The aim of this paper is to analyze the effectiveness of the EU Package Travel Directive during the COVID-19 pandemic. First, the paper depicts the legal regime under Council Directive 90/314/EEC of 13 June 1990 on package travel, package holidays and package tours as well as Directive (EU) 2015/2302 of the European Parliament and of the Council of 25 November 2015 on package travel and linked travel arrangements. The comparison of both EU Package Travel Directives shows both some similarities and differences from the perspective of travellers’ rights. Furthermore, the paper offers justification of the actions taken by the EU Member States in the face of COVID-19 pandemic, using the EU report on the application of the 2015 Package Travel Directive. Finally, the paper exhibits case law relating to tourism that evolved as a consequence of the COVID-19 pandemic. The reported cases are pending before the Court of Justice of the European Union, which means that all EU Member States are still waiting for the final judgement. The author supports the views presented by Advocate General Laila Medina and strongly believes that the protection of tourists will be continued.

The article presents the impact of European Union law on the development of supra-local self-government structures in Poland. In the literature, it is estimated that the self-governmental reform of 1998 assuming the establishment of self-government voivodships and poviats enabled Poland to effectively join the implementation of regional development policy. The voivodship self-government and poviat became the basis of the institutional infrastructure together with the commune, enabling efficient acquisition of the Structural Funds and the EU Cohesion Fund.

The aim of this article is to investigate how the principle of transparency, deriving from the Treaties and the secondary law, is implemented in the course of conditions and rules imposed during the public procurement procedure. Firstly, the principle of transparency in the EU legal system is discussed and explained are its sources, types and aspects, as well as the necessity to adapt it with time. Secondly, the principle of transparency in the EU public procurement law is outlined, with particular emphasis on its sector specific sources and aims it serves. Furthermore, the question is analysed whether the notion of “transparency” is a principle or a legal obligation, used to implement other principles. Thirdly and lastly, the principle of transparency is discussed, as reflected at different stages of public procurement procedure.

The subject of this article are issues related to the functioning of the food safety system in terms of institutions and administrative entities established for this purpose at the EU level. The aim of the considerations is to answer the question whether the adopted legal solutions will enable effective official control of agri-food products. They are based on the assumption that only coordinated control and monitoring programmes serve to prevent or minimise exposure to food hazards. At the same time, they should cover the entire agri-food chain, and the application of a coherent approach to official controls and enforcement measures should serve this purpose. Member States are responsible for compliance with EU legislation in this regard. They shall indicate the competent central authority or authorities to which they entrust control competences. Their specific role is, among other things, the development of procedures or solutions used to ensure the efficiency and usefulness of official controls and other official activities. Official food control is one of the most important instruments of the food safety system. Therefore, the extension of its scope to the entire agri-food sector should be evaluated positively. The EU control model created allows for its effective organisation. At the same time, it should be stressed that the environment of the agri-food chain is constantly changing, which requires constant adaptation of the official control system by the EU legislator.

In September 2015, the European Commission announced the first actions of its plan to build a Capital Markets Union in Europe. The undertaken restructuring of the financing model is designed to make a shift in the main channel through which enterprises raise investment funds, from loans to capital, and – as a result – contribute to more dynamic growth in the EU Member States. I describe the key features of the Commission’s plan and discuss the economic rationale behind it. The plan has many strengths but also some weaknesses, such as limited ambition in the supervision and enforcement of securities regulations. Other challenges to the development of European capital markets include the financial transactions tax, the low-interest-rate environment, cultural reasons, and potential political opposition. My paper deals first of all with highlighting the structure of the financial sector in the European Union. It provides a overview of the role of the different financial and no financial sectors in offering capital funds to accomplish the needs of households, companies, governments, etc.. I also describe the history of capital market integration in the EU. The paper also analyses some important aspects of the implementation of the Capital Markets Union, which will be a key step in completing the EU Single Market. I concluded that the integration of the capital markets will be a strong step in supporting economic growth and competitiveness in the EU in the long run.

Many issues need to be considered and tackled before moving data into the cloud. Adoption of cloud computing raises concerns and questions in particular with respect to security, control and privacy in cloud computing environment. Users should be aware where their data will be stored and what law governs. In a case where personal data are to be processed it is important for the contracting parties to ensure that requirements and obligations placed on them pursuant to the EU data protection laws will be fulfilled. This article also includes an overview of typical terms and conditions of cloud computing contracts, stressing that most of contractual arrangements in current practice fall short of achieving a fair balance of rights and obligations arising under the contract between cloud providers and users. The aim of this study is to indicate regulations and guidelines which are applicable to cloud computing contracts as well as initiatives undertaken at the EU level and their role in building legal certainty and trust to cloud computing technology.

In a referendum held on June 23, 2016, the United Kingdom voted in favour of leaving the European Union. For the first time since its creation in the Lisbon Reform Treaty of 2009, art. 50 TEU will probably now be invoked by the UK for the withdrawal process from the EU, envisaged by the outcome of the referendum, to commence. Article 50 TEU requires that national constitutional arrangements exist so that notification on withdrawal can be made to the European Council. Curiously, to date, the biggest consequence of the referendum outcome has not been the creation of a debate about the role of EU law in the UK legal order, but rather the separation of powers within the UK’s unwritten constitution and which organ of state has authority to activate the art. 50 TEU withdrawal: Parliament or the Executive. The debate has spawned dozens of constitutional blog posts, numerous academic articles, a High Court judicial review of the Government’s position, a second draft independence bill published by the Scottish Government and a judicial review before the Northern Irish Court of Appeal. On one side of the debate, the Government maintains that it alone possesses the Royal Prerogative to ratify and withdraw from international treaties, and thus to make the notification of withdrawal. On the other hand, Parliament and the ’Bremainers’ maintain that any unilateral action by the Government exceeds its authority, and Parliament must provide authorisation; a position which could ultimately result in the referendum outcome being ignored and the UK remaining a Member State. In a third corner, the governments of Scotland and Northern Ireland, two countries within the UK whose electorates voted to remain in the EU, demand a voice in both the decision to leave and in the subsequent negotiations with the EU institutions (note, however, that the status of the devolved administrations will not be addressed in this article, as the issue is considered by the author as being too unclear in the absence of any judicial statement on matters of devolution and institutional hierarchy, including but not limited to the limitations imposed on the doctrine of Parliamentary Sovereignty by the Sewel Convention). The judgment of the High Court has not yet been published, and even if it were there will inevitably be an appeal to the Supreme Court, so it is only possible to speculate on what will happen, but this article intends to provide clarity on the legal principles currently under discussion in the most important constitutional discussion to happen in the UK since it joined the EU in 1973.

The aim of this article is to present the development of Polish and EU regulations on child pornography. Four amendments to the Polish Criminal Code, which were passed with the purpose of effecting tools to protect children, are strictly connected with the changes in the EU law – from the Green Paper of 1996 to Directive No. 2011/92/EU of the European Parliament and of the Council. The paper presents the current definition of child pornography, the understanding of which has evolved since the 90s. Changes in the EU law and the Polish regulations can be divided into three stages – first attempts at specifying instruments on child protection, widening the scope of the definition of child pornography and stiffening sanctions for child pornography. Amendments tothe Polish Criminal Code reflect the actual tendency to adopt more precise tools to prevent children from sexual exploitation. However, it does not lead to desired effects. Child pornography is a growing problem due to the relentless technological development but current regulations in their casuistic form are not a suitable tool to combat sexual exploitation of children.

Since the Chernobyl disaster, special attention is paid in Ukraine to legislation in the field of nuclear energy and radiation safety. A new stage of enhancing Ukrainian nuclear and radiation safety legislation began with the signing in 2014 of the Association Agreement between the European Union and its Member States, of the one part, and Ukraine, of the other. In addition, the Ordinance of the Cabinet of Ministers of Ukraine of 17 September 2014 on the implementation of the Association Agreement on atomic energy between Ukraine from one side and the European Union, the European Community and its member-countries from another side, provided for the development and adoption of new regulations in the energy sector (including nuclear) in order to implement Directives: 1) Council Directive 2014/87/Euratom of 8 July 2014 amending Directive 2009/71/Euratom establishing a Community framework for the nuclear safety of nuclear installations, 2) Council Directive 2006/117/Euratom of 20 November 2006 on the supervision and control of shipments of radioactive waste and spent fuel, 3) Council Directive 2013/59/Euratom of 5 December 2013 laying down basic safety standards for protection against the dangers arising from exposure to ionizing radiation. Implementation of EU legislation in the field of nuclear and radiation safety will reveal major shortcomings of the current state of affairs and, at the same time, mechanisms to improve Ukraine’s national legislation with the aim of preventing another Chernobyl disaster in the future.

At the current stage of the European integration, the problems occurring as a result of the coexistence of the European private law, including contract law, and the national legal systems, find their origins in the differences in legal concepts underlying these legal orders, defined by different goals and hierarchies of values. In European private law, the tendency to protect the weaker party of the contractual relationship is stronger than in national legal systems, or at least some of them. This results from the fact that the European legislator confers particular importance to the consumer protection, employment, public health and access to the public utility services (transport, telecommunications and Internet services, energy). In these very fields, European law limits the parties’ formal autonomy in order to guarantee their actual autonomy. The regulatory functions of the European law determine the content of legal relationships in order to compensate the “deficiency of equality” by strengthening the weaker party and limiting the professional’s rights. By these means a perspective based on the distributive axiology rather than on the commutative function typical for the civilistic relationships is being introduced into private law. This trend is reflected in the EU Court of Justice case-law. The abovementioned tendencies clearly correspond with the ongoing evolution of the national systems of private law under the influence of European law. In other words, the impact of the European law is getting stronger, and this not only by way of introducing new regulations, but also due to the alteration of the methods of legal interpretation and applying the law, by putting emphasis on the wider context of legal mechanisms. This process leads more and more often to consequences, which legal scholars use to characterize as a “publicization” or “constitutionalisation” of the private law.

Scientists strongly emphasize that the nature protection will be crucial in the wake of the post pandemic COVID-19 socio-economic recovery as the jump-start of the economy of so-called “new normality” should not result in further environmental degradation. The paper discusses the European Union Biodiversity Strategy for 2030 (hereinafter referred to as BS) whose adoption has been announced in the European Green Deal document (hereinafter referred to as EGD) as, inter alia, the basis for building biodiversity resilience. As a comprehensive strategy aiming to foster the transition of the European Union into a green and digital economy, the EGD has included among its main objectives preservation of ecosystems and biodiversity. Special emphasis is put on the BS which has been adopted in the middle of the pandemic COVID-19 and which aims, inter alia, to enhance environment resilience. The EU ambition is to ensure that the world ecosystems are restored, resilient, and adequately protected by 2050. From this perspective, the EU biodiversity strategy is focused on strengthening nature protection. One of its purposes is to create political and legal tools for building environment resilience, particularly desirable in time of the “new” socioenvironmental normality, following the pandemic crisis. The paper comprises three parts: The introductory issues are followed by the legalsystemic approach to EGD, BS, and the 8th General Union Environment Action Programme until 2030 (hereinafter referred to as the 8th EAP).. The third part addresses biodiversity building resilience from the EGD, BS and the 8th EAP. At the end some complementary remarks de lege lata and de lege ferenda are offered.

This paper discusses a problem whether the war in Ukraine is so specific that it was necessary to adopt the Act of 12 March 2022 on assistance to Ukrainian citizens in connection with the armed conflict in the territory of that country, instead of providing assistance under the Act on granting protection to foreigners of 13 June 2003. Based on a preliminary examination of Polish law, the Geneva Convention Relating to the Status of Refugees of 1951, Directive 2001/55/EC on minimum standards for giving temporary protection in the event of a mass influx of displaced persons, the Council Implementing Decision (EU) 2022/382 establishing the existence of a mass influx of displaced persons from Ukraine, and scholars’ opinions, the author has established that the Polish legislator rightly extended the subjective scope of the law applicable to persons granted temporary protection, and the respective Polish regulations are consistent with the letter and the spirit of international law. De lege ferenda conclusions are also propounded.
