Opis:
Space law is clearly oriented towards creation of soft law instruments and their subsequent implementation directly into national law. However, it is not an ideal method for regulating the peaceful use of outer space. At least a few problematic issues should be noted. Firstly, the lack of scrutiny by parliaments with regard to soft law standards accepted by States. Secondly, the multiplicity of soft law documents on the same subject matter – especially in the case of space debris (IADC, UN, ISO or ESA), which may not be fully identical. Thirdly, developments in space technology mean that existing soft law standards may nevertheless be outdated in practice. Fourthly, the creation of new soft law is not always a quick process. However, implementation of international soft law relating to outer space into domestic law ensures that international norms are binding under national law. It thus strives to guarantee both the development and the effectiveness of international space law, despite the absence of new treaty regulations.

A notary, as a person who performs activities that play a huge role in legal transactions and produce extremely significant effects, is obliged to act in accordance with the law and behave with dignity – both in private and public life. The notary is responsible for the breach of these rules. As a rule, the following types of liability are mentioned: civil, criminal, disciplinary, and tax. Based on Art. 19a of the Law on Notaries, a notary public is subject to compulsory third-party liability insurance for damages caused while performing notarial activities. There are doubts about the nature of the civil liability of a notary and its scope. This article aims to provide a clear answer on this matter.

The article deals with the issue of referrals to the study of criminal law as sources of inspiration for the enforcement of public law rules of competition and consumer protection (Act of February 16, 2007, on Competition and Consumer Protection (Journal of Laws of 2021, item 275) (oukk)). It is now widely accepted in antitrust jurisprudence that although the liability of the parties to the proceedings before the President of the Office of Competition and Consumer Protection (UOKiK) is not of criminal nature, and fines imposed by the President of UOKiK are not penalties within the meaning of the Criminal Code, the rules of judicial verification of the correctness of UOKiK’s decisions imposing these sanctions should meet the requirements analogous to those applicable by a court adjudicating in a criminal case. However, while there is little doubt that antitrust authorities should be required to apply standards of protection of fundamental rights as derived from the study of criminal law and international sources (European Convention on Human Rights, Charter of Fundamental Rights), the issue of transferring to competition and consumer law other standards recognized in criminal law remains open. The current jurisprudence contains divergent positions on this issue. The Supreme Court emphasized that „there are no justified grounds for applying the provisions of the general part of the Penal Code under the regime of administrative liability” (case I NSK 4/18). On the other hand, it approved references by analogy to the solutions taken from the Criminal Code in the absence of similar provisions in the uokk (case I NSK 8/19) or in cases where competition law uses concepts taken from criminal law (case I NSK 62/18). The article presents both of the jurisprudence lines mentioned above. In addition, the article point outs issues of competition and consumer protection law in the case of which, in the author’s opinion, the use of concepts derived from the study of criminal law would be justified.

The article concerns primarily the effects of the membership of the European Union on national (Polish) law and, to a limited extent, on the political system of a state. The conclusions presented in the article are of universal value. Although the article deals with Polish affairs, the principles, tendencies and consequences identified are typical of the relationship state – the EU, both before and after accession, regardless of the state concerned. It should be, however, noted that the path to membership and the membership itself are different in each case. The practice of the Polish membership of the European Union, its systemic dimension and the changes in the national legal system (Europeanisation) do not differ significantly than in the case of other Member States. Europeanisation of Polish law, politics, economy, culture and society has been in progress since the 1990s. One can differentiate between two stages of Europeanisation: before and after Poland’s EU accession, each characterised by different conditions. Over time, this process, on the whole, has been undergoing numerous changes but it has never weakened in importance. Poland faces issues such as poor legitimation of integration processes, supremacy of the government over the parliament, passivity of parliamentary committees in controlling the government and EU institutions in the decision making process, as well as dilution of responsibility for decisions taken within the EU. The process of Europeanisation relies mostly on direct application of the standards of EU law in the national legal system, implementation of directives into national law and harmonisation or standardisation of national legal solutions so that they comply with the EU framework. It is also reception of a common, European (Union) axiology.

Despite the traditional postulates of jurisprudence regarding the necessity to introduce flawless bills, each legal system struggles with issues which arouse controversy and become the subject of a lively political and legal debate. Even if the controversy affects millions of people and their private lives, the decision to solve it is limited by government policy. For example, this pattern is reflected in the married couples’ same surname issue in Japanese Family Law. Japanese courts investigated it yet did not provide any binding solution. The media have also increasingly raised this problem as an example of a private law defect requiring a fundamental change in the near future. Still, public awareness of the legal controversy is insufficient to overcome it. Even though a large part of Japanese society supports the reform of the married couples’ same surname system, the government protects it as an embodiment of Japan’s legal tradition and a symbol of family unity. Undoubtedly, the dispute regarding the need to revise Family Law went beyond the legal debate and became a significant political and social issue in the last three decades. Unfortunately, Western legal scholarship is still unaware of this vivid example of the 21st-century rivalry between the liberal/individual and the conservative/collective views in one of the most distinguished private law systems.

The article is devoted to the views of Professor E. V. Vaskovsky on the system of Russian civil law of the late XIX beginning of XX centuries. Giving a presentation on the civil law system E. V. Vaskovsky, first of all, emphasizes the feasibility of isolation in a special section of the general part. The most important parts of civil law system, he believes property law, law of obligations, family law and inheritance law, constitute a special part of civil law. Author composed of sections, which are section of the special part of civil law, including the rights materialized, embodies the bearer. Summing up the views of E. V. Vaskovsky on the system of civil law, it should be noted that along with the traditional inclusion of family law, the novella is extremely large character that took place in the end of XIX century in the field of legal regulation of intellectual creativity, and found in it reflected. Further, the article presents a generalized analysis of the current system of the Russian civil law. The concept of the civil law system, all also based on the division into the general and special part. Now, however, in the civil law system is allocated a number of subbrunches. Selecting subbrunches of the modern civil law associates with the isolation of each of them with their own general part. Currently, the structure of the special part of civil law includes the following subbrunches: corporate law; property law; inheritance law; law of obligations; the law of “intellectual property”; commercial law. Historical experience has shown that the “materialized rights” that E. V. Vaskovsky also singled out in the structure of the special part of civil law did not subbrunch of the modern Russian civil law, as the rapid development of the stock exchange trade resulted in the so-called “dematerialization” of securities, which is the main instrument of the stock market. Currently, the data set of rules should be considered as one of the most important institutions of commercial law as a subbrunch of modern civil law.

Ukraine has chosen its way of development towards Europe, European values and respect for human dignity and human rights. The signing of the Association Agreement in 2014 obliged Ukraine to harmonize its legislation in priority spheres of life with the legislation of the European Union. But legislative approximation should touch not only upon the fields of public law, but private law too and, in particular, tort law. The main problem of tort law approximation is that there are no joint tort rules in the EU. All attempts to harmonize tort law stopped at the creation of acts of “soft law” – general non-binding rules and principles. One of the most significant examples is the PETL – the Principles of European Tort Law. The PETL show a modern understanding of torts, spell out the conditions of tort liability, as well as other relevant requirements. Ukrainian rules of tort law do provide protection of a victim’s violated rights, however some recommendations of the PETL, such as provisions governing the conditions of tort liability, the understanding of causation and fault should be taken into account when Ukrainian tort law is modernised.

Autor w artykule analizuje zagadnienie problemu wykorzystywania prawa porównawczego przez sędziów orzekających w sprawach cywilnych i handlowych. Założeniem wyjściowym dla analizy jest fakt, że odwołania do prawa obcego przez sędziów krajowych występują bardzo rzadko. Zdarzają się one czasem w prawie publicznym, ale nie istnieją niemalże w ogóle w prawie prywatnym. Autor stawia tezę zakładającą, że stosowanie przez sędziów prawa porównawczego przy orzekaniu w sprawach cywilnych i handlowych powinno stać się regułą. Tezę tę uzasadniono, używając dwóch argumentów. Po pierwsze, autor przedstawia zalety, jakie niesie ze sobą wykorzystywanie prawa porównawczego w orzecznictwie cywilnym oraz możliwości jakie przedstawia w kontekście coraz dalej idącego ujednolicania systemów prawnych. Po drugie, autor daje uzasadnienie prawne powoływania się przez sądy krajowe na prawo zagraniczne i wyjaśnia, dlaczego taka praktyka jest dopuszczalna de lege lata oraz jak można by ją rozpowszechnić de lege ferenda.

The article tries to provide an answer to whether it is possible and viable to establish a universal criminal law applicable worldwide. The author focuses on the relationship between culture and law. Special attention is devoted to the area of criminal law and the influence of cultural backgrounds in different societies, which makes an impact on controversial topics, and sometimes becomes a subject matter of penal law. The article considers issues linked to philosophy of law and comparative law, seeking answers in various doctrines and worldviews. The paper presents the theoretical arguments and practical benefits of developing a system of ex-post evaluation of regulatory impact by studying the actual effects of the decisions of legislative decision-making bodies. The individual issues under consideration involve: the analysis of general assumptions of the decision-making approach in legal studies and its application to the problems of a law-making policy; presentation of the stages of the legislative decision-making process, with a particular emphasis placed on the effects of such decisions; and discussion of the conditions of a contemporary law-making policy, from both the theoretical and practical points of view, based on a distinction of several dimensions of legislative decision-making (instrumental, axiological, power game, social conflict, discursive, social normative system, economic, and temporal). For each dimension, ex-post evaluation criteria are proposed.

The article provides an analysis of the notion of competitiveness as a legal category allowing the operation of the economy. Various understandings of competitiveness has been analyzed through examples from economic law, in particular from agricultural law. Both European and national legal acts were analyzed. It was noted that a functional interpretation was required to decipher the meaning of competition in the law. Its common understanding does not coincide with the specification of the legal definition of that concept. Such a situation can create uncertainty, particularly when increasing competitiveness determines the effectiveness of the funds spent.

The study deals with a new phenomenon in criminal and immigration law referred to as crimmigration. It involves the use in immigration law of instruments borrowed from criminal law, such as detention, banishment, procedures used in criminal law and the powers of police authorities, in order to combat illegal immigration. The commission of a criminal offence becomes a premise for deportation of persons who are even legally present in the country. On the other hand, new types of offences criminalising illegal border crossing and illegal residence are introduced into the criminal law area. Criminalisation of illegal immigration intersects with the tendency to protect victims of the crime of human trafficking and human smuggling. It must also take into account international treaties providing international protection to refugees from areas of armed conflict, persecution and humanitarian crises, often resulting from climate change. Paradoxically, the tightening of criminal law instruments to combat human trafficking worsens the situation of victims of this crime. The article also analyses Polish regulations in this area, indicating that they correspond to the phenomenon of crimmigration and presenting the possibilities of interpreting the relevant provisions in a way that guarantees observance of the principles of humanitarianism towards immigrants.
