Opis:
Intentional destruction and theft of cultural property during armed conflicts are now prohibited by international law. In line with international regulations, deliberate attacks against cultural property, both during international and non-international armed conflicts, may constitute serious violations of the norms of humanitarian law and their perpetrators should be tried and penalized. At the international level, the United Nations Educational, Scientific and Cultural Organization (UNESCO) is the most appropriate body to take action to protect cultural property during armed conflicts. The International Criminal Court (ICC), on the other hand, has the jurisdiction to prosecute and penalize perpetrators of crimes against cultural property, classified as war crimes. The aim of this paper is, therefore, to answer the question of the extent to which the cooperation between the ICC and UNESCO may affect the protection of cultural property during armed conflicts. In order to answer this question, analysis was performed of the scope of the protection of cultural property by the ICC and UNESCO, as well as of the legal basis for cooperation between these institutions.

Opis:
Starting with the presentation of the acts of international maritime law most relevant to the presented subject, the author describes the history of the development of international organizations and their types. Using a dogmatic and historical analysis of normative acts, he tries to find an answer to the question asked – “Is the preservation of the maritime environment a dominant perspective among the operational goals of states?”. While examining the above issue in relation to the formation and activities of international organizations, the thesis was formulated that “the coordination of efforts of international organizations in matters related to maritime resources and their effectiveness should constitute the core of considerations on the subject of the effectiveness of all kinds of international policies”. The author presents the legal and international approach to the definition of maritime resources and describes the effectiveness of the European Union’s Common Fisheries Policy.

The aim of this paper is to map the issue of environmental protection of outer space from the perspective of regulations of existing corpus iuris spatialis. The issue of the environmental protection of outer space has been a subject of considerable discourse which leaves many questions unanswered from the present corpus iuris spatialis perspective. There is no doubt that environmental concerns are an issue for the outer space legal regime and that the human activities in outer space pose a serious threat to future generations and uses of space. The article consists of five parts. In Parts I and II, the author deals with the problems of definitions of the environment of outer space and the environmental threats connected with human activity in the outer space; Parts III and IV present an overview of corpus iuris spatialis from an environmental protection perspective, and principles of international environmental law from the perspective of the future regulation iuris spatialis. Part V presents some final remarks.

The paper concerns the issue of climate migrants, the causes of this phenomenon, and postulates in this respect. It should be indicated that currently there are no binding legislative acts that would regulate the legal status of a climate migrant. The definition of the term ‘refugee’ in the Convention Relating to the Status of Refugees of 28 July 1951 covers only those who are forced to change their place of residence for fear of persecution. However, the term ‘environmental refugee’, or ‘climate refugee’, has been used in the literature and in international legal documents, e.g. in the report for the United Nations Development Programme of 1985. Due to climate change and other environmental factors, the problem of environmental migrants has become a reality. Small island states, such as Tuvalu, the Maldives, and Kiribati, are among the most vulnerable to climate change, including rising sea levels and risk of flooding. Therefore, appropriate legal measures should be taken to fill the legislative gap and to provide appropriate legal protection to persons who seek asylum in other states due to climate threats.

Environmental protection in times of non-international armed conflicts is not subject to the sectoral or particular protection categories of environmental law and to date it has not been comprehensively regulated by international law. Except for generalities, it was also ignored in the 1992 Rio Declaration Principle 24 of which is not unambiguous in its expression. In fact, only the international humanitarian law of armed conflict contains norms which address the natural environment in times of armed conflicts. On the basis of a review of legal acts addressing the issues of environmental protection in times of non-international conflicts, negative conclusions de lege lata can be drawn as part of an attempt to answer the question whether international law ensures sufficient environmental protection in such circumstances. In the Author’s opinion, in international law there is a gap relating to the protection of the environment in times of non-international armed conflicts; the existing legal regulations which could be applied in these matters have a rudimentary characters.
