The principle of this article was not only the legal analysis of the content of the agricultural property lease agreement concluded by Agricultural Property Agency but, above all, positioning of this Agency in the process of concluding the abovementioned agreement. The necessity of looking into this matter again resulted from large scale changes in the Act dated 19 October 1991 on the management of agricultural properties owned by the Treasury and accompanying acts, introduced by the amending Act dated 16 September 2011 which came into effect as of 3 November 2011. The changes largely concerned the lease of agricultural properties owned by the Treasury. The basis of the article constituted also a lawsuit, during which the Agency was a party. The lawsuit caused changes in the property sale and lease procedure. The article also presents the basic legal requirements for the functioning of Agricultural Property Agency. The introduced legislative changes exposed the monopolistic position of the Agency. The statutory tendency to liquidate lease of the state–owned agricultural properties was also clearly presented, what met with criticism in the doctrine. Moreover, concerns were also aroused due the fact that the amended Act on the management of agricultural properties owned by the Treasury introduced legal instruments which allow for the unilateral interference in the content of lease agreements concluded for a definite period of time. Undoubtedly, the tenant of the state–owned agricultural property, in case of the greement concluded for a definite period of time, should receive a far–reaching legal protection. Only this type of protection guarantees achievement of the economic objective and allows for the permanence of management of the land held under lease. The amended act questions this permanence.

The draft bill on shaping of the agricultural system which is to repalce the current version of the Act of 11 April 2013 was submitted to the Parliament by Polish People’s Party in in July 2014. Beyond aims listed in the article 1 of the Bill, undoubtedly it is also to create more effective than the present ones mechanisms counteracting the possibility of acquisition of agricultural lands by foreigners. Planned arrangements are partly based on the current Act of 2003 and there are also new instruments proposed, such as obligatory mediating of Agricultural Property Agency in the sales of every agricultural property irrespectively of its size, as well as prohibition of sale and encumbrance of the agricultural property purchased by tender for 10 year of the date of purchase. The proposals are ill-conceived from the agricultural activity practice point of view and the limitations go far beyond the nature of property right, which is contrary to the Constitution.

Opis:
The manner, in which a written tender has been regulated in the Act of 19 October 1991 on Management of the Treasury Agricultural Property, shows many specific features. Similar to other tender procedures provided for in other legal acts, in particular in the Civil Code, it is a multilateral and qualifying procedure. However, unlike other tender procedures, price of the land is not the subject of competition of the participants. Moreover, no provision of the future agreement of sale is defined in the course of the tender. This makes it a unique solution, to which the tender provisions contained in the Civil Code may be applied only by analogy. It seems that this applies to regulations of the Civil Code related to the claim to conclude a contract of sale, the annulment of the contract concluded by invitation to tender and the effects of lodging the security to the extent not regulated by the Act on Management of the Treasury Agricultural Property.

Space is a joint interest that requires legal protection ensured through administrative (authoritarian) legal instruments. The value of this interest is incalculable, thus the instances of restriction of land ownership are not an infrequent occurrence. The main legal instrument affecting space development is the local land use plan adopted by the competent municipal or rural council. This document underlies a variety of decisions (administrative and judicial) involving land use. One of them is the decision approving the property division plan. The solutions adopted in the plan must be in line with the aforesaid land use document. If the divided property is not covered by a land use plan, the conformity of property division is determined based on the location decision or, if the latter is absent, pursuant to the specific provisions governing land use. Polish regulations on the rules and procedures for property division were laid down as early as in 1928. These rules and procedures have been altered several times ever since. Currently, the effective law is Articles 92–100 of the Act of 21 August 1997 on Property Management (consolidated text: Journal of Laws of 2010, No. 102, item 651 as amended). The measures adopted in the new law differ from previous solutions. By and large, the new regulation stipulates the control of divisions of land lots and not the divisions of larger property that may consist of many lots. This may come as a surprise since the manner of using land property in accordance with the local land use plan or other documents is contingent upon the area and shape of the property rather than the area and shape of a parcel being part of that property. This paper aims to assess the adopted solutions on the division of property against the modifications made and from the viewpoint of legal risks that arise from these new regulations. The currently binding arrangements regarding the division of property have been assessed positively in principle although they narrow the scope of property division control. With regard to the specific regulations, they are not entirely consistent, which is the source of certain legal risks associated with property transactions.

The subject of thorough analysis is, among others, the effectiveness of the performed transformation and one of the first attempts, in Polish science, to compare the legal changes; the attempt to answer the research question concerning the method of the implemented changes – whether the administrative and legal regulation has brought the expected results and whether all legal institutions relevant to the private law have been used appropriately; results and method of the performed inspection and supervision of the process of ownership changes in both of the countries in question. One of the basic purposes is to answer the question of how the national administration interfere in the legal turnover of agricultural real estate nowadays and how the national agricultural property influences the legal turnover of real estate. The analysed legal regulations of both countries become an interesting research area. In both cases the process of ownership changes began similarly but the further changes were proceeding differently; also, the ultimate result of the system transformations is different. The execution of the project enabled to reveal advantages and disadvantages of the changes implemented during the last 20 years. It also enabled to suggest de lege ferenda changes in the Polish Law, which made it possible to reasonably manage the agricultural real estate being the property of the State Treasury, including the transformations of the Agricultural Property Agency.

The concept of agricultural property as proposed by A.Stelmachowski relies on the association of the original construction of property law with its specific object, i.e. the farmstead. According to this concept, agricultural property (specified in respect of the matter of ownership) is a complex of laws and obligations describing the legal standing of the subject – farm owner. The concept of agricultural property is an important element of the doctrinal accomplishment underlying the distinguishing of agricultural law as a new branch of legislation; it may also form – on the didactic level – an axis to organise the presentation of agricultural law institutions. Core ownership issues are obviously regulated by civil law. To describe the general features of property law, as a particular legal category, A.Stelmachowski indicates that property law 1) possesses the most comprehensive content as regards the relationship of the subject to the property attributed to him; 2) awards the owner exclusive right (a certain monopoly) as regards a specified object; 3) is characterized by a singular flexibility. All of these features can be referred to various kinds of ownership, regardless of its subject, including agricultural property. The originality of A. Stelmachowski’s approach to ownership arises from a proposed construction which is different to the classic, civil law model of ownership. This model has been inherited from Roman law (triad of ownership), which stressed the absolute rights of the owner. The owner had rights but no obligations towards the others, on the contrary, they are obligated to respect the rights of the owner. The protection of agricultural property is a continuation of the essential idea of the concept Author, and thus encompasses not only the substantive nature of agricultural law but property, that is a farmstead, itself. Important are both the subject and the scope (intensity) of protection. To protect the individual components civil regulations on property are applied, and to protect the farm, it is necessary to restrict the right to dispose of its components at will. When considering the subject of protection, one should take note of two elements: 1) what goods in various historical periods effected protection of the property law, and equally 2) whose interests were taken into account when awarding the protection, in other words, this will be a query regarding the function of property law. The interest (function) which brought about protection of agricultural property in the legal order currently in place in Poland could be described as execution by farmstead proprietors of European Union legislation on the use of agricultural holdings. Similarly as in the period of socialist economy in agriculture, the legal measures are rooted in a model of farming administration developed outside Poland, and introduced here.

The main purpose of this paper is to analize few selected aspects of the article 28a of the Act on management of the agricultural properties owned by the State Treasury. It is one of the legal instruments aimed at prevention against excessive concentration of agricultural properties. Important issue is to verify opinions formulated in the legal doctrine regarding to legal sanctions associated with above mentioned regulation. Author states, that violation of that legal norm causes nullity of sale contract. There are no justified reasons to assume another concept formulated in legal doctrine. Particulary, the author disagrees that it is norm without a sanction. Paper deals also with the problem of the definition of family farm in the legal regulation of tender procedure conducted by Agricultural Property Agency. Family farm is defined in the act on formation of agrarian system and it is not necessary to create different definition exclusively for tender procedure regulation.

The institution of agricultural exemption is the most significant economic importance from all limitations to the exclusive right to the plant varieties. The agricultural exemption shall mean the derogation from the assumed protection model of plant variety rights, the objective of which is to defend the interests of farmers. Protecting the interests of farmers within the institution concerned is provided through their entitlement to benefit from the material harvested from plant varieties protected by the exclusive right as the seed without the breeder’s consent. So far-restricting protection of the exclusive right to the variety may lead to disintegration of the referred right, unless the legislator ensures the breeders legal instruments to offset their legitimate interests. Both at the Community and the national level such instruments shall be the entitlement to collect a fee for the agricultural exemption, the entitlement of the breeder to demand the information on a scope of the use of the institution of agricultural exemption, as well as the entitlement to check the compliance of the obtained information with the actual data. The latest draft amendment to the plant variety protection act fails to satisfy the principle to balance interests of the parties for obligatory relations of the agricultural exemption. In Poland its potential adoption and coming into force may be the essential factor which shall make the protection of the exclusive right regarding plant varieties at national level illusory.

In the nineties of the last century there was a return to the traditional distinction between private property and public property, which is the division derived from the basic division of private law and public law. At the same time there was retained the subjective diversity between state agricultural holdings, cooperative agricultural holdings and individual agricultural holdings. Each agricultural holding as set of factors of agricultural production, which is organized as economic unit, does not serve to realize the interest, or the public purpose, therefore in the property classification into categories of public and private property, agricultural holding should be ranked as private property, regardless of the legal nature (legal entity or natural person) of the entity who is its owner. Among the total number of agricultural holding there must be extracted the following categories: individual holdings run by farmers –individual natural persons; holdings belonging to the agricultural producer groups; cooperative holdings, run by agricultural production cooperatives, and state holdings.

The aim of the article is to present the essence and function of the municipality responsibility to the owner (perpetual usufructuary) of the real property related with the adoption or amendment of the local master plan pursuant to Section 36 of the Act on Spatial Planning and Development of 27 March 2003. The aim of the Author is also to highlight essential interpreting problems concerning Section 36 of the Act on Spatial Planning and Development which have been revealed under the ruling of the Supreme Court. The paper describes in detail which legal and financial results does the local master plan bring for a person when coming into force. The Act determines the extent of the allowable entitlement of the owner of the real property to make use of their right, but it also may influence the value of the real property included in such a plan. As a result, entering into force of the local master plan may affect the owner’s right to make use of the real property and decrease its value. The above implications constitute the basic reason for ascribing responsibility to municipality pursuant to Section 36 of the Act on Spatial Planning and Development. In attempt to analyze the legal character of the municipality responsibility pursuant to Section 36 of the Act on Spatial Planning and Development, it was also referred to rules of the Supreme Court. According to that some essential interpreting doubts were highlighted which were evident in the rules of the Supreme Court concerning the local master plan. They referred to: 1) the concept of damage and ways of assessing its value, 2) the stipulation for units entitled to assert their claims pursuant to Section 36 (1 and 3) of the Act on Spatial Planning and Development, 3) interpretation of requirements for municipality responsibility.

This paper concerns the problem of the real estate transactions in which spouses are involved. Therefore, in the first place the laws that govern marital property systems are examined in order to investigate how the fact of marriage and the choice of a given marital property system influences the legal situation of spouses. The analysis leads to a conclusion that the legal situation of spouses is determined not so much by the very fact of marriage as by the marital property system that is binding in a given case. Spouses may structure their property relationship in such a way that they retain full independence in taking legal actions concerning the disposal, charging, or acquisition of real estates. However, at the same time there appear special legal regulations that refer to various public law issues, e.g. diverse forms of support within the Common Agricultural Policy. In these regulations the legal situation of spouses is created in a different way, because the very fact of being married becomes a decisive factor, regardless of the marital property system adopted by the spouses.

The joint land properties belong to the dwellers of a given commune. Their land covers almost 100 thousands ha. They have a long history, but from the legal side, they were established in 1963. Since then, the basis legislation has not change much, unlike the political, social and economic situation in Poland. Nowadays, the joint land properties quit often are run against the law, many of them have not established the proper partnerships and do not act in required way. Thus the legislator has made an attempt to change such a situation. The article attempts to analyze the suggested changes in the legislation. It considers both the proposal of their elimination and as well as their maintenance with some legal modifications. Those aspects are analyze from their historical, practical and legal points of view.

Ownership is the main property right which gives the fullest control over a thing and, simultaneously, imposes the obligation to respect that control. The situation is totally different in respect of limited property rights. The limited property rights entitle a person to exercise some rights, which are typically given to an owner, on another person’s thing. The right of transmission easement constitutes a special, separate type of easement and it limits the ownership. The introduction of that right was a legislator’s response to the postulates made by transmission entrepreneurs to regulate the use of the real estate on which distribution equipment has been or is planned to be constructed. The possibility to acquire transmission easement by acquisitive prescription still causes numerous disputes both in the doctrine and among legal practitioners. That claim raised by the entrepreneurs entails the necessity to prove that the transmission entrepreneur and their legal predecessors used another person’s real estate in exactly the same way as it would have been used by the person who is entitled to the transmission easement (from 2008) or to an easement analogical (similar) to the transmission easement (until 2008), namely by using permanent and visible facilities which in this case are designed to transmit electrical energy (energy transmission, equipment maintenance, checkups and repairs).

Professor W. Pańko as a scientist was very keen on many scientific disciplines covering private law and public law. His interests were connected with the issues of property right as well as town and country planning. On this plane there criss–crossed various threads: urban, agricultural, ecological. Two monographs have brought the significant role in development of the doctrine of agricultural law and theory of real estate property, i.e. “Land property in planned spatial development” and “About property right and its present functions”. The conceptions presented in the monographs have had undisputed impact on to development of the idea and the research directions in agricultural law and spatial planning. The negative appraisal of the legislative system of spatial planning within rural contemporary to him (in force in years: 1972–1986) and his influence on to shaping rural space is still actual. Therefore, requirement for improvement of the spatial planning system, including protection of rural spaces where the scope of spatial planning system should be provided with significantly stronger protection in a form of for example development plans of arable grounds, however approved by a voivode. In view of the increasing number of non–agricultural development of the new rural development acceptance of such solution becomes necessary, the process of dying out and devastation of farmsteads and development on rural areas, the decreasing number of agriculture land resources subject to strong pressure of the capital. This process can be favoured by the special support systems for rural areas from the European Union funds (for the years: 2014–2020) supporting differentiated economic activity, not only the agricultural one. Consequently, the absence in the spatial planning system of special protection instruments for agricultural production in rural areas may little by little bring to devastation of the agricultural environment.

Opis:
The notion of Bug River property regards the property abandoned within the territory of the Republic of Poland within its pre–war borders which after the year 1945 were abandoned outside the present–day territory of the Republic of Poland. For objective reasons, and because of the lack of the concept providing the final solution, only in 2005 an act to ensure comprehensive regulation and procedure of awarding compensation for movable property abandoned outside the present–day borders of the territory of Poland was passed. In the Act of 2005 the Bug River People were granted a right to compensation for the property left beyond the Polish borders. The entitlement to have the value of property abandoned outside the present–day Polish borders offset is affirmed by the voivodship offices competent with regard to the place of residence of the applicant – the property’s owner and in case of inheritors – with regard to the last place of residence of the property’s owner. The voivod’s decision confirming the right to compensation determines persons eligible for this right, the value of abandoned property, the amount of compensation and the form of its implementation. The right to compensation may also be implemented through allowing the value of property left by Polish nationals beyond the Bug River to be offset against the price to be paid for State–owned land
