The article analyzes the concept of justice in both procedural and substantive aspects of civil law, with regards to John Rawls’ notion of “procedural justice”. The basic problem of the article is the question if each outcome of a fair procedure is just by the token of the fairness of the procedure. The author argues that such a standpoint, claiming that the procedure itself creates a just decision, will be incompatible with Article 45 paragraph 1 of the Polish Constitution. This paragraph grants the right to just adjudicature, which takes into account the whole substantive law. There are areas in law where conflicts between the procedural and the substantive justice are possible. Such an area is the adversary trial proceedings and evidentiary proceedings. The Court of Justice of the European Union emphasizes that there are such groups of legal entities (eg. consumers), for which it is necessary to regard ex officio all of facts pointing to the unjust treatment of consumer. The similar point of view was expressed by the Supreme Court of Poland. The Supreme Court of Poland allowed an evaluation of a claim which includes principles of justice, even if the defendant doesn’t take any position. This belief agrees with the standpoint of E. Waśkowski, who emphasized that the sentence should be “rightful”.

In the paper, I discuss ethics of care as a feminist critique of Kantianism, utilitarianism and liberalism. The critique focuses on justice, rationality, individualism and the free market. The perspective taken by the proponents of the ethics of care is based on emotions, sensitivity and empathy. The ethics of care is based on the life experiences of women, while the ethics appealing to logic grows out of the experiences of men. The ethics of care focuses on relations, while traditional ethics refers to rules, norms and rights. It considers relations between family members or friends, based on care, as crucial for the whole society. From that point of view, the ethics of care criticizes liberalism which splits human life into two separate spheres – private and public.

Tax law populism should be associated more with a populist economic policy than with the legal populism. Populist economic policy requires an increase in social spending, while the source of financing is the public debt or an increase in tax burdens. However, the tax increase is hidden from the public due to the complexity of regulations and the method of settlement, imposing levies that are less noticeable by society (indirect taxes) and changing the structure of direct tax burdens for various social groups (primarily a raise for the wealthy).

Opis:
The concept of reverse discrimination refers to a variety of strategies that entail giving strong preferential treatment in employment or education to the groups in a society that have been institutionally discriminated against. “Giving strong preferential treatment” means that candidates with lower qualifications are given priority over better qualified members of the groups that have not been discriminated against in the past. Reverse discrimination can be justified with reference to two strategies: backward-looking and forward-looking. On the backward-looking justification, reverse discrimination is a means of compensating victims of past discrimination, while on the forward-looking justification, reverse discrimination is a means of creating more diverse and egalitarian society. The aim of this paper is to challenge both justifications. First, against backwardlooking justification, I shall claim that reverse discrimination is not a proper method of compensating for past wrongs of discrimination. Second, I shall challenge the forwardlooking argument by pointing at the risks inherent in perceiving reverse discrimination as the means of creating more egalitarian society. Importantly, the objections presented in this paper refer only to reverse discrimination, and they do not undermine other methods used within the affirmative action (including tie-breaker provisions).

The analysis of the use of the notion of justice in the Polish Constitution proves that in the course of historical development, the designated value was given various conceptual profiles. It was associated mostly with the law within the subjective (‘justified entitlement’) and objective scope (‘legitimacy’), with the judicial authorities (‘fair hearing’), and with the punishment (‘just decision’). Apart from juridical meaning, the notion of justice shall connote ‘equality’ or ‘equal treatment of all people’, including ‘equal justice under law’ or ‘objectivity of a judicial ruling’. Over time the justice gains social and political value which is reflected in the ideal of social justice meant as ‘the equality of all citizens and equal evaluation thereof’. The latter is highlighted in the Polish Constitution (of 1997) where justice is treated as the guiding moral and constitutional principle in the Republic of Poland. The significant profiles of names designating justice in the texts of the Constitution are confronted with the connotations appearing in the questionnaires filled up by the students of the universities in Białystok. In the eyes of young Poles, justice seems to be a human value which is important in their environment an shall be protected by the state.

The paper attempts to expound upon the actual and statutory role of lay judges in the process of adjudication. A theoretical model was confronted with the practice of making judicial determinations. The authors analysed the state of the law on the matter and the functions of lay judges accorded thereto by the legislator. In addition, as a result of extensive sociological-legal studies, a typology of the moments of composing a judgment (i.e. during deliberations; in between cases; conversations with prosecutors; voluntary acceptance of liability (plea bargain)) and of types of deliberations present in Polish courts (deliberation without deliberation, deliberation dominated by the judge, deliberation pro forma, the ideal type, deliberation and a discussion – bargaining) is described.

The article raises the issue of public interest concept as understood by E. V. Vaskovsky. In particular, it is demonstrated that the scientist proceeded from an idea that such a phenomenon as law exists within social benefit. He associated development of many institutions of law specifically with social needs. The article also provides insight into certain aspects of how E. V. Vaskovsky interpreted the social meaning of various civil law institutions, as well as different restrictions of legal rights to the shared benefit. It is shown that the scientist believed that court activities related to justice administration are of particular social importance. It is also underlined that E. V. Vaskovsky did not equate public and state interests. The author’s reflections on E. V. Vaskovsky’s views and the relevance of his ideas to date are also provided.

Human dignity in the Polish law is considered as the basis for the system of rights and freedoms regulated in Chapter II of the Constitution of 1997. In turn, the rule of law is a principle of constitutional democracy respecting human rights. Procedural rules focus on the manner in which the state operates, also in relation to individuals. Procedural justice as a principle derived from the rule of law can be defined as a set of values whose guarantee in legal norms and implementation in procedural practice affects their fairness and enables their positive evaluation. The jurisprudence of the Constitutional Tribunal considers the principle of procedural fairness as one of the principles of the rule of law and binds it with the right to court which means exactly: 1) the right of access to court, 2) the right to really fair procedure, 3) the right to court judgment, and 4) the right to appropriate shape of the system of the authorities examining cases. Appropriate shaping (fairness) of the procedure within the meaning presented by the Constitutional Tribunal ensures in particular that the parties of proceedings have: the right to be heard; the right to obtain a justification of the decision, which prevents arbitrary action of the court; ensured predictability of the proceedings; guarantee of procedural measures balancing the position of the parties; ensured the control of the decision by a superior instance; guarantee of impartiality of the judge. Meeting these requirements guarantees respect for dignity of a man as a participant in the proceedings.

The article deals with the issue of the Zabużanie people’s claims. The Zabużanie people were persons who lost their assets as a result of relocation from the Eastern Borderlands (also known as Kresy) of the Second Republic of Poland caused by a revision of territorial borders after the Second World War. The Author describes the genesis and legal nature of the so-called Republican Accords regulating the principles of assistance for displaced persons and forms of realisation of the Zabużanie people’s claims in the statutory law of the Third Republic of Poland. Then, the author discusses the case law of the Constitution Tribunal and the European Court of Human Rights related to that legislation. He indicates a shift in the case law with reference to the scope of discretion accorded to the legislator in respect of adopting compensatory mechanisms. The author underlines the special role that was played by the principle of trust of citizens towards the state and the law enacted thereby in the Tribunal’s assessment of the adopted legislative solutions. At the same time, the author indicates that the potential of the constitutional idea of solidarity was not fully used when solving the issue of the Zabużanie people’s claims. In the opinion of the author, the idea of solidarity could be an axiological foundation for a policy of transitional justice.

The aim of this paper is to investigate the distribution of exponents of modality in the justifications of judgments passed by the Court of Justice of the European Union (CJEU) and judgments passed by the Supreme Court of the Republic of Poland (SN) in the post-accession period of 2011 to 2015. In particular, the paper aims to establish the degree of convergence between translated EU judgments and non-translated national judgments in terms of the employment of modality markers. The research material consists of a large corpus of Polish-language versions of 897 judgments passed by the Court of Justice (CJ), 384 judgments passed by the General Court (GC), a corpus of 2564 non-translated judgments delivered by the SN, and a reference corpus of contemporary Polish (NKJP). The quantitative data point to the high salience and divergent distribution of a number of various markers in both EU and national judgments, such as the value-laden modal verbs należy [(one) must/should] and trzeba [(one) should/must]. It is argued that the frequent use of markers of modality constitutes a generic feature, as it raises the perceived level of authoritativeness of judicial argumentation. The findings may contribute to raising awareness of language patterns which involve the expression of modal stance.

The 2012 judgment of the International Court of Justice in "Jurisdictional Immunities" concerned the application of state immunities in Italian courts and its failure to recognize the rights of Germany in this regard. Once the ICJ found Italy in violation of international customary law and ordered that relevant judicial decisions should cease to have effect, Article 94 of the UN Charter providing for the obligation to comply with ICJ decisions began to apply. The paper tracks down attempts to implement "Jurisdictional Immunities" in the Italian legal regime, analyses different – legislative and judicial – means of compliance, and presents general observations on the complexity associated with the fulfilment of the obligation to comply.

Since 1 may 2004 Poland was obligated to adopt rules of the European Union law (acquis communautaire). Domestic courts must apply appropriate regulations two different legal orders . Cooperation with European Court of Justice (ECJ) could be the best solution to achievement accordance of treaties obligations and national law. One of the most popular method, provided for article 234 Treaty establishing the European Community, are preliminary questions. In according with european jurisdiction, polish administrative courts could use this mechanism to adjudicate . In many situations courts have to refer to the ECJ for a preliminary ruling a question on the interpretation european union law. On the other hand some cases should be decided by domestic jurisdiction, but even than ECJ is obligated to present his point of view. Although litigant party could not influence on court he can use regulations provided by domestic legal procedure, for example he can lodge a complaint against suspension of legal proceedings. Put preliminary questions into practice shows how consequences will bear a parties europeanization domestic law.

The article deals with the question concerning legal responses to sexual harassment – whether those responses should be relentless in punishing and stigmatizing perpetrators and banishing them from positions where they can offend further, or whether there should be room for rehabilitating or even forgiving at least those offenders whose abusive behavior is not violent or serial. On the one hand, the importance of achieving justice and equality for women is critical. On the other hand, one may recognize the possibility of repentance and restoration of both victim and offender to society. The modern restorative justice movement, informed by Christian theology, suggests that alternative dispute resolution mechanisms should not only ensure that victims receive appropriate restoration for the harm they have suffered, but also try to restore perpetrators who accept responsibility for their offenses back into the community. It seems that practiced in the right cases, restorative justice may turn the disempowerment and fearful, sometimes guilty in-turning that victims may experience in adjudicative processes, into a freedom of giving beyond justice, and they may move the self-justificatory shame of a perpetrator into true repentance and reparatory action. At least, restorative justice may push them toward a relational dynamic that is healthier for both whether they must necessarily encounter each other in the future or free themselves from the hurt of the past.

Justice requires a certain form of “fraternity” (Rawls), “solidarity” (Marxists) or “civic friendship” (Aristotle), which is often justified with a need to limit socio-economic inequalities that can undermine just political institutions. However, fraternity has long been associated with the community of “male citizens”, and was also usurped by a totalitarian margin (e.g. the Bruderschaftof the Nazi elite). Less often it is observed that the idea of solidarity, of “standing together” in the opposition to practices of exploitation, has also been modelled on historically male forms of activity: on marching, demonstrating, fighting at the barricades (military activity) or launching labour strikes (economic production). The significance of the notion of civic friendship today is grounded in a third model – that of ethical action or praxis – i.e. in all those activities that support the reproduction of flourishing relations (here called friendship), whether personal or civic, for their own sake. This model of activity has been eclipsed in the modern period by the dominant model of production, yet it includes a host of practices, traditionally (but by no means exclusively) performed by women outside the market: feeding and caring for the young, for the old and sick, developing others’ abilities, educating them, simple playing, etc. Once this alternative model is developed – and its practices thoroughly adapted to modern principles of universal right and respect for personhood – the ideal of civic friendship may just be the most appropriate idea of community for today’s democratic and pluralist society.
