The author asserts that the organization of judicial system in each country is a result of a long evolution triggered by political, economic, social and cultural developments. The Polish Supreme Court was created in 1917, but its current shape is an outcome of changes initiated in 1990s, most notably the entrance into force of the new Polish Constitution in 1997. The author analyses the notion of judicial power by juxtaposing a functional approach and a structural approach. Next, he remarks that the most important function of the Polish Supreme Court is to ensure the uniformity of jurisprudence by examining cassation complaints. Among other functions of the Supreme Court, the author enumerated examination of electoral protests, declaring the validity of elections of executive and legislative authorities, stating the validity of national referendums. The author emphasized that some specific duties of the Supreme Court are stipulated not only in the Constitution, but also in other legal acts. By presenting a wide range of attributes bestowed upon the Supreme Court, the author also invoked the duty of examining complaints against the excessive length of the proceedings, complaints for declaring a final judgment contrary to law, the appellate measures in disciplinary cases involving judges, prosecutors and legal advisors as well as appellate measures against the decisions of the National Judiciary Council. In addition to it, the author hinted at the Supreme Court’s obligation to control acts adopted by the authorities of self-governing bodies of attorneys, notaries, legal advisors and bailiffs. The author comes to the conclusion that the Supreme Court in Poland cannot be described as a typical cassation court. Although its principle role is to examine cassation complaints with a view to ensure uniformity of jurisprudence and its conformity with law, it also fulfils many other functions that are of great significance for the legal order in Poland.

In connect judgement, the Supreme Administrative Court granted right, a taxable person who has been refused the right of assistance thus also possibility of defending their position on the complaints about the decision of the tax authority concerning the multimillion tax liability. The Court of second instance states that the Provincial Administrative Court in assessing the reasons justifing the application of the law should help carry out simulations of the effects of incurring expenses related to legal entry to the assets of the taxable person and the people with him in the household. In addition, the Supreme Court stresses that in determining the value of the assets of the taxpayer must be taken into account only the assets – without excercising a taxable person claims and obligations. According to the author the vote decision is an example of a rational approach to the issue of the right of assistance in the case of taxable persons whose entire property subject to execution. It is essential that the courts processed the applications for the grant of the right in the help i.a. in the context of the possibility of payment of legal entry and real estate has the taxpayer. In the case entry of the Court is 100 000 PLN (maximum) and every taxable person whose tax liability would amount to tens of millions of zloty wouldn’t be able to pay such costs. This may not however prevent the implementation of the right to go to court against such taxpayer.

The author analyzed the structure of cassation proceedings in France. He remarked that the French Cassation Court does not examine the dispute, but the judgment which was issued as a result of the proceedings in a specific case. He claims that the function of the cassation proceedings, as well as the role of a cassation judge is special for several reasons. Most importantly, cassation consists in overruling a judgment. The legal interpretation and the justification of the grounds of such a ruling bear more similarity to doctrinal considerations rather than a purely judicial verdict. The text also presents the organisation of the French Cour de cassation by describing the composition of each chamber, their scope of competence, the tasks of the president of the court as well as the overall day-to-day functioning. The author asserts that the organisation of the court reflects its main endeavour, namely to assure the uniformity of the jurisprudence. Additionally, he puts an emphasis on the relation between the selection mechanism of cassation cases and the Cassation Court’s ability to efficiently fulfill its role. The author argues that such mechanisms do not infringe on Article 6 (1) ECHR. Next, the author proceeds to describe an outline of the court session at the Cour de cassation, including the role of judges, parties to the proceedings, as well as the scope of examination of a cassation and the possible outcomes that come into play. The author concludes his considerations by analysing the extent to which the French cassation court may control the constitutionality of legal provisions and juxtaposing it with solutions adopted in some other European countries.

The text discusses different aspects connected with organisation of supreme courts. It argues that the focus should be shifted to the “how” question. If the supreme courts aspire to fulfil certain special functions, a necessary precondition towards fulfilling this goal entails appropriate organisational structures, means and personnel. The organisation, framework and methods of work of a supreme court should reflect the functions that it is supposed to serve. Although most supreme courts have staff, departments and offices that are entrusted with legal research and analysis, the rise in importance of international jurisprudence is putting on the agenda the need for restructuring and reinforcing the existing departments. The author claims that supreme courts are becoming less and less self-centred in their adjudication, which requires legal research of international and comparative law. The text also deals with other aspects of supreme courts’ organisation. For instance, it shifts focus towards the relation between the number of judges in a supreme court and its impact on the uniformity of jurisprudence. It also emphasises the need to further examine the relation between the number of judges per capita and the efficiency of the court’s work.

The aim of this paper is to investigate the distribution of exponents of modality in the justifications of judgments passed by the Court of Justice of the European Union (CJEU) and judgments passed by the Supreme Court of the Republic of Poland (SN) in the post-accession period of 2011 to 2015. In particular, the paper aims to establish the degree of convergence between translated EU judgments and non-translated national judgments in terms of the employment of modality markers. The research material consists of a large corpus of Polish-language versions of 897 judgments passed by the Court of Justice (CJ), 384 judgments passed by the General Court (GC), a corpus of 2564 non-translated judgments delivered by the SN, and a reference corpus of contemporary Polish (NKJP). The quantitative data point to the high salience and divergent distribution of a number of various markers in both EU and national judgments, such as the value-laden modal verbs należy [(one) must/should] and trzeba [(one) should/must]. It is argued that the frequent use of markers of modality constitutes a generic feature, as it raises the perceived level of authoritativeness of judicial argumentation. The findings may contribute to raising awareness of language patterns which involve the expression of modal stance.

The paper discusses the problem of reopening of proceedings ended in a judgment of the Supreme Court on extraordinary appeal. It examines the admissibility of reopening of proceedings ended in a judgment on extraordinary appeal, court jurisdiction, court panel and cases in which the Supreme Court decides on the admissibility of the reopening. The study also focuses on the appealability of particular judgments on extraordinary appeal and possible decisions on the admissibility of reopening of proceedings using this procedure. The issues of the Supreme Court’s examination of the findings of fact and the power to file a petition for bringing extraordinary appeal proceedings are also addressed. It is concluded that the Supreme Court has jurisdiction to reopen proceedings ended in a judgment of the Supreme Court on extraordinary appeal in three cases: (i) when only the Supreme Court has applied a provision declared to be non-compliant with the Constitution of the Republic of Poland; (ii) when the proceedings have been invalid only before the Supreme Court; (iii) with respect to the restitutionary ground – when, adjudicating the extraordinary appeal, the Court has ruled on the merits of the case.

The text presents the development of the Dutch Supreme Cassation Court from the early 19th century onwards. The Court adopted the French model of cassation, which is reflected in two types of cassation proceedings: ordinary cassation appeals and cassation in the interest of the uniform application of the law. The text offers an outline of the organisation of the court, status of the Dutch Supreme Cassation Court’s judge as well as the layout of the Court’s chambers. Interestingly, although administrative matters are generally excluded from the Court’s scope of competence, an exception to this rule has been made for tax cases, which are examined by one of the Court’s chambers (the so-called “fiscal or tax chamber”). Additionally, the text not only discusses the question of influx of cases and duration of proceedings, but also presents comparative data with regard to each chamber of the court. The author also touches upon the system of consultations in each chamber, which positively affects the uniformity of the Court’s jurisprudence.

The author offers a critical commentary on the point 2b of the Constitutional Tribunal judgment of 7 October 2021, K 3/21. The Tribunal claims that issuing court verdicts on the basis of the provisions which are not binding, having been revoked by the Sejm and/or ruled by the Constitutional Tribunal, is inconsistent with Art. 2, 7, 8(1), 90(1), and 178(1) of the Constitution. The Constitutional Court reconstructs the mentioned above jurisdiction of the courts based on the Art. 19(1), second subparagraph, of the Treaty on European Union. The author doesn’t agree with this statement and argues that the Tribunal incorrectly and unlawfully interprets the provisions of the Treaty. Furthermore, the verdict is in contrary to Art. 2 and 42 of the Polish Constitution and the principle of non retroactivity of law. Moreover, the Tribunal’s decision violates the concept of the Constitutional Tribunal judicature with the deferred clause. The author claims that the Tribunal’s decision does not cause any legal effects and the courts in Poland will not apply it during resolving cases.

Since 1 may 2004 Poland was obligated to adopt rules of the European Union law (acquis communautaire). Domestic courts must apply appropriate regulations two different legal orders . Cooperation with European Court of Justice (ECJ) could be the best solution to achievement accordance of treaties obligations and national law. One of the most popular method, provided for article 234 Treaty establishing the European Community, are preliminary questions. In according with european jurisdiction, polish administrative courts could use this mechanism to adjudicate . In many situations courts have to refer to the ECJ for a preliminary ruling a question on the interpretation european union law. On the other hand some cases should be decided by domestic jurisdiction, but even than ECJ is obligated to present his point of view. Although litigant party could not influence on court he can use regulations provided by domestic legal procedure, for example he can lodge a complaint against suspension of legal proceedings. Put preliminary questions into practice shows how consequences will bear a parties europeanization domestic law.

The text presents the issue of the Supreme Court’s functions from the perspective of civil law countries. The author argues that the division into cassation, revision and appeal is not an adequate point of reference enabling to define those functions. The author asserts that the most important criterion is whether the Supreme Court acts overwhelmingly in public or private interest. The assessment of that criterion should be made on the basis of the methods of selection of cases by the Supreme Court. What is essential is whether the selection is based on public aims or whether it simply aims at solving a given case accurately. It may be argued that as a result of reforms introduced in the last few years, the majorityof civil law countries have focusedon the implementation of the public rather than private functions. The author concludes that the public function of supreme courts is of a completely different significance than in the times of socialism. The public interest is combined with private interest as it refers to the situation of parties – not parties to the specific proceedings, but all parties which are going to engage in litigation in the future.

Members of the pharmacists’ self-government can be held liable before pharmaceutical courts for conduct breaching the rules of professional ethics and deontology, and infringing legal regulations concerning the practice of the pharmacist’s profession. Thus, the basis of professional responsibility of pharmacists is generally similar to the rules of professional liability of doctors, nurses, and midwives. Nevertheless, certain significant differences can be noticed in the course of the proceedings. Such a difference occurs in the proceedings before the Supreme Pharmaceutical Court. The professional group of pharmacists cannot be indifferent to punishable acts because this would imply tacit consent to breach of legal provisions regulating the professional practice and the rules of professional ethics and deontology set forth in the Code of Ethics of the Polish Pharmacist. Therefore, it is crucial that pharmacists, who practise a profession of public trust, should take care of the appropriate status of their occupation in order to conduct properly their mission of serving the society.

Opis:
Amendment to the Civil Code rules on succession, introduced on 2 April 2009, extended the range of statutory heirs by more distant relatives than lineal parents and collateral siblings’ descendants, by including stepchildren within the range of statutory heirs. This article is an attempt of the author – academic lecturer and, at the same time, practising advocate – to reflect on the practical consequences of that legislative reform. In particular, the problem arose as to how the extension of the range of statutory heirs influences the efficiency and duration of court proceedings in matters for the confirmation of inheritance acquisition. The article presents the most crucial procedural problems, often following from inconsistent judicial practice, which lead to the protraction of court proceedings, both when we have to do with intestate and testamentary succession. Another question depicted is the causes of delivering two or more decisions confirming the acquisition of inheritance from the same deceased person and methods of eliminating such defective rulings from legal practice. The presented problems should provide a stimulus for necessary legislative amendments in this area.

Author approves in the commentary to the judgment the position taken by the Supreme Court of Poland in the decision of 30 September 2015, I KZP 9/15. The Supreme Court considered the problem of composition of the District Court – Labour and Social Security Court adjudicating on an appeal against the judgment of the National Disciplinary Court of the National Chamber of Auditors. As argued in the commentary, the District Court does not instigate disciplinary proceedings from the beginning but continues it as an appellate body. The main disciplinary proceedings are held before the National Disciplinary Court of the National Chamber of Auditors. The District Court although acts as a court of first instance with an appeal to the Court of Appeals, has limited powers only to verification of the National Disciplinary Court’s judgment. Thus, the District Court sits in a three-judges panel (art. 29 § 1 k.p.k.).
