for Rural Development to financing direct payments. For the full realization of the objectives of rural development policy, it is necessary to clearly specify the size of the funds allocated to rural areas in aid programs financed by other funds of the Common Strategic Framework.

Opis:: Environmental protection is an integral part (component) of actions as well as financial and legal instruments undertaken in the course of the two pillars of the Common Agricultural Policy: market and income policy and rural development policy. Such protection is the aim pursued in the programs and legal regulations of the Common Agricultural Policy, and legal mechanisms of environmental protection, act as instruments of the Common Agricultural Policy, giving reasonable assurance, flexible but effective protection of the various elements of the natural environment. Imposing an obligation to protect the environment is justified in the concept of sustainable development of agriculture, as such development meets the needs of future generations. Connection between the obligation to protect the environment, which is the public aim, with economic activity in the private farmstead, does not raise doubts from the point of view of the principles of distributive justice. The legal construction that explains such a solution is, proposed by A. Stelmachowski, the concept of agricultural property, as a complex of rights and obligations determining the legal situation of the entity – the owner of the farm. A characteristic feature of agricultural property is that these obligations relate not only to specific individuals, but to the State representing the public interest of society as a whole. In exchange for the due performance of agricultural property, the owner has the right to expect assistance from the state, when they exercise their ownership rights.

Opis:: The new financial perspective covering the period 2014-2020 has brought many changes. The main priority of the new rural development policy is to improve the competitiveness of farms, having regard to environmental objectives. Rural Development Programme for years 2014-2020 will encourage further restructuring and modernization of farms and development of agri-food processing as well as strengthening their competitiveness in EU and global food market. Development of farms will also be supported by seven sub-measures of current Rural Development Programme. The most important needs of rural areas have been established using the popular SWOT analysis. Implementation of these needs is to induce specific criteria for the access to the various forms of financial assistance as provided for in the Program. Author of this article takes the view that they have been aptly chosen and should result in effective implementation of the objectives of the current Rural Development Programme.

Opis:: Today, the issue related to spatial planning in rural areas takes on particular significance. In this context a reference to the views of Professor W. Pańko is justified, as they remain perfectly stable. The planning is an instrument promoted by EU which enables permanent and sustainable development of rural areas. The planning is an imminent and integral element of the notion covering the management, as it concerns spatial planning in any economy system. The issue of spatial planning in rural areas should be viewed from the point of view of its functions (synchronisation, coordination and information), where the two last ones takes on particular significance for development of them. The coordination function plays an important role for the policy to support development of rural areas from the Union and national resources; it is expressed in the contents of local master plans and relates to the coordination of actions, as well as the organisation of cooperation among entities operating on the areas in concern and bringing together their interests. The information function, their place and actions in which satisfies openness and transparency of planning procedures gives all entities the awareness of their place and actions in economic space and its value. Construction elements of the prescriptive model of spatial planning ensure logic link between documents which designs spatial management of a commune (strategies of commune development, the spatial development conditions and directions study, local master plans) aim to ensure the spatial order and the sustainable development of communes in rural areas. The process of using the specified mechanisms is a very comprehensive, long-lasting, time consuming and expensive process, therefore there is a huge gap between the prescriptive model and the actual process of spatial development of rural communes. Current prescriptive model of spatial planning gives almost the same attention to the organisation of agricultural space as the legal regulation of 70s of the XX century. This raises the question on the adequacy of the referred model to organise development processes of the current agriculture, as on the one hand the model (the study and the local master plan) seems all perfect, then costly and heavy, and on the other hand a stream of funds for development of rural areas it is intended not only for the agriculture, but also for the whole multi-functional rural area. As the notion of a rural area is not the same as the notion of an agricultural manufacturing space then the concept of multi-functional rural areas should be matched by its expression and reflection in the instruments of spatial planning. However, the provisions of the act on spatial planning and development fail to pay attention to this issue special interest. In the paper’s content the Author seeks to respond to the dilemmas on this matter.
