In the article chosen issues of the relation of the Polish and the European agricultural law in basic concepts were presented. They made an appraisal of the need of the redefinition of these notions. In conclusion, it was found that only changes of a basic concepts may make it necessary to formulate a new agricultural legislation in a European perspective. They pointed also at issues of sending back legal for European regulations. They also dealt with linguistic issues and interpretation of formulated notions. It was emphasized, that the concepts of agricultural legislation contained in European law are concepts national law of particular importance. They are not only modifying already existing notions, but also, when the contradiction is occurring between them they are more important and should be applied in the given area of the regulation.

Professor Andrzej Stelmachowski (1925-2009) is an outstanding person, deserving huge appreciation because of his activity in various fields; as a lawyer, a prominent specialist in civil law, commercial law, family law, who played a remarkable role in the development of agricultural law. He is the creator of a new school of Polish agricultural law, as he elaborated by his scientific achievements, a theoretical basis to distinguish (in the area of doctrine and didactics) agricultural law as a separate branch of law; he has proposed an original method of research – the study of law in the process of its application, and around these ideas he organized research teams – a large group of students at such universities as: Wroclaw, Warsaw and Bialystok (Professor has promoted 23 PhDs of law). Another merit of Professor Stelmachowski was to determine the object and scope of agricultural law, the fundamental structures of agricultural law (the concept of agricultural property), as well as the legal solutions for protection of individual farming. The recognition and respect for the position of Professor at the international level are demonstrated by His numerous professional contacts and honorary doctorates that he was awarded with. The Professor was the first Polish scholar in the CEDR (the European Committee for Agricultural Law), as well as the first President of the Polish Association of Lawyers specialized in Agricultural Law. The concept of teaching elaborated by Professor A. Stelmachowski was reflected in the subsequent editions of academic books in the field of agricultural law, issued under his scientific edit in the period 1970-2008. In all areas of his involvement, despite changes in the external environment, Professor A. Stelmachowski always presented a permanent system of values, among which we should mention: rightness, fidelity to convictions and responsibility, concern for the common good, solidarity with the weak and being guided by the social doctrine of the Church, all of which gave him an unquestionable moral authority as a Person of great strength of character.

Opis:
Definition of agricultural holding contained in the Civil Code is the subject of numerous studies. This is justified, since this definition is one of the basic conceptual categories of agricultural law, to which reference is made in a variety of acts. Issues related to the definition has become particularly current after the changes of the Civil Code in the year of 1990. Among the questions raised is, inter alia, determination of the functions performed by the holding, which art. 553 of the Civil Code refers to. The study identifies the importance of the proprietary and functional features, and their mutual relations. These functions are inextricably linked. At most it can be said of stronger or weaker accentuation depending on type of institution to which the normative concept of the holding is applied.

The article discusses a wide range of issues concerning the amendments introduced to the Polish bill od 11th April 2003 on shaping of agricultural structure by the law of 16th September 2011. Among other things, the law altered definition of the individual farmer, one of the most important institutions in Polish system of agricultural law. In the first instance, the article examines the modifications of the criteria which construct the definition of the individual farmer. Among them the special emphasis is laid on the criterion of professional qualifications, because of the fact that its redaction was strongly criticized on the basis of the former legislation. Author makes an attempt to evaluate the new formulation of above mentioned definition trying to point out its both positive and negative aspects. Further, Author describes current status of individual farmers in Polish agricultural law, indicating few regulations which concern this professional group in Poland. The analysis refers to the situation after the introduction of the law of 16th September 2011 and results in firm dispraise of the current regulations. With respect to above–mentioned arguments, the strong need of further studies both on definition of individual farmer and his status in Polish legal system– is to be stressed.

Shaping the Agrarian System is one of the basic topics of the Polish Agricultural Law. The main problem here is to define a proper model of ownership relations in the agricultural sector and principles of the real estate trading. These issues are relevant for both economic and political relations. In economy the influence the real capability of the agricultural sector as well as the standard of living of the agricultural society. In the politics they are treated as the instruments assuring the food security for all the citizens and in the international relations food sovereignity. The article presents, against the historical background, the solutions provided in the recently adopted law, the main purpose of which was to restrict the possibility of acquiring the agricultural real estate by foreigners. The new law provides a ban for the transfer of state owned agricultural real estate not only to foreigners but also to Polish citizens who are not farmers. It also provides certain other restrictions on this area.

The author presents the position of farmers with reference to the VAT act. As a final result of numerous changes to tax law introduced in Poland over the last 20 years, farmers gained the status of VAT taxpayers in the scope of their business activity held in agriculture. The article depicts the status and situation of VAT taxpayers and presents the tax law application in reference to agricultural business. The article describes the common definitions used in regard to agricultural tax law: flat-rate farmer, farmer products, agricultural activity, agricultural farm, forestry farm, fishing farmhouse. Special attention has been given to flat-rate tax model for farmers and the rules of VAT taxation of farmers. The article denotes the major acts and changes in the law situation introduced by: VAT Act (2000), following amendment (included changes with connection to VI Directive od European Union Council). The most recent changes have been implemented by Directive of European Union Council no. 2006/11/WE (28th of November, 2006). The purpose of the article is to present the farmers’ tax situation with reference to tax law (VAT) and to point out the issues with application of tax law, particularly with the renouncement of tax exemption under the general rules.

The author attempts to answer the essential question concerning the position and the role of a concept covering the “agricultural activities” in the agricultural law. The author’s brief comments precede the main thread of considerations regarding the position of the “agricultural activities” in the Polish legal system and just against this background she seeks an answer the question about the position and the role of the “agricultural activities” in that system. She already in the introduction assumes that the “core” of the agricultural law shall be covered by the private law, while the core of the agricultural law is agricultural activities, which are economic activities of specific type. She, referring to the doctrine and applicable jurisdiction within the scope of private law and public law, proves that similarly as in the private economic law (commercial law) the “economic activity” forms a link between concepts of the “enterprise” and the “ entrepreneur”, while in the agricultural law the “economic activities” forms a link between the concepts: the “agricultural holding (farm)/agricultural enterprise” and the “farmer/agricultural producer”. The concept of agricultural activities cannot be dealt with separately from these two specified concepts, as agricultural activities constitute the creative factor/link; the agricultural holding is established to enable the farmer/agricultural producer within its framework and with its use to undertake a particular type of economic activity to satisfy specific needs. The agricultural activities fulfils two basic functions: production and organisational, and the choice of agricultural holding components is provided in the light of the intended or performed activity, what means that the selection of relevant subjects and rights shall enable to carry on the selected agricultural activity. Moreover, this type of activity also subjects to the rules of public economic law, which in market economy systems becomes more useable to protect economic operators than merely to legitimatise economic governance of the State.

It has been more than thirty years since, in the pages of “Państwo i Prawo” (State and Law), together with Professor Andrzej Stelmachowski, who is not with us anymore, we formulated the principles of agricultural law for the young, developing discipline of Juridical Science, i.e. for the agricultural law. Dynamic development of the agricultural law in the previous political formation (also continued in the free–market economy) required the formulation of specific guiding principles of this discipline of Juridical Science. The passage of time, the political transformation that took place in Poland after 1989 as well as Poland’s membership in the European Union require verification of the formulated principles of agricultural law. Existing agricultural law as well as the legislation of the European Union and national legislation allow the formulation of new principles of agricultural law and ranking them according to the importance of legal regulation. They include: 1. The principle of intervention impact on agriculture and rural areas by the European Union and nation states in accordance with the objective of the EU Common Agricultural Policy. 2. The principle of productivity including the stimulation of technical and agricultural as well as biological progress by the state. 3. The principle of protection of the productivity of land within the frameworks of the protection of natural resources in conjunction with development of spatial rural areas. 4. The principle of protection of the farm as a farmer’s workshop and of the protection of other forms of land management.

Upon entry into force of the accession treaty, Poland – as a member state of the European Union – became bound by the body of EU law (the acquis communautaire), including its primary and secondary law as well as the interpretation of EU law contained in the Court of Justice of the European Union case-law. Due to a very close approximation of Polish legislation to EU law – resulting from the obligation to consider, employ, and apply in the process of implementing the former a number of EU legal acts, i.e. regulations, directives, as well as acts of soft law such as guidelines and recommendations that are not acts of common law – the problem of the scope of application of EU law within the Polish legal system has occurred; this problem, or a gap in the legal sense, has been addressed and resolved, to a large extent, by case-law of the CJEU.

Within the set of principles of agricultural law there can be distinguished those that are directly or indirectly empowered in the Constitution of the Republic of Poland. The outcome of analyzing them according to this criterion may serve as contribution to better systematize these principles and to determine the extent of their consistency with the socio–economic model of the system. It also appears that the results of in–depth research of this issue could become useful in the determination of the constitutional norm for controlling legal solutions applicable to the existing provisions of agricultural law. As a result of the analysis conducted, it can be assessed that the principles of agricultural law proposed by P. Czechowski and A. Lichorowicz have multifaceted empowerment in the provisions of the Constitution, which allows to better understand and more fully define them. The only principle of a constitutional status, regarding the family farm as the basis of the agricultural system, for its greater usefulness, requires a wider application on the basis of ordinary laws. It seems that it is the requirement of the times to take a new, slightly more comprehensive, look at the principles of agricultural law and to cogitate on establishing new ones, particularly in the light of the experience of almost a decade of the Polish membership in the European Union and more than fifteen years of the Constitution of 1997.

The article discusses a wide range of issues concerning the new legal institution introduced to the Polish legal system by the bill to amend the Polish Civil Code –i.e. “specific bequest”. The bill introduced a specific bequest alongside the current ordinary bequest. The item in question – which could take the form of personalty, an alienable property right, an enterprise or agricultural farm, or usufruct or a servitude– will go to the named legatee as soon as the estate enters probate. Thanks to this new institution testator will be able to assign a specific item of his property to a specific person (heir or not). For the agricultural law doctrine the most important issue concerning the institution of specific bequest is the fact that its item can be “agricultural farm”. In this way the notion of “agricultural farm” – central institution of rural law – has been introduced to the general provisions of inheritance law and, therefore, its importance has been strongly valorized. On the other hand, however, new regulations create a great number of serious doubts and problems which can easily put in question its practical importance. These problems have been divided in the paper in two basic groups. The first group concerns so–called “technical” problems. The most important one is the question of describing the agricultural farm in the notarial will, taking into account the doctrinal postulate of its maximal specification and substantiation as well as unification of descriptions in will and in the court’s ruling confirming the rights to the item of specific bequest. This problem should be analyzed with respect to the social – economic fact that agricultural farm only very rarely is the item of the property right. Usually, it is complicated construction consisting of different items and rights which do not have to be owned by the farmer. The second group of problems examined in the article was called “political issues”. In this part of paper Author tries to prove that the institution of specific bequest does not ensure satisfactory level of protection for the agricultural farm. Firstly, this legal instrument enables unqualified heirs access to the farm. Secondly, it can provoke the unreasonable partition of the farm. Moreover, it can also occur dangerous to the economic basis of the farm, regarding the fact that legatees are severally liable for heritable debts and can be also liable to certain statutory heirs. With respect to above–mentioned arguments, the strong need of the suitable legal institution – which would facilitate the generational changes in the agricultural farms – is to be stressed.

Broadly understood trading, especially trading of ownership rights to agricultural properties, as well as arable land forming a part of them, is subject to specific regulations in numerous countries. Poland is one of such countries. In the post–war period in Poland, it is possible to distinguish two basic stages of the State’s impact on the trading in arable land: until September 30, 1990 and after this date. In 1990, the trading of arable land inter vivos, regulated in the civil code, was significantly liberalised. It was only the Act on Shaping of Agricultural System of April 11, 2003 (Dz.U. No. 64, item 592) which entered into force on April 15, 2003 that introduced new restrictions into turnover of agricultural properties. In spite of the suggestive title of the above–mentioned act, it does not contain regulations whose purpose would be protection of agricultural farms from divisions detrimental from the point of view of correct agricultural economy. In Poland, work is currently under way on a new civil code. The task was entrusted to the Codification Committee of Civil Law established in 2002 by the Minister of Justice. Within the framework of work on the new code, the issue of restoring regulations which limit turnover in arable land to the civil code has emerged. This article was written by a member of the Task Team of the above–mentioned Committee. It contains remarks regarding the purposefulness and the scope of introducing limitations regarding trading in arable land into the civil code by means of contracts transferring the ownership right. The article also contains a draft regulation prepared by the article’s author.

The purpose of this article is to assess the compatibility of the amendments made to the laws regulating the basis and manner of establishing working relationships with the management staff of agricultural administration in Poland with the provisions of art. 2, 24, 30 and 60 of the Constitution of the Republic of Poland, in particular in the light of the principle of citizens’ trust in the State, the rules of protection of labour, the principle of respect for and protection of human dignity and the principle of equal access to public service. The elaboration is an analysis of the compatibility of certain provisions of the Act of 22 December 2015 on the Amendment to the Act on Social Insurance for farmers and to certain other laws with the aforesaid constitutional models.
