Opis:
The article attempts to discuss the legal and institutional issues related to the use of the State Land Fund (SLF) as a fundamental instrument of the postwar agrarian and land policy in Poland. First of all, an attempt was made to indicate the normative basis for its implementation and to reconstruct the legal character of the institution in question. Reconstruction of the legal essence of the State Land Fund shows the divergences formulated in this regard by the proponents of the doctrine of agricultural and financial law. The evolution of functions performed by the fund in the framework of the agrarian policy of the socialist state, and changes made in the model of administration of this institution, have contributed to the emergence of different evaluations. It seems that the institutional specificity of the SLF was determined primarily by the doctrinal or systemic basis of the Stalinist agricultural policy.

Opis:
The article presents the genesis and evolution of shaping the institution of municipal property of local government. The shaping of the legal institution of municipal property was presented against the background of the systemic change as a result of the changes and reforms initiated as a result of the 1989 ‘round table’, which also defined the principles of building a new local government system based on the legal and systemic model of European local self-government (municipal ) and its guiding principles. As a result of the introduced statutory regulations, in 1990, the first degree of local self-government was introduced, equipping communes (cities) and their associations as well as established legal entities with communal property. It should be mentioned that the acquisition of communal property, apart from the civil legal nature, also had a significant systemic significance guaranteeing the local government political, political and economic independence. The work presents the legal status of communal property, the procedure for its acquisition and the procedure of enfranchisement of communal entities under the first degree of local authority.

During the 18th century, an increasingly strong individualistic attitude in the way of understanding the relationship between man and the tangible world spread throughout Europe. The legal institution which, more than any other, suffered from the effects of this reductionism was the Property as victim of incredible compression in comparison to medieval world. The exclusive model that the new Enlightenment and the bourgeois mentality wanted to adopt was the individual Property, to the detriment of all those forms of possession documented in the Middle Ages. The present study intends to investigate, in the geographical context of the Papal States, the great juridical dispute between the individualistic model – endorsed by the Sacred Legislator – and that of a collectivistic nature defended by the Community.

Opis:
The Act on Management of Agricultural Property Stock of the State Treasury contains a regulation on contractual obligations imposed on the purchaser of an agricultural property acquired from the Agricultural Property Stock of the State Treasury. These obligations are not imposed on the purchaser by operation of law, however, there is a requirement that they have to be included, in certain cases of acquisition detailed in the provisions of the Act, in the content of the real estate sales agreement. The sales agreement has to stipulate that the purchaser is prohibited from selling the real estate for a period of 15 years from its acquisition; the purchaser is obliged to conduct agricultural activity on the purchased property; and that during this period, the purchaser may not encumber the property with any mortgage. Any violation of the aforementioned stipulations shall result in the purchaser’s obligation to pay an amount equal to 40% of the property’s sale price. In addition, the legislator has introduced the obligation to pay this amount in the event that the purchaser makes any false statement or representation as to the origin of the funds allocated to the purchase of the real estate. The provisions relating to the issues raised in the article cause a number of interpretative doubts as to their correct understanding. In particular, this applies to the legal nature of the obligation to pay an amount equal to 40% of the price of the purchased real estate property.

Opis:
The main legal problem which is addressed in this article focuses on impact of expiry of the time limit of the perpetual usufruct of a property on the right of separate ownership of the premises in a building on the land kept in perpetual usufruct. The author collates two opposed theories and argues that the separate ownership of premises should expired also. This outlook was not shared by the Supreme Court in the seven judges’ Resolution of 25 August 2017, III CZP 11/17, therefor, the thesis from it are analyzed and criticized. In author’s opinion, the courts should pass in accordance with the rules (Article 235 § 2 CC in conjunction with Article 3(1) and Article 4(3) of the Act of 24 June 1994 on Ownership of Premises) and the judgments which refer to principles of equity should be marked negative.

Opis:
The article refers to the legal status of a building which was constructed encroaching the border of neighbouring land. In such a case part of the building is placed on one real estate and the other part on another real estate, belonging to someone else. In legal doctrine and jurisprudence three possible solutions of this problem were proposed. According to the first approach, the whole building becomes a component of the „starting” real estate. According to the second approach the part of the building positioned on another’s land becomes part of this land and therfore property of this land’s owner. According to the third approach – until proper land servitude is established (building servitude), the second approach should be adopted and after the servitude is established – the first approach. The author of this article adopts the second approach, pointing out that among many arguments in this discussion, superficies solo cedit rule is of decisive significance.
