Opis:
Every action of the President of the Office of Competition and Consumer Protection [PL: Prezes Urzędu Ochrony Konkurencji i Konsumentów] must be taken in the public interest – the primary purpose of the antimonopoly regulation is to protect the business of entrepreneurs and consumers in the public interest. The President of the Energy Regulatory Office [PL: Urząd Regulacji Energetyki] is also governed by public interest activities. Under the applicable law, he is responsible for the development of competition, and one of his duties is to counteract the adverse effects of natural monopolies and balance the business of energy companies and fuel and energy consumers. In the Act on competition and consumer protection [PL: ustawa o ochronie konkurencji i konsumentów], the notion of public interest is defined very generally. However, the Act on Energy Law [PL: ustawa – Prawo energetyczne] precisely specifies which elements shall be taken into account by the President of the Energy Regulatory Office each time when making a decision. A number of his activities aim to balance the business of energy security with the protection of energy companies’ business and consumers’ business, including issuing decisions on approval of tariffs. The President of the Energy Regulatory Office ensures the implementation of the public interest in this respect, and such interest cannot be understood differently by another regulatory authority under another act. Otherwise, a violation of the axiological coherence of the legal system occurs. In this particular context (in terms of the implementation of the public interest), priority should be given to the utility regulatory authority (the President of ERO) and not to the antimonopoly authority. However, in this case, we are not dealing with a contradiction of the wording of the provisions but with a potential contradiction in terms of the understanding and application of the public interest premise. Therefore, the provisions of utility acts constitute a lex specialis in this respect to the Act on competition and consumer protection – taking into account this particular approach, such contradiction does not occur. Consequently, it should be concluded that if a given action of the President of ERO (an administrative decision issuance) implemented the public interest by the Act (and was maintained in legal transactions, was not repealed, etc.), it thus excludes the possibility of taking action by the President of the Office of Competition and Consumer Protection which was based on the need to protect this public interest.

Opis:
Article 40 of the Energy Law Act of 10 April 1997 provides for the possibility for the President of the Energy Regulatory Office to order the continuation of economic activity by an energy company despite the expiry of a license. This is a special regulation related to the need to ensure the continuity of supplies and protection of recipients of energy services when required by social interest. Therefore, this regulation provides for an exception to the principle of the freedom to undertake, perform, and terminate economic activity. The purpose of this article is to draw attention to the fact that the necessity to ensure the provision of energy services in a continuous manner means that the state imposes an obligation on energy companies to continue economic activity, at the same time not guaranteeing the entrepreneurs sufficient compensation in the form of appropriate remuneration for continuing the economic activity. Pursuant to the provisions of the Energy Law Act of 10 April 1997, an energy company is only entitled to loss coverage and only in the amount limited to the justified costs of the ordered activity.

The dispute over the Constitutional Tribunal is primarily of a personal nature and concerns two issues: 1) the legality of choosing three people for the position of judge of the Constitutional Tribunal: Mariusz Muszyński, Jaroslaw Wyrembak and Justyn Piskorski; 2) the legality of the appointment of the judge of the Tribunal Julia Przyłębska to the post of the President of the Constitutional Tribunal. This article consists of a descriptive part summarizing the basic facts and arguments brought up by both parties to the dispute in the legal discussion, and a prognosis presenting four alternative scenarios for ending the dispute over the Constitutional Tribunal in 2019–2024 or later.

On June 29, 2018 in Dziennik Urzędowy “Monitor Polski” (the Official Gazette of the Republic of Poland) were published two announcements by the President of the Republic of Poland – from May 24, 2018, on the vacant positions of the judges in the Supreme Court and from May 28, 2018 on the vacant positions of the judge in the Supreme Administrative Court. The obligation to announce the number of vacant judges’ positions is a result of changes in the structure of the Supreme Court introduced by the new law of 8 December 2017 and the obligation to apply these provisions to the judges of the Supreme Administrative Court. The controversy is aroused by the fact that the published announcements were not countersigned – although this competence is not included in the catalog of presidential prerogatives, exempted from the obligation of co-signing by the Prime Minister. The analysis of the constitutional shape of the countersignature and the practice of using by the President of his competences will allow to answer the question whether the President’s announcements require for their validity the signature of the Prime Minister’s or are they exempt from this requirement. In the light of the doctrinal reflections, the recognition of the announcement of the President of the Republic of Poland on vacant judicial positions in the Supreme Court and the Supreme Administrative Court may be considered as a derivative or analogous competence to the presidential prerogative of appointing judges. However, this stands in contradiction with the Constitutional Tribunal jurisprudence, which excludes the possibility of a broad interpretation of the constitutional catalog of prerogatives. Nevertheless, due to the informative, non-normative character of the announcements of the President, the issue of qualifying them to the catalog of official acts, for which the countersignature is required, raises reasonable doubts.

Opis:
On the basis of the Polish law of entrepreneurs, a competency dispute arose between the Minister of Digitization and the President of the Office of Personal Data Protection. Both authorities deem it appropriate to interpret GDPR. The Minister of Digitization believes that he is authorized because of the rights to create a policy in the field of personal data protection. The President of the Office for Personal Data Protection believes that he is authorized as a supervisory body according to GDRP and the competent authority for the protection of personal data. Due to the fact that the GDPR is an act of a higher rank than the Polish law, it is necessary to admit to the supervisory body that it is the only person entitled to a binding interpretation of GDPR regulations.
