Opis:
Public administration in Poland has taken the form of a system of entities with different tasks and objectives, as well as different competences. It is a part of the classical model based on the functioning of two separate components, such as the state administration, including the government and local self-government. From the perspective of a democratic state governed by the rule of law, the existence of local self-government is extremely important, and even becomes a necessity. Therefore, the deliberations addressed in the paper focus on the functioning of this form of public administration at the lowest level of basic division of the state, which is the commune. The presented research is an attempt to indicate the legal status and position of commune self-government not only in the broadly understood local self-government but also in the whole public administration system.

The article presents the impact of European Union law on the development of supra-local self-government structures in Poland. In the literature, it is estimated that the self-governmental reform of 1998 assuming the establishment of self-government voivodships and poviats enabled Poland to effectively join the implementation of regional development policy. The voivodship self-government and poviat became the basis of the institutional infrastructure together with the commune, enabling efficient acquisition of the Structural Funds and the EU Cohesion Fund.

The concept of decentralization has fixed content and the scope of meaning. At present, defining decentralization only through the lack of hierarchical dependence would be incorrect. One can speak of the external and internal limits of decentralization. The internal limits of decentralization are political or legal determinants of decentralization. The external limits of decentralization are those which closely interact with centralization – as an opposite category, but complementary to decentralization. Outside of decentralization and centralization, there is a place for autonomy. Autonomy is in contradiction with the state’s unitarian character.

Restoring in 1990 institutions of territorial self-government at the gmina level was one of the most profound measures undertaken for the purpose of transforming the political system of Poland. This reform did not close the path to further decentralisation of the state and to the creation of self-government institutions at other levels of the basic territorial division. Attempts made during 1992–1996 at establishing self-government at the poviat and voivodship level proved unsuccessful. There was no further, considerable decentralisation of the state, although the previous experiences of the functioning of gminas clearly indicated that territorial self-government effectively pursues the tasks and competences previously belonging to central government organs. As a result, the reform of the structure of public administration in Poland, introduced in 1990 and in the subsequent years, was considered unfinished. Following amendments were not made until 1998, when two acts were passed on 5 June 1998: on the poviat self-government and on the voivodship self-government, as well as many acts amending the scope of tasks and competences of organs of public administration. Thus, there was also fulfilled one of the fundamental assumptions of the state structural reform, which involved the grounding of local administration on the self-government system. The study presents the process of developing the structure of territorial selfgovernment in Poland during 1990–2000, with a particular consideration of the selfgovernment’s organs, the course of their formation and the rules of their functioning. It should be emphasised at this point that new acts on self-government of 1998 referred in their regulations to many solutions adopted back in 1990 in the act on gmina selfgovernment, yet in some cases introducing entirely different regulation or only slightly similar to the one in force in gminas. On the other hand, some regulations adopted in the poviat and voivodship legislation became a starting point to the amendment of the act on gmina self-government. However, in some cases, there occurred differentiation of the constitution of particular units of territorial self-government which was removed by subsequent amendments of legislation in force.

The article discusses the definition and the essence of the principle of social participation, with particular emphasis on the views of the doctrine and the jurisprudence of the administrative courts. The author expresses the view that social participation has constitutional legitimacy (however modest) and is closely related to the category of civil society. In the following part of the paper, specific participatory instruments are synthetically presented: public consultations, civic budget, youth municipal council, municipal council of seniors, civic legislative initiative, local referendum and village administration (sołectwo) fund. In summary, the author takes the view that the development of social participation meets the desired changes, empowering the real impact of residents on the life of the local community. Moreover, he expresses the view of the need to conduct critical research in parallel on the discussed principle.

As a result of communalization of state property, local self-governments received significant areas of forests related territorially to the areas of cities and communes. The lack of, apart from a few exceptions, specialized organizational units to manage these areas causes a number of organizational problems. Opis:
The thirtieth anniversary of the return of local government at the municipal level to the Polish legal and constitutional order prompts various reflections and summaries. There is also time to ask questions about basic issues. Such is the question about the existence of permanent and durable elements in the institution of local self-government, not susceptible to changes in the economic, technological or cultural environment. They include, first of all: 1) the legal nature of the municipal self-government (in terms of public and private law); 2) general goals justifying its existence; or 3) the ways and methods of their implementation. Considering the utilitarian and praxeological context of the existence of local self-government, it is worth paying attention, above all, to those permanent elements that determine the task-related effectiveness of the municipality. They are in particular: 1) collective needs of the community; 2) cooperation of the municipality with other entities and 3) measures conditioning the implementation of tasks entrusted to the municipality. The above enumeration does not reflect the full list of determinants of the effectiveness of local government institutions, but nevertheless it seems reasonable to present a few comments and observations on the indicated elements, which could also be treated as a source of verifying the correctness of the choice made.

Opis:
The article deals with the subject of collegiality and monocracy in the structure of local government authorities in Poland. The author begins his considerations with the characteristics of the collegial and monocratic form of organization of administrative organs. It indicates their essence, advantages and disadvantages and the related possibilities of their application in public administration. The next part of the study analyzes the existence of collegial and monocratic forms in the organizational system of local government authorities, which are treated in a broader sense than just as organs of individual local government units. The author indicates collegial and monocratic structures, emphasizing that the former are clearly preferred, and discusses the postulate of extending the monocratic form to all local government executive bodies; also draws attention to the need for a legal solution to the emancipation of monocratic offices of heads of collegial organs towards the separate and independent offices. An important role is played by the presentation and evaluation of various collegial bodies with which local government organs are enclosed. The considerations end with summarizing reflections, in which the timeliness and importance of the issues under consideration is emphasized, along with the listing of the most important issues.
