Opis:
The paper aims at examining the influence of international legislations on the scope and content of the non-refoulement principle as articulated in the Polish law. Its shape on the Polish national ground is in fact a sum of influences stemming from external law systems. The article is based on the determination of three major sources of the refugee law that shape the content of the principle: public international law, European Union law and Polish national law. The Author first scrutinises the scope and content of the principle as laid down in crucial legislations belonging to these three sources which later enables their comparison and examination of the impact they make on one another in terms of conceptualisation of the principle of non-refoulement. The EU law reflects and specifies mechanisms established in the public international law which are further specified on a national ground. The final product is a national structure of the principle which is far more specific than the one known from the 1951 Refugee Convention that first stipulated it. The Author concludes with pointing at flaws and inaccuracies in a national articulation of the principle.

This analysis of freedom of religious worship is associated with a special situation in the world and in Poland caused by the SARS-CoV-2 virus. Restrictions introduced by the Government in Poland enter the constitutional sphere of religious liberty. Under international law and the 1997 Constitution of Poland, the freedom of manifestation of religion may be restricted only by statute and only if it is necessary to protect national security, public order, health, morality or the freedom and rights of others.

Opis:
Environmental protection in times of non-international armed conflicts is not subject to the sectoral or particular protection categories of environmental law and to date it has not been comprehensively regulated by international law. Except for generalities, it was also ignored in the 1992 Rio Declaration Principle 24 of which is not unambiguous in its expression. In fact, only the international humanitarian law of armed conflict contains norms which address the natural environment in times of armed conflicts. On the basis of a review of legal acts addressing the issues of environmental protection in times of non-international conflicts, negative conclusions de lege lata can be drawn as part of an attempt to answer the question whether international law ensures sufficient environmental protection in such circumstances. In the Author’s opinion, in international law there is a gap relating to the protection of the environment in times of non-international armed conflicts; the existing legal regulations which could be applied in these matters have a rudimentary characters.

Law applicable to the protection of the rights of personality rights is regulated by a method of alternative indication with two equivalent connecting factors. The interpretation of these criteria – the place of the infringement of personal rights and the place where the damage occurred – may cause difficulties. The interpretation given by the European Court of Justice in the cases of Shevill and eDate Martinez seems to be the first to be taken into account, although exceptions should be admitted in justified cases. If the effects of infringement of the rights of personality occur in the territory of many states, it is to be assumed that the damage existing in each of them is governed by its legal system. However, this mosaic principle should only be applied where the person requesting the protection indicates the applicable law of the place of effect. If the law of the place of the infringement of personal rights is indicated, the norms of one legal system should be applied.

The legislator has not specify who and how should determine which one will apply. Both the linguistic formulation and functional arguments support the conclusion that it is the right of the claimant. In case of lack of such indication the court should apply the law which is most closely connected to the situation.

The rise of modern international law as an autonomous scientific discipline in the early 1870s can be considered the culmination of multiple legal and extra-legal processes which trace their origins back to much earlier in the century. Several decades before the founders of the Institut de Droit International declared themselves the “legal conscience of the civilized world”, other societal groups had already expressed profound disaffection with the existing law of nations, which they viewed as inherently insufficient to guarantee lasting stability amongst civilized states. The conferences of the “Friends of Peace”, held between 1843 and 1851 in several European cities, featured many jurists who routinely employed legal modes of reasoning to communicate and advance legalistic objectives such as mandatory international adjudication and the codification of international law.

George C. Marshall, famed U.S. World War II general and eventual U.S. Secretary of State and Nobel Peace Prize winner, on his first assignment fresh out of military school, told a fellow officer: Once an army is involved in war, there is a beast in every fighting man which begins tugging at its chains. And a good officer must learn early on how to keep the beast under control, both in his men and himself Even for nations possessing a reputation for stringent compliance with the law of war, the annals of history, to include more contemporary military engagements, are littered with cases of atrocities committed by soldiers. All too often the beast wins, and because every nation has an obligation to minimize the reality described above, nations must continue to dedicate time, thought and resources to best prepare their forces for future military operations. Unrestrained warfare has a direct negative military impact on both winning the war and winning the peace. This corollary remains as true today as it has ever been. What is meant by a ‘reluctant warrior’? Put simply, a reluctant warrior is one who while ready to employ lethal force when the situation demands, is not eager to do so in “the moment”. He answers the questions: “Can I, If I, Should I”, and then takes decisive action – or employs uncommon restraint – with a goal of accomplishing the mission all the while staying true to the value imbedded in the U.S. Marines’ Hymn, “to keep our honor clean”. To fully develop the ‘reluctant warrior’ needed on today’s and tomorrow’s battlefields, this article will look at the role of legal regulation and the practice of military education and training, as well as some of the other factors that influence behavior and decisionmaking during instances of armed conflict. This article will also comment on the costs to the individual soldier and to the mission when a nation fails to prepare ‘reluctant warriors’.
