The article concerns primarily the effects of the membership of the European Union on national (Polish) law and, to a limited extent, on the political system of a state. The conclusions presented in the article are of universal value. Although the article deals with Polish affairs, the principles, tendencies and consequences identified are typical of the relationship state – the EU, both before and after accession, regardless of the state concerned. It should be, however, noted that the path to membership and the membership itself are different in each case. The practice of the Polish membership of the European Union, its systemic dimension and the changes in the national legal system (Europeanisation) do not differ significantly than in the case of other Member States. Europeanisation of Polish law, politics, economy, culture and society has been in progress since the 1990s. One can differentiate between two stages of Europeanisation: before and after Poland’s EU accession, each characterised by different conditions. Over time, this process, on the whole, has been undergoing numerous changes but it has never weakened in importance. Poland faces issues such as poor legitimation of integration processes, supremacy of the government over the parliament, passivity of parliamentary committees in controlling the government and EU institutions in the decision making process, as well as dilution of responsibility for decisions taken within the EU. The process of Europeanisation relies mostly on direct application of the standards of EU law in the national legal system, implementation of directives into national law and harmonisation or standardisation of national legal solutions so that they comply with the EU framework. It is also reception of a common, European (Union) axiology.

Opis:
The term ‘beneficiary’ used for the purposes of spending the EU aid funds was introduced into the Polish legal system before Poland became member of the European Union. Initially, the national legislator used this term only in the domestic regulations on the basis of which public funds were transferred. Over time, the legislator also introduced the definition of the beneficiary to national regulations adapted to the needs of the cohesion policy. It can be observed that the legislator, while initially providing own definitions of the beneficiary, recently has only referred to particular provisions of the directly applicable EU regulations. Obviously, national authorities must operate in an integrated legal system, in which there are many sources of binding law that define ‘beneficiaries of funds allocated to the implementation of the cohesion policy’. In this context, one can speak of the Europeanisation of national law with regard to the implemented policy.

The year 1993 marked the establishment of formal EU citizenship and, subsequently, special relations were forged between the earlier status of the individual, a subject of internal market freedoms, and the notion of political EU citizenship. The social and welfare rights of individuals were strengthened, thus enabling a deeper integration. The social rights in the EU’s legal system play a special role in the construction of EU citizenship as they add meaning to the notion of citizenship and go beyond the traditional, economic dimension of integration. What links the constructs of market citizenship and social citizenship is the strong emphasis on the individual’s right to their status, and to rights which can be exercised effectively. Recently, political and economic citizenships have merged. However, this process has been confronted with resistance from some member states, particularly the ones with wealthy social protection systems. This has been caused by the abuse of rights by migrants from other member states, i.e., through so-called social tourism.

The aim of this paper is to present the concept of Better Regulation (BetReg), in particular its implementation mechanisms in light of the latest documents of EU bodies and its application in the European Union legislative procedures. It will illustrate both viable aspects and shortcomings of this initiative. The authors argue that the better regulation postulate has a horizontal nature. It is an initiative that brings tangible and noticeable effects; however, it must be applied as an EU legislative standard for the whole EU law: not only for that being designed or amended but also for assessing the existing law in all EU law-making institutions and countries implementing European legislation. A question is raised whether BetReg has a real impact on legislative practice or whether it remains predominantly a postulate. The hypothesis is that BetReg is already a mature project and may significantly improve the legislative environment in the EU. It should be noted that the paper covers only a fraction of the problems, the comprehensive examination of which would allow verification of the hypothesis.

Opis:
At the current stage of the European integration, the problems occurring as a result of the coexistence of the European private law, including contract law, and the national legal systems, find their origins in the differences in legal concepts underlying these legal orders, defined by different goals and hierarchies of values. In European private law, the tendency to protect the weaker party of the contractual relationship is stronger than in national legal systems, or at least some of them. This results from the fact that the European legislator confers particular importance to the consumer protection, employment, public health and access to the public utility services (transport, telecommunications and Internet services, energy). In these very fields, European law limits the parties’ formal autonomy in order to guarantee their actual autonomy. The regulatory functions of the European law determine the content of legal relationships in order to compensate the “deficiency of equality” by strengthening the weaker party and limiting the professional’s rights. By these means a perspective based on the distributive axiology rather than on the commutative function typical for the civilistic relationships is being introduced into private law. This trend is reflected in the EU Court of Justice case-law. The abovementioned tendencies clearly correspond with the ongoing evolution of the national systems of private law under the influence of European law. In other words, the impact of the European law is getting stronger, and this not only by way of introducing new regulations, but also due to the alteration of the methods of legal interpretation and applying the law, by putting emphasis on the wider context of legal mechanisms. This process leads more and more often to consequences, which legal scholars use to characterize as a “publicization” or “constitutionalisation” of the private law.

Ukraine has chosen its way of development towards Europe, European values and respect for human dignity and human rights. The signing of the Association Agreement in 2014 obliged Ukraine to harmonize its legislation in priority spheres of life with the legislation of the European Union. But legislative approximation should touch not only upon the fields of public law, but private law too and, in particular, tort law. The main problem of tort law approximation is that there are no joint tort rules in the EU. All attempts to harmonize tort law stopped at the creation of acts of “soft law” – general non-binding rules and principles. One of the most significant examples is the PETL – the Principles of European Tort Law. The PETL show a modern understanding of torts, spell out the conditions of tort liability, as well as other relevant requirements. Ukrainian rules of tort law do provide protection of a victim’s violated rights, however some recommendations of the PETL, such as provisions governing the conditions of tort liability, the understanding of causation and fault should be taken into account when Ukrainian tort law is modernised.

30 April 2016 saw the entering into force of the Act of 14 April 2016 on the Suspension of Sale of Land of the Agricultural Property Stock of the State Treasury and on Amending Numerous Acts . The amendments pertained to, inter alia, the Act of 11 April 2003 on the Formation of the Agricultural System , and introduced a variety of alterations thereto, thus restricting significantly the freedom of trading in agricultural land. This article provides an analysis of conformity of Polish legislation with European Union legislation and also explains the liability of the State Treasury in case of violations of EU law.

Unimpeded functioning of the natural environment is the basis for the operation and effective development of society. However, the fundamental role that nature plays in the existence of society has not protected it from overexploitation. Human activity focused mainly on the progressive economic development has gradually led to a significant environmental degradation. Therefore the problem of environmental protection has rightly become the main topic of public discourse worldwide. In response, governments and international organizations have taken a series of coordinated actions to prevent further destruction. Law is one of the most effective instruments in environmental protection. The Polish Constitution provides that environmental protection is a duty of public authorities, which they are obligated to fulfil. The EU law also protects the environment by means of many legislative acts. Over the years, the European Union, as the economic and political union of states, has developed one of the most restrictive mechanisms of environmental protection. The EU legislation has always emphasized that sustainable development and green economy are the supreme values for the Union. The EU law is part of the Polish legal system, and thus also imposes the obligation on Polish public authorities to care for the environment.

In a referendum held on June 23, 2016, the United Kingdom voted in favour of leaving the European Union. For the first time since its creation in the Lisbon Reform Treaty of 2009, art. 50 TEU will probably now be invoked by the UK for the withdrawal process from the EU, envisaged by the outcome of the referendum, to commence. Article 50 TEU requires that national constitutional arrangements exist so that notification on withdrawal can be made to the European Council. Curiously, to date, the biggest consequence of the referendum outcome has not been the creation of a debate about the role of EU law in the UK legal order, but rather the separation of powers within the UK’s unwritten constitution and which organ of state has authority to activate the art. 50 TEU withdrawal: Parliament or the Executive. The debate has spawned dozens of constitutional blog posts, numerous academic articles, a High Court judicial review of the Government’s position, a second draft independence bill published by the Scottish Government and a judicial review before the Northern Irish Court of Appeal. On one side of the debate, the Government maintains that it alone possesses the Royal Prerogative to ratify and withdraw from international treaties, and thus to make the notification of withdrawal. On the other hand, Parliament and the ’Bremainers’ maintain that any unilateral action by the Government exceeds its authority, and Parliament must provide authorisation; a position which could ultimately result in the referendum outcome being ignored and the UK remaining a Member State. In a third corner, the governments of Scotland and Northern Ireland, two countries within the UK whose electorates voted to remain in the EU, demand a voice in both the decision to leave and in the subsequent negotiations with the EU institutions (note, however, that the status of the devolved administrations will not be addressed in this article, as the issue is considered by the author as being too unclear in the absence of any judicial statement on matters of devolution and institutional hierarchy, including but not limited to the limitations imposed on the doctrine of Parliamentary Sovereignty by the Sewel Convention). The judgment of the High Court has not yet been published, and even if it were there will inevitably be an appeal to the Supreme Court, so it is only possible to speculate on what will happen, but this article intends to provide clarity on the legal principles currently under discussion in the most important constitutional discussion to happen in the UK since it joined the EU in 1973.

The numerus clausus of property rights indicates that a mandatory closed catalogue of property rights exists in a given legal system; the content (method of creation, conveyance, expiration) of a right falling within this closed list is strictly specified and cannot be changed by the parties. In this way, the state consciously limits the activity of the parties in this regard, indicating the socially and legally acceptable types of property rights they can use. An insightful look at the development and explanation of this principle over the centuries and now seems to be necessary with the advancing unification of private law in Europe. The present article discusses the dogmatic basis of the concept of numerus clausus and outlines its history and economic reasoning behind it. Then, the main models of the numerus clausus in European legal orders as well as the functioning of this principle in Polish property law are presented. Subsequently, the strengths and weaknesses of the numerus clausus are examined. This provides us with general conclusions concerning the harmonization of this area of private law.

Opis:
The article presents the genesis of the occurrence and origin of the African Swine Fever virus (ASF). In the absence of the discovery of a vaccine against the ASF virus, the only form of combating it is the application of administrative legal mechanisms characteristic of sanitary and veterinary law. The subject of the analysis are the administrative and legal mechanisms used to fight the ASF virus: the bans, orders, and mixed structures. The legal analysis performed was based on the legal regulations of the European law and the Polish national law. The final remarks include an assessment of the effectiveness of the doscussed legal mechanisms.

The article presents current development trends related to European regulations concerning agricultural property trade. The paper aims at examining the influence of international legislations on the scope and content of the non-refoulement principle as articulated in the Polish law. Its shape on the Polish national ground is in fact a sum of influences stemming from external law systems. The article is based on the determination of three major sources of the refugee law that shape the content of the principle: public international law, European Union law and Polish national law. The Author first scrutinises the scope and content of the principle as laid down in crucial legislations belonging to these three sources which later enables their comparison and examination of the impact they make on one another in terms of conceptualisation of the principle of non-refoulement. The EU law reflects and specifies mechanisms established in the public international law which are further specified on a national ground. The final product is a national structure of the principle which is far more specific than the one known from the 1951 Refugee Convention that first stipulated it. The Author concludes with pointing at flaws and inaccuracies in a national articulation of the principle.

The article presents author’s own opinion on case C-333/21 which concerns the controversial project of organizing a football Super League (ESL). The aim of this initiative is to develop a commercial organizational formula for football competition, which at the same time would be independent of the structures of FIFA and UEFA. For the above reasons, the resolution of the dispute before the Court of Justice of the European Union has a significant impact on the answer to the question about the future of the organizational structure of European football. In this case, the EU competition law and the determination of a catalog of values are of fundamental importance that could possibly justify compliance of the restrictions applied by FIFA and UEFA in relation to ESL organizers with Articles 101 and 102 TFUE.

This article discusses the role of administrative norms in food labelling regulations with regard to consumers’ protection. Administrative regulations play a significant role in the entire food law system, particularly in the pursuit of its general objectives related to consumers’ well-being. Food labelling is one of the instruments applied to ensure consumers’ protection but it needs to be assisted by a legal apparatus enabling efficient control over the observance of the provisions and imposing sanctions for non-compliance. Not only is food label a basic channel of communication used by producers in order to provide consumers with information about products, but it also has a tremendous impact on consumers’ food choices. Information shared on labels ought to be readable and understandable for the purpose of facilitating conscious food decision making. Nonetheless, despite the institutional support, consumers are still considered to be the weaker party on the food market, therefore food labelling regulations should be compliant with their awareness and habits.
