Opis:
The Agency for the Cooperation of Energy Regulators (ACER) has been established in 2009 in the Third Liberalization Package of Energy Sector. The Agency became fully operational in 2011. After 5 years of its functioning the Author presents his opinion on general issues like legitimacy of the European Union regarding the tendency of creating new European agencies (among them ACER) and the problem of the common belief in rule of experts in the typical field of politics. Subsequently the paper handles the history of setting up the Agency and the description of its bodies and competencies in order to present the achievements of ACER within 5 years of its work. The Author concludes with positive statement: ACER meets its goals, encompassing the principle of subsidiarity and helping the Commission and National Regulatory Authorities in realizing the aim of establishing the common energy market in European Union.

Opis:
Land use planning is a key element of rural development. First, it is related to the circulation of agricultural real estate and its use for non-agricultural purposes. Secondly, it finds in the current state of the law fundamental importance for the development of renewable energy sources, including wind farms. Some people see in such localization of renewable energy sources obstacles and hindrance to the process of expanding wind farms in Poland. The article evaluates the current regulations, as well as the proposed changes not only in the context of rural development, but also climate and environmental protection. The results carried out do not inspire optimism due to the existing conflict between the development of wind farms and the acquisition of so-called green energy, and the preservation of landscape heritage and aesthetic values of nature, including spatial order.

Opis:
The article presents issues related to the location of renewable energy sources in rural areas. Spatial planning regulations are analysed, as well as other regulations enabling or impeding the development of green energy in rural areas. The legal possibilities of realising investments in renewable energy sources in rural areas through the prism of the Smart Village concept are also assessed. De lege ferenda proposals are presented to enable faster investment in renewable energy sources in rural areas. The article also points out the risks for farmers, whose current role has been reduced to renting agricultural property.

Renewable energy sources remain the key to a successful energy transition. This article provides an overview of the investment process for all renewable energy sources on the grounds of Polish law. Firstly, it covers the main framework of the investment process in Poland in terms of permit-granting and identifies the administrative decisions required for the construction of renewable energy ventures. On such grounds, further addressed are specific spatial, environmental, and construction issues related to the investment process of particular types of renewable energy installations – wind, solar, water, tidal, geothermal, ambient, and biofuel energy, as well as renewable hydrogen. Such an up-to-date study is particularly relevant given the recent major changes in the law.
