The aim of the article is to present the essence and function of the municipality responsibility to the owner (perpetual usufructuary) of the real property related with the adoption or amendment of the local master plan pursuant to Section 36 of the Act on Spatial Planning and Development of 27 March 2003. The aim of the Author is also to highlight essential interpreting problems concerning Section 36 of the Act on Spatial Planning and Development which have been revealed under the ruling of the Supreme Court. The paper describes in detail which legal and financial results does the local master plan bring for a person when coming into force. The Act determines the extent of the allowable entitlement of the owner of the real property to make use of their right, but it also may influence the value of the real property included in such a plan. As a result, entering into force of the local master plan may affect the owner’s right to make use of the real property and decrease its value. The above implications constitute the basic reason for ascribing responsibility to municipality pursuant to Section 36 of the Act on Spatial Planning and Development. In attempt to analyze the legal character of the municipality responsibility pursuant to Section 36 of the Act on Spatial Planning and Development, it was also referred to rules of the Supreme Court. According to that some essential interpreting doubts were highlighted which were evident in the rules of the Supreme Court concerning the local master plan. They referred to: 1) the concept of damage and ways of assessing its value, 2) the stipulation for units entitled to assert their claims pursuant to Section 36 (1 and 3) of the Act on Spatial Planning and Development, 3) interpretation of requirements for municipality responsibility.

The general normative model of spatial planning is not adequate to the current needs of the organization of rural development. Expanded and procedurally unwieldy local spatial development plan serves well as an instrument of organizing urban development (within the administrative boundaries of cities). Used for rural development focuses on the use of the agricultural production space, notwithstanding the fact that rural areas are not only the areas of agricultural production but also a multifunctional areas, inhabited by people working outside agriculture. The doctrinal proposal is the postulate to consider the legitimacy of separation two categories of local spatial development plans: urban and rural.

The aim of the object study is to ponder the influence of constitutional principles implementation, particularly the necessity to protect the values formulated in article 31 section 3 of the Constitution of the Republic of Poland, on the final form of provisions of the local land development plan. The arguments lead the authors of the study to state that in the planning act the district planner is authorised to accept solutions which are highly harmful to the legal interest of the owner of land property even by establishing a building interdiction, but it should occur in accordance with constitutional principles of restricting constitutional liberties and rights formulated in article 31 section 3 of the fundamental statute.

Mining activity may result in serious impact to the environment. According to Polish law, local development plan (enacted by the council of the local community) is an act of generally binding local law. It should provide information about the existence of mineral deposits and provide the needs of their current and future exploitation. In fact numerous plans do not provide any solution in that matter or even (directly or indirectly) are banning mining activity. According to Geological and Mining Law of 2011 mining activity may be undertaken only if it does not violate the destination of land determined by the local development plan (if such plan does not exist – the way of using the land determined by co called “studium of local development” that is nor local law) or particular acts of law (like establishing nature protective zones), who determine such destination. More restrictive solution refers to the environmental impact assessment (EIA), that must precede granting most mining concessions (licences). The result of EIA is so called environmental permit, which is the necessary element of the application for most mining concession (licences). The problem is, that environmental permit must be granted only in accordance with the determination of land provided by the local development plan.

Space development has, in view of limited nature of the space and persistence of its effects, axiological dimension. The regulations governing development also intervene within the range of exercising property right, what is a source of conflict of interests and what touches the issue of justice. Development of a particular space can take place under one of two competitive legal regimes. One of the regimes is established by local development plans constituting acts of local law which is commonly in force within territories covered by such the acts. In a position of the absence of a local development plan the other of the regimes, determined by rules of the law of general public order, is applied. The referred rules make the basis for giving, under the administration procedure, individual decisions on determining conditions for site development. Agricultural lands located outside administrative borders of towns, constituting arable lands of I–III class, whose contiguous area purposed for change of development classification exceeds 0.5 ha are excluded from the opportunity to obtain such a decision (a permission for development). However, the exclusion does not refer to development which fails to lose agricultural nature of a land. The courts’ decisions represent the opinion that the surface limit refers to the area which effectively is to change the way of development, not taking into consideration the land from which it was earlier parcelled out, what without doubt decreases protection level of agricultural lands. Other dissimilarity connected with determining conditions for site development of agricultural lands is departure from the statutory rule of “good neighbourhood” in case of farmstead development in farms whose surface exceeds an average farm surface area in a commune.

Pursuant to the new article 5b of the Act on the protection of agricultural and afforested lands as amended on 19 December 2008 agricultural lands situated within the administrative borders of cities has been excluded from the scope of this Act. As a consequence, changing conditions of development of such agricultural lands is now subject to the planning and development Act only. Legislator settled the conflict of two values deciding that the need of protection of agricultural lands should not hinder the urbanization processes within the city limits. The article discusses regulatory environment created as a result of the mentioned amendment of the Act, presenting in particular potential threats that due to the actual lack of master plans and inefficient regulations promoting enactment thereof, large areas of undeveloped agricultural lands located within the city limits will be developed in accordance with individual planning permits, where the current planning and development Act does not provide for the precise criteria for issuing such planning permits in undeveloped areas that used to be a farmlands. So–called good neighborhood rule, which assumes continuation and duplication of already existing solutions seems to be inadequate tool to the needs of urbanization of undeveloped areas, to which agricultural lands are very often counted. The author expresses opinion that the issue of providing sufficient amount of investment areas for the city development purposes has much broader dimension and may not be limited to formal status conversion. Effective transformation of agricultural production areas into investment areas requires enactment of the local master plans determining not only possibilities of non–agricultural development of particular plots but also indicating scope and basic rules for required mergers and/or divisions of land necessary for it’s development, and regulating principles of development of technical and communication infrastructure (e.g. road system), drainage, environmental protection and other issues, which cannot be effectively addressed on the individual decisions level. The permanent solution of this problem would require deeper system changes particularly in development planning regulations.

The article presents selected issues of mutual acts relations that are referred in the Nature Conservation Act and Spatial Planning and Land Development Act with regard to agriculture. It points out the position of systemic farmer in natural areas of precious value. Particular attention was put on implementing restrictions on the exercise of agricultural property ownership rights as a result of established acts of planning and conservation plans. Space is a joint interest that requires legal protection ensured through administrative (authoritarian) legal instruments. The value of this interest is incalculable, thus the instances of restriction of land ownership are not an infrequent occurrence. The main legal instrument affecting space development is the local land use plan adopted by the competent municipal or rural council. This document underlies a variety of decisions (administrative and judicial) involving land use. One of them is the decision approving the property division plan. The solutions adopted in the plan must be in line with the aforesaid land use document. If the divided property is not covered by a land use plan, the conformity of property division is determined based on the location decision or, if the latter is absent, pursuant to the specific provisions governing land use. Polish regulations on the rules and procedures for property division were laid down as early as in 1928. These rules and procedures have been altered several times ever since. Currently, the effective law is Articles 92–100 of the Act of 21 August 1997 on Property Management (consolidated text: Journal of Laws of 2010, No. 102, item 651 as amended). The measures adopted in the new law differ from previous solutions. By and large, the new regulation stipulates the control of divisions of land lots and not the divisions of larger property that may consist of many lots. This may come as a surprise since the manner of using land property in accordance with the local land use plan or other documents is contingent upon the area and shape of the property rather than the area and shape of a parcel being part of that property. This paper aims to assess the adopted solutions on the division of property against the modifications made and from the viewpoint of legal risks that arise from these new regulations. The currently binding arrangements regarding the division of property have been assessed positively in principle although they narrow the scope of property division control. With regard to the specific regulations, they are not entirely consistent, which is the source of certain legal risks associated with property transactions.

Lack of general planning duty along with long time required for conduction of procedures concerning passing (introducing changes) in local area development plans lead to substantial difficulties in making location of numerous investment of public nature (public aim investments). Unfortunately the Act of 27th March 2003 on spatial planning and development (Journal of Laws of 2012 item 647 with subsequent changes) does not foresee any particular solutions. Therefore legislator decided to introduce particular regulations within this field. Decisions which approve of carrying out respective investments determining their location are to be solution to the above mentioned problems. The most frequently spatial planning and development regulations are not applied while issuing these decisions, although sometimes they are binding while making local plans, or issuing decisions on development conditions, as well as area development plans. Decisions which are issued within this scope can be determined as particular substitutes of spatial planning. However, it is worth to underline that the above mentioned acts determine also number of different issues connected with conditions of carrying out plans and can result in real estate expropriation at the area of planned undertaking, or at last some of them constitute consent to its construction.

The primary function of the local development (spatial) plan is to determine the destination of the area covered by it, including various destinations of its individual fragments. Such plan is the act of local law, generally applicable on a given territory. Consequently, it becomes the basis for many decisions relating to the use of the real estates, which also means that it becomes an instrument of environmental protection. Detailed requirements of the legal system of environmental protection frequently stipulate that decisions determining the scope and manner of such protection must be in accordance with the local development plan. In fact, local development plan while specifying the destination of the covered area, also determines the legal scope and use of the environment. In practice, these requirements function only to a limited extent. This is because: – as a principle, adopting the local development plan is not compulsory, and as a result of a complex and expensive planning procedure only a part of the country territory is covered by such plans, – many local plans have numerous failures, primarily because of the conflict with the acts of parliament defining the detailed requirements to be met by such plans or because of the use of extremely imprecise terminology, – there is no effective mechanism for implementing the solutions of the public interest of a supracommunal character to the local development plans. For certain types of investments, this problem is solved by specific acts of law defining the detailed rules for the implementation of projects covered by them, while excluding requirements of spatial planning system.

The aim of the study is to evaluate the effect of local spatial management plans on legal forms of administrating agricultural real estates. In view of the extensive scope of the problem it was decided to focus on the concept of agricultural real estates; transfer of ownership right or perpetual usufruct right of agricultural real estates for purposes other than agricultural; the effect of a local spatial management plan on lease of agricultural real estates. Moreover, the paper also presents principles of changes in planned land use of agricultural real estates in the local spatial management plan and it was referred to the problem of exclusion of agricultural land from agricultural use as well as re-zoning fees. In conclusion the author states that e.g. adoption or a change in the spatial management plan and the location of an agricultural real estate in areas with planned land use other than agricultural does not impose in principle an obligation to cease agricultural activity and does not introduce the date for the exclusion of agricultural land from agricultural activity (unless the plan stipulates another manner of their temporal land management). However, already a change in the plan (the location of an agricultural real estate in areas with planned land use other than agricultural) results in a situation when the National Agricultural Constitution Act of 11 April 2003 is no longer binding. The author also presented her de lege ferenda conclusions concerning e.g. changes in spatial planning, implementation of greater protection of class IV agricultural land (if their cohesive area planned to have their land use changed exceeds e.g. 1 ha), reinforcement of the legal position of agricultural real estate lease in the case of planned land use for leased land other than agricultural in the local spatial management plan. In such a situation the lessee no longer is entitled to the preemptive right, which may be particularly unfair in relation to long-term dependent possessors, who introduced considerable improvements hoping for the potential acquisition of ownership.

Today, the issue related to spatial planning in rural areas takes on particular significance. In this context a reference to the views of Professor W. Pańko is justified, as they remain perfectly stable. The planning is an instrument promoted by EU which enables permanent and sustainable development of rural areas. The planning is an imminent and integral element of the notion covering the management, as it concerns spatial planning in any economy system. The issue of spatial planning in rural areas should be viewed from the point of view of its functions (synchronisation, coordination and information), where the two last ones takes on particular significance for development of them. The coordination function plays an important role for the policy to support development of rural areas from the Union and national resources; it is expressed in the contents of local master plans and relates to the coordination of actions, as well as the organisation of cooperation among entities operating on the areas in concern and bringing together their interests. The information function, their place and actions in which satisfies openness and transparency of planning procedures gives all entities the awareness of their place and actions in economic space and its value. Construction elements of the prescriptive model of spatial planning ensure logic link between documents which designs spatial management of a commune (strategies of commune development, the spatial development conditions and directions study, local master plans) aim to ensure the spatial order and the sustainable development of communes in rural areas. The process of using the specified mechanisms is a very comprehensive, long-lasting, time consuming and expensive process, therefore there is a huge gap between the prescriptive model and the actual process of spatial development of rural communes. Current prescriptive model of spatial planning gives almost the same attention to the organisation of agricultural space as the legal regulation of 70s of the XX century. This raises the question on the adequacy of the referred model to organise development processes of the current agriculture, as on the one hand the model (the study and the local master plan) seems all perfect, then costly and heavy, and on the other hand a stream of funds for development of rural areas it is intended not only for the agriculture, but also for the whole multi-functional rural area. As the notion of a rural area is not the same as the notion of an agricultural manufacturing space then the concept of multi-functional rural areas should be matched by its expression and reflection in the instruments of spatial planning. However, the provisions of the act on spatial planning and development fail to pay attention to this issue special interest. In the paper’s content the Author seeks to respond to the dilemmas on this matter.
