Opis:
The problem in the 5th controversia from the work of Lucius Annaeus Seneca the Elder, entitled Oratorum et rhetorum sententiae divisiones colores, is presented as follows: one man seduced two women during the same night. According to the law, which in the literature is referred to as lex raptarum, a woman who was kidnapped may choose between the death penalty for the ravisher or marrying him, but without giving him a dowry. Here, two women were granted the right of option and one of them demanded the death of the man, but the other wanted to marry him. The declaimers were trying to find an answer to the question: which solution is worthier to prevail? Since, in fact, the main problem raised in the controversia is the interpretation of law, it constituted quite a significant intellectual challenge. The declaimers employed very impressive legal reasoning techniques. This controversia constitutes then not only an interesting starting point to conduct the research on the borderline of law and declamation, but also might be a strong argument that the law and rhetoric, at least in some aspects, could have been complementary to each other.

The status of women in law (and not only theirs) is linked to social and cultural perceptions of women’s desirable behavior. Going against well-established patterns is not indifferent in both legal and social terms. One of the primary contexts of ‘femininity’ in the law is close relationships, in which women are viewed through the ‘role’ of a mother and wife. The purpose of this paper is to determine how the cultural script of romantic love and the emotions associated with it affect perceptions of women in close relationships, such as marriage and parenthood. It assumes that the emotions of participants in legal discourse – dogmatists and those involved in the law-making process – influence the final shape of legal regulations. The cultural script that influences how women are perceived in law is romantic love. To illustrate the issue, the case study of the Infertility Treatment Act is presented in this article. This case shows that from a legal perspective, a woman is seen in indivisible roles in a close relationship of a wife (partner) and mother.

Objective: reconstruction of attitudes of Poles towards selected restrictions on freedom of speech and also towards hate speech in Polish law (selected issues). Methods: the approach to data collection included a computer-assisted telephone survey on a sample of N=1,000 adult Poles (18+) and an analysis using descriptive statistics and selected inductive statistics techniques (covariance measures and cluster analysis). Results: an analysis of the aggregate and sub-dimensions of Poles’ attitudes toward selected limits of freedom of speech in the Polish legal system and Poles’ experiences of actions considered violations of freedom of speech was conducted. Groups with different attitudes toward these phenomena and, as a result, different susceptibility to political messages of attempts to limit freedom of speech were identified. Conclusions: Poles value freedom of speech, although – in a sense – they want to limit it; They recognise that it is essential for democracy, but at the same time they do not believe that they can use it properly and, above all, effectively. We observe the paradox of support for freedom of speech or, in another convention, symptoms of ‘flight from freedom’.

Although Pope John Paul II taught through his apostolic letter Ordinatio Sacerdotalis (1994) that the Catholic Church is unable to ordain women to priesthood, the Catholic Church gives a special place to women in it, and a survey of the Code of Canon Law (CIC 1983) and the Code of Canons of the Eastern Churches (CCEO 1990) shows that there is a marked improvement in the Catholic Canon Law regarding the place and role of women in the Catholic Church. Whereas the Pio-Benedictine Code (CIC 1917) did not consider men and women as having the same rights and duties in the Church, the fundamental equality of men and women is acknowledged in the canons of the new Codes. The author argues that there is no violation of fundamental rights of women in the prohibition to ordain women to priesthood. At the same time, the article highlights the clarion call the Pope Francis to have a special role for the “Feminine Genius” within the Catholic Church.
