Currently, the concept of terrorism, which in recent years has intensified so much, it is still difficult to define, there are huge inconsistencies in both its defining and application. For many years, terrorism was linked with geographically and culturally distant countries, but the 20th and 21st centuries changed the face of this phenomenon, which did not resist globalization and has become one of the major problems that befits to face the modern world. The issue of terrorism, although investigated by many eminent scientists, and even though there are a great many scientific achievements in this subject, it is still a difficult problem and raises a lot of confusion of a legal-dogmatic nature, which the Author tried to highlight herein. The article presents the analysis of the concept of terrorism and illustrates the problems associated with the broad catalogue of definitions of this term. The main problems preventing continued unification of definition are presented. Furthermore, the text assumes the analysis of the legal state instrumental for combating terrorism, with particular focus on terrorist crime contained in the Polish Penal Code.

The presented article is of a historical and legal nature. It analyzes the impact of the legal solutions and the tradition of the Polish civil service on the current model of the civil service. The results of the conducted research lead to the conclusion that despite the considerable passage of time – and despite the fact that while the 1922 Act on the State Civil Service was formally maintained until 1974, the continuity of tradition was interrupted in the period of “People’s Poland” – the classic solutions of the Act from before a century have survived to such extent that there are grounds for talking about the impact of the 1922 Act on the current model of the civil service – a model far from perfect, and even “decapitated”.

The object of analysis is the amended art. 28 § 1 of the Penal Code, which stipulates that „whoever commits an act while being in justifiable error as to a circumstance constituting a feature of an prohibited act, shall not commit a crime”. The new regulation of 28 § 1 of the Penal Code is the next attempt to statutorily define the concept of an offence based on the methodology of a strict separation of the object of evaluation from the evaluation itself, that is, primarily a radical separation of mens rea of a prohibited act from guilt. Therefore, the authors of the change have consistently attempted to eliminate all normative attributes from the scope of „recklessness” and „negligence”. This is a result of the view that assumes a pure descriptive character of the set of criminal offence features (Ger. „Tatbestand”) including subjective features (offences of intentional and unintentional character). In this context, acts committed while being in justifiable error as to a circumstance constituting a feature of a prohibited act exclude guilt, however the fulfilment of the features of criminal acts of unintentional character is limited to the fulfilment of objective features (a consequence of the concept of the unintentional character of an offence as a plain negation of intent). The negative wording of art. 1 § 3 of the Penal Code, the objective and general interpretation of the term found in art. 9 § 2 „could have foreseen” (a transfer of the so-called objective foreseeability to the category of objective attribution) and the concept of committing an act while being in justifiable error as to a circumstance constituting a feature of a prohibited act excluding guilt lead, in the area of unintentional character of an offence, to the presumption of guilt on the basis of the fulfilling only the objective features of a criminal act. The author of the article demonstrates the inaccuracy of this argument for a strictly descriptive character of the features of a prohibited act, and in particular the features of intent (intentional character of an offence). The object of intent (a feature of a criminal offence) has a evaluative character (evaluation), therefore determining intent can generally constitute a premise for accepting guilt (intended), unless the circumstance of excluding guilt exceptionally occurs. In the case of an unintentional character of an act, such a relation does not occur, and the guarantee functions (the rule of positive establishment of the perpetrator’s guilt) thus require subjective (specific and individual evaluation) interpretation of the premise „could have foreseen” found in art. 9 § 2 of the Penal Code.

The paper elaborates the problem of the passive side of capacity to act which consists in the ability to receive (or to be an addressee of) the will declarations. Given the absence of an explicit regulation in the Polish civil code, the passive side of capacity to act has lost its attribute of a doctrinal evidence. However, the capacity to act should not be understood in a popular way limiting this concept to its active side only. Such an understanding generates in fact a grievous gap in the Polish civil law.

Opis:
Set of regulations extracted in the systematics of normative act shall be accompanied by headings. Headings of systematics unit includes the name of the individual, the ordinal number and the signal inscription, which contains the characteristics of team rules. Name of entity together with its ordinal number identifies the unit and show relationships, in which remains the unit to other systematics units in this normative act. The signal inscription is an expression of metalinguistic and identifies a set of rules included in the systematics unit, based on semantic criteria. The essay proposes a typology of methods for creating signals inscriptions. The signal inscriptions occurring in the Polish legal language allowed the determination of terminology (nomenclature) signal inscriptions and to discuss the terms of ownership, including ownership of logic and language (grammar). Shows the diversity and originality of the vocabulary used in the signal inscriptions compared to the vocabulary of the entire legal language and general language.

The legislative standard is the coding of legal norms in legal regulations, because the lawmaker has no need, or even the possibility, to directly present the fully developed legal norms. This coding process enforces the fragmentation of a legal norm, which in turn results in the fact that the interpretation of a legal text, as a process opposite to the activities of the lawmaker, must be non-fragmentary. The lawmaker can and should provide the interpreter with guidelines on how to carry out this non-fragmentary interpretation, and especially indicate which fragments of the legal text are to be related to each other in this interpretation and how to bind them together. The lawmaker may find it extremely helpful in the implementation of this task to make appropriate use of the means of legislative technique, in particular the systematics of a normative act and the references contained in these acts.

The aim of this paper is to present the main solutions adopted in Polish act of July 7, 2005 on lobbying activity in the law-making process, with particular emphasis on the dysfunctions of this regulation. Despite the hopes of reducing corruption in public life and ensuring the transparency of the decision-making process, the discussed act deserves a critical evaluation. Among the many weaknesses, some must be especially identified: the act ignores the possibility of lobbies influencing the law-making by the President, the parliament bodies, the National Broadcasting Council and the decision-making bodies of local self-government and local government administration bodies; public hearing procedure; defective definition of lobbying activity and the size of penalties for violation of the lobbying regulations. Moreover, actual effects of the act were presented, which prove the thesis that Polish lobbying act can be assessed as “apparent regulation”.

The article deals with three main ideas. (1) The philosophical roots of punishment in modern criminal law are the same in countries that very much differ among each other as far as the level of severity of their systems is concerned. It is therefore something else than just philosophical roots that have an impact on criminal and penal policy of a country. Those other possible elements are then discussed. (2) The philosophical roots of punishment in modern criminal law often refer to the Hammurabi rule: “eye for an eye”, and are read as a justification for severe punishment. The article questions this assumption and proposes an interpretation which seems to be much closer to Hammurabi’s original idea. (3) Countries with differences in criminal and penal policy might introduce equally wrong laws abridging the core human rights when they resort to dehumanization practices and moral disengagement. It is especially possible when fear of foreign cultures and terrorism prevails. An example of such legislation, an aviation law in German and Poland, is discussed.

The paper describes the regulations of the Council of Europe concerning medical powers of attorney and permissibility of such powers of attorney under Polish law. The author tries to consider whether a medical power of attorney is capable of functioning within the boundaries laid down under the current regulatory regime or whether new agency provisions are necessary. The paper discusses the interpretation of Article 95 § 1 of the Civil Code and the notion of “nature of a legal act”. At the end of the article a reference is made to the European legal tradition as a common ground for Polish and Ukrainian law.

The article explores the issue of unity of a continuous act referred to in Art. 12 para 1 of the Criminal Code. The author considers whether and (if so) to what extent it is permissible for the adjudicating court to transform separate, concurrent offenses (as listed in the indictment) into one – supplemented by an element of continuity – continuous act of Art. 12 para 1 CC. According to the thesis advanced in the article, such a transformation should be considered admissible as long as the attributed offence does not encompass any additional behavior not expressly listed in the indictment, occurring chronologically before the first behavior of the indictment, after the last one, or between them.

The paper concerns the application of illegal regulations by public administration authorities. This issue is presented in relation to regulations introduced to prevent the spread of COVID-19. The authors believe that the adoption of these regulations and their application prove that ‘the real constitution’ – as it was described by Ferdinand Lassalle – prevails over the written constitution, which in practice becomes only a ‘piece of paper’. The analysis leads to the conclusion that the epidemic regulations were enacted in clear violation of law as they: (i) crossed the limits of statutory delegation; (ii) violated the constitutional principle of the exclusivity of the statute on limiting civil rights and freedoms; and (iii) violated the constitutional prohibition against impairing the essence of rights and freedoms. Therefore, the public administration authorities should refuse their application. The authorities must observe the hierarchical rule regarding the sources of law. Consequently, they have to refuse the application of every regulation which manifestly violates a statute, a treaty or the Constitution. In cases other than a direct contradiction between the regulation and the higher-level source of law, in order to decide whether there is indeed a manifest violation, the authorities should refer to case law (consuetudo secundum legem principle) or the opinio communis of legal scholars. Moreover, applying a regulation despite the fact that it manifestly violates a statute, a treaty or the Constitution leads to the criminal liability of a public office-holder (e.g. an official, a police officer) under Article 231 of the Polish Criminal Code.

Any information relating to an identified or identifiable natural person is considered personal data, and as such, is protected by data protection laws. There are, however, a few specific categories of personal data related to the intimate sphere of life, the processing of which is, in principle, prohibited, unless one of several exceptions occurs. Although, early data protection regulations distinguished the state of health as specific category of data, genetic data were not treated as such. Therefore, in the light of Convention 108 (adopted in 1981) and Directive 1995/46, genetic data were treated as “ordinary” personal data. The Polish Data Protection Act from 1997 went further than the Directive 95/46 and listed “genetic code” among specific categories of data. However, the term “genetic code” was not defined in the Act and in practice caused a lot interpretation problems. The General Data Protection Regulation, adopted in 2016 and replacing national laws, including Polish data Protection Act, enumerates genetic data among specific categories of data. In the light of the GDPR “genetic data” means personal data relating to the inherited or acquired genetic characteristics of a natural person which give unique information about the physiology or the health of that natural person and which result, in particular, from an analysis of a biological sample from the natural person in question.
