Evgeniy Vaskovsky always enjoyed well-deserved reputation, in the first place as a specialist in the civil process. His fame as a material civil lawyer and, in particular, as a civil lawyer-educator, somewhat less; even in Russia, the star of his civil-name is eclipsing by other many civil stars, more bright and flashy. The article attempts to at least partially fix this obvious injustice – tell about “The Handbook of Civil Law” by Evgeniy Vaskovsky. Unfortunately, the Handbook was left unfinished: it was limited to only two parties – the General Provisions and the Rights in Rem. Despite this fact, as well as those one hundred thirty years that have passed since its publication, “The Handbook of Civil Law” by Evgeniy Vaskovsky continues to be more than relevant, useful and even instructive piece not only academic, but also scientific as well as practical destination.

The article is devoted to the views of Professor E. V. Vaskovsky on the system of Russian civil law of the late XIX beginning of XX centuries. Giving a presentation on the civil law system E. V. Vaskovsky, first of all, emphasizes the feasibility of isolation in a special section of the general part. The most important parts of civil law system, he believes property law, law of obligations, family law and inheritance law, constitute a special part of civil law. Author composed of sections, which are section of the special part of civil law, including the rights materialized, embodies the bearer. Summing up the views of E. V. Vaskovsky on the system of civil law, it should be noted that along with the traditional inclusion of family law, the novella is extremely large character that took place in the end of XIX century in the field of legal regulation of intellectual creativity, and found in it reflected. Further, the article presents a generalized analysis of the current system of the Russian civil law. The concept of the civil law system, all also based on the division into the general and special part. Now, however, in the civil law system is allocated a number of subbrunches. Selecting subbrunches of the modern civil law associates with the isolation of each of them with their own general part. Currently, the structure of the special part of civil law includes the following subbrunches: corporate law; property law; inheritance law; law of obligations; the law of “intellectual property”; commercial law. Historical experience has shown that the “materialized rights” that E. V. Vaskovsky also singled out in the structure of the special part of civil law did not subbrunch of the modern Russian civil law, as the rapid development of the stock exchange trade resulted in the so-called “dematerialization” of securities, which is the main instrument of the stock market. Currently, the data set of rules should be considered as one of the most important institutions of commercial law as a subbrunch of modern civil law.

This paper emphasises that Europeanisation of law contributes greatly to the phenomenon of decodification. The impact of European legislation on the position of the civil code as the main source of private law is clearly visible in the case of directly effective regulations. Also, implementation of directives can (and often does) lead to the creation of legislation regulating civil law matters, yet separate from the civil code. The Polish experience with implementation of directives concerning consumers protection makes for a good example. Regulation of timeshare contracts completely outside the civil code is – according to the Polish doctrine – a result of difficulties with integrating this particular provision into the codification of private law. If such difficulties are inevitable, so is also progressing decodification of civil law due to its advancing harmonization on the European level.

In 1952 Witold Czachórski posited as a general principle of Polish contract law that legal actions leading of a transfer of wealth require for their validity a proper cause; the rule was construed as a mandatory one and precluded the creation of abstract obligations unless expressly permitted by law. Czachórski’s theory was underpinned by an in-depth analysis of the entire body of civil law, as well as axiological considerations that emphasized the need to control contractual fairness (Section 1). After 40 years of largely uncontroverted acceptance the rule was abruptly abandoned by the Supreme Court on grounds of freedom of contract (Section 2). Despite its fundamental nature, this change was not accompanied by any in-depth discussion in legal doctrine (Section 3). While unsatisfactory on a theoretical level, it seems in retrospect that this was, at a time of systemic transformation to a liberal market economy, a pragmatic and perhaps inevitable approach that served to further the newly re-established principle of freedom of contract. Paradoxically, however, with the contemporary shift to a more control-oriented approach to freedom of contract it would not be entirely surprising to see a rebirth of the role of cause and of Czachórski’s theory some time in the future (Section 4).

The paper is devoted to the new Czech Civil Code, thanks to which the Czech private law has experienced its greatest legislative change in the last fifty years representing its ultimate diversion from the socialist law principle. The author discusses briefly the development of Czech private law in general, as well as the recodification process. However, the focus of the paper lies mainly in the presentation of the new Czech Civil Code to the public of Visegrad Group countries. The aim of the presented paper is to provide a complex and unbiased view on the new Czech Civil Code, which in some respects may serve as an inspiration for the drafters of the new Slovak and Polish Civil Code.

The article is intended to show, using the examples from Polish law, how strongly the owner’s right to abandon a thing is limited. First of all, the legal structure of the abandonment and its current, very universal legal form are presented. Next, some categories of things that cannot be abandoned in Polish law are distinguished, and further examples of relevant private and public law regulations are provided. Finally, the conclusion is drawn that, despite the granted right to abandon a thing, it is usually not problematic to abandon only completely safe things of low economic value.

The text presents different attributes of the Supreme Court in common law and civil law systems. The author claims that the question of design and function of a supreme court, while important, is no more significant than the issue of its institutional status and evolution, i.e. something one could refer to as “legal culture”. Neither the “common law camp”, nor the “civil law camp” turns out to be monolithic in this regard. The distinctive history of the US Supreme Court is presented through the perspective of its statutory and procedural supremacy, as well as its power of constitutional adjudication. The author indicates that the supremacy of the US Supreme Court depends on many factors. Arguably, the most important attribute of the US Supreme Court’s supremacy is linked with the latitude offered to judges in common law system to “make law”, which stands in contrast to a limited judicial function in many civil law countries. The author argues that being a court in a common law system carries with it much broader authority. A supreme court in such a system is, as a result, much more supreme. The author concludes his comparative remarks by saying that it is not possible to proclaim the superiority of one specific system because there are too many variables that come into play with regard to respective nations.

The aim of this paper is to analyze the terms of the subjects of acts in law in Chinese legal language. Morphologically, Chinese is an isolating language. It also uses a non‑alphabetic writing system. Creating the terms of the subjects of acts in law is governed by fairly strict language rules; however, there are numerous exceptions that may be misleading for the translator. These terms are commonly used, among others, in the civil law contracts and therefore are an important element of the legal language, also used by non-specialists (e.g. parties to the contract). The analysis of particular terms has allowed to identify the aforementioned general rules in the legal language, as well as to find some exceptions. The research material included the civil law acts (General Principles of Civil Law of the PRC, new General Provisions of Civil Law of the PRC, the Contract Law, and the Inheritance Law – in modern Chinese law, as yet, no unified civil code has been adopted, therefore its role is played by the general law and the so-called satellite laws). The study is complemented by the comparison of the Chinese legal terms and their suggested Polish equivalents, which can be a valuable help for translators.

With the “glosa” on the Siete Partidas (13th century) by G. López (16th century), Latin America possesses an excellent example of a commentary on a civil law code, actually one of the greatest of the civil law tradition. Yet, the Latin American countries did not develop, as a rule, a proper culture of commentaries, albeit they gave themselves civil codes around the middle of the 19th century. The most important of these codifications, the Chilean civil code by Andrés Bello, is even a conscious continuation of the tradition enshrined in the Siete Partidas. In most countries, authors prefer instead to write textbooks. This choice seems to be explained by the fact that this literary form gives them more freedom to distance themselves from their civil codes, which are considered rather historical monuments than living legal texts. Commentaries appear only where the civil lawyers deal with a modern codification which is the case in Argentina and Brazil.

The article analyses the legal character of stadium ban. Interpretation of the legal regulations shows that there are a few aspects of stadium ban: administrative, criminal and civil. The author considers the character of stadium ban from administrative, criminal and civil perspectives. Moreover, the author points out two judgments which were held by the Constitutional Court in this regards. The article focuses on a few legal issues, for example regarding to legal basis of the stadium ban. The legislator introduced for mixing together the various elements of criminal law, civil and administrative. The stadium ban is stipulated by a private entity. The stadium ban has criminal character, but the appeal of it is subject to administrative law. Therefore the stadium ban’s regulations are unconstitutional.

Opis:
According to the Act of 1963 of Common Lands, in order to properly manage and develop the common land, its shareholders shall appoint the administrative entity called the common land’s company. The company is not the owner of common land, but acts as the land manager, since these lands are subject of specific type of joint ownership operated by a rural community. The establishment of the company is made by way of a resolution adopted by a majority of members entitled to participate in the common land in the presence of at least half of them. Upon approval of the statute of the company by the appropriate administration authority, the company acquires legal personality. The article describes the legal nature of the common land’s company and aims at placing it in the Polish legal system. In order to achieve it, the common land’s company is being compared to a civil, commercial and administrative law companies.

Fundamental Polish pre-war regulations pertaining to civil service (i.e. the 1918 Regency Council Rescript and 1922 Law on Civil Service) represent fairly comprehensive pieces of legislation which also somehow reflect the concept of civil service accountability. The reflection they offered, however, is far from representing a complete model of accountability as they contain only a handful of criteria useful for the identification of quality expected from civil service performance. Yet, even these limited regulations can be considered effective anchors for construing the concept of civil service accountability with the intentionally left loopholes to be filled in by the political (i.e. non-civil service) corps of governmental offices. The identified criteria of civil service quality can be interpreted as representing determinants of accountability identified in the Friedrich-Finer Debate. In the regulations concerned, Friedrichian determinants (i. e. these concerned with the systemic delineation of competences) are less pronounced than the Finerian ones (concerned with the axiological content of accountability). When compared with the present 2008 Civil Law, the pre-war regulations provided for far more regulatory determinants of accountability. The resulting normative intensiveness produced a stronger anchor for civil service accountability (and,atthe same time, independence) than the one now in force.

The article explores reasons of the abandonment by the Polish legislator of the public law model of the civil service. The discussed reasons were classified into two categories: normative and non-normative premises. The first group discusses the impact of international law on the activities of the Polish legislator and the disproportionately large number of publications on the doctrine of labor law as compared to the administrative law. In the second category, three groups of impact on the legislator’s activities are discussed, i.e. the political perspective (here: systemic, point-based, and episodic impact), clerical, and social perspectives. In conclusion, a return to public-law solutions is proposed.

Judicial capacity consists in the transposing of substantive law subjectivity to proceedings under civil law in a form allowing valid proceedings closing with a judgment, said proceedings involving the participation of a specific entity. A party without capacity for the status of specific subjective rights or legal relationship cannot expect to participate in a valid trial closing with a judgment. Three categories of entities with general legal capacity – private individuals (natural persons), legal persons, and organisational units as stipulated by provisions of Article 64 §11 of the Civil Proceedings Code – have been equipped with judicial capacity, as they can be party to legal relations constituting the subject of action. The participation of such entities in proceedings under civil law – while potentially concerning any case – shall only apply to cases under civil law wherein entities as duly indicated act to protect their legal circumstances associated with events potentially occurring prior to the commencement of judicial proceedings. They should only appear as parties in civil cases involving their activities on their own behalf and to their own benefit.
