The aim of this paper is to correct a historical error, one that I will argue is at the heart of the contemporary feminist movement: the ancient claim, grounded in a flawed understanding of the reproductive act, that woman is inferior to man. I will show that the lineage of this can be traced as far back as the pre-Socratic philosophers, finally finding its earliest concrete expression in a claim most have either dismissed, forgotten, or never heard: Aristotle’s argument that women are merely “malformed males” and are therefore “inferior to man”. The theory found support in the first century with a historical interpretation of Genesis 2:18-23, traceable in particular to the Hellenistic Jewish philosopher, Philo (BC 13-AD 54). Philo’s own theory about woman echoed that of Aristotle’s; his legacy includes the vague feeling that Scripture itself declares that, since woman is created after man, she is necessarily subservient to him. She becomes, as it were, the “second sex”. The combination of Aristotle and Philo proved too persuasive even for the mind of St. Thomas Aquinas and the theory accelerated and then spread through the university system inaugurated during the Middle Ages, subsequently informing the social structures and norms of Western civilization, going mostly unchallenged throughout human history, silently persisting even into the present time. This error represents what can be called a chronic “wound” in our intellectual tradition. And it is a wound that must be healed. I argue that the antidote is to correct this account and that it can be defeated on its own terms. Through the lens of Hebraic and Aristotelian-Thomistic anthropology, and building on the insights of St. John Paul II, I provide a robust, philosophically and theologically grounded account of man and woman from within the Catholic exegetical tradition, showing that man and woman are both equally human, equally endowed with intellect, will, and freedom while at the same time reflecting two different ways of being in the world.

The article confronts the most important political and economic thoughts dealing with the way of distributing the tax burden in society with contemporary socio-economic conditions and with the current tax legislation. The essence of the analyzed problem is the traditional dilemma of a flat tax or a progressive tax. In the economic terms, the Polish tax system, treated as a whole, together with social security (ZUS) and health care contributions (NFZ), is not progressive, but regressive, because in percentage terms, the effective burden generally decreases with increasing wealth (the nominal tax rates are flat with the exception of progression in case of PIT). The Polish Deal did not change the fundamental conclusion on the regression of the Polish tax system, although some social groups recorded an increase in the tax burden on personal income (PIT together with ZUS and NFZ contributions).

The article deals with demands made upon women about their appearance in the 21st century, comments made by, and about, women and the ways in which they dress. That is the suggestion that there is a greater plurality about dress in the contemporary world than it was in the world of our grandmothers. But in place of the former strictures there are others: demands about youth and youthfulness, of forms of self association either for or against class and racialised others, of representing a human, dressed, version, of the “new”. All represent aspirations for identifying – or not – the self through dress. The question of who do we want to look like is one that is unavoidable.

The author, starting with the presentation of the acts of the international law of the sea that are most relevant to the presented subject, describes the evolution of the definition of a landlocked state, and the genesis and development of the freedom of the high seas. The author, by means of the dogmatic and historical analysis of the normative acts, seeks an answer to the question: Can the occurrence of actual inequality lead to inequality or to apparent equality, manifested in normative acts? When examining the above issue in relation to the states’ experience, a thesis has been advanced about the seemingly editorial nature of the freedom of the high seas in the context of its exercise by landlocked states. This may suggest apparent inequality of states observable in the international law. The author argues that, despite some unfavourable codification changes, the landlocked states gain a number of rights that significantly reduce the discriminatory nature of the remaining provisions, and international experience shows that the position of the landlocked states in international relations is strong.

The concept of reverse discrimination refers to a variety of strategies that entail giving strong preferential treatment in employment or education to the groups in a society that have been institutionally discriminated against. “Giving strong preferential treatment” means that candidates with lower qualifications are given priority over better qualified members of the groups that have not been discriminated against in the past. Reverse discrimination can be justified with reference to two strategies: backward-looking and forward-looking. On the backward-looking justification, reverse discrimination is a means of compensating victims of past discrimination, while on the forward-looking justification, reverse discrimination is a means of creating more diverse and egalitarian society. The aim of this paper is to challenge both justifications. First, against backwardlooking justification, I shall claim that reverse discrimination is not a proper method of compensating for past wrongs of discrimination. Second, I shall challenge the forwardlooking argument by pointing at the risks inherent in perceiving reverse discrimination as the means of creating more egalitarian society. Importantly, the objections presented in this paper refer only to reverse discrimination, and they do not undermine other methods used within the affirmative action (including tie-breaker provisions).

Opis:
The article is a paper presented during the Poland-wide academic conference The U.S. Constitution – theory and practice. The basis for reflections constitutes an issue of the constitutionality of the federal legislation establishing restrictions on the money’s influence on financing election campaigns. The paper focuses on an analysis of the U.S. Supreme Court’s case law related to the range of an acceptable interference of such regulations in the freedom of speech and political expression clause of the First Amendment to the Constitution. The author discusses selected statements contained in the rulings made in cases, from which as the most crucial he regards: Buckley v. Valeo (1976), McConnell v. Federal Election Commission (2003) and Citizens United v. Federal Election Commission (2010). In the conclusion of the article an opinion is presented that the U.S. Supreme Court judicature, co-creating with the federal legislation the campaign finance law, is an unique attempt at balancing the two values fundamental to the democratic election process, which are freedom of speech and the principle of equal opportunities for political competitors.

Women empowerment agenda plays a crucial law in a global legal debate. Despite years of struggle and undeniable success in several fields, women remain vastly underrepresented in the workforce and business leadership. The areas traditionally associated with gender equality are located within the public law regulations, with the core of labor and social security law. At the same time, it seems that some useful tools can be also provided by private law. Therefore, in the thought of a multi-faced, comprehensive approach, it is worth evaluating the actual and potential law of the European company law regulations. The aim of the article is to present the current legal and research state-of-play, mark the research gaps and formulate hypotheses as to the possible developments in this regard.

The social role of a person, to a large extent imposed by the person’s sex, may change. The social role is given by a social construct called gender, while sex is given biologically. Gender theory or gender studies is a branch of science exploring sex and gender. Besides and in contrast to it, there is gender ideology, or better anti-gender ideology, standing in fierce opposition to every mention of gender. Gender theory uses rational arguments, anti-gender ideology usually does not. It may be portrayed by the example of the Istanbul Convention about violence against women and domestic violence. Its topic is not gender, but it uses the word gender from time to time as a useful instrument of gender theory. However, the Convention is presented by its opponents as an instrument for spreading gender ideology. The Catholic Church or their bishops in the Czech Republic are usually of the same opinion, they are also manipulated or are the manipulators themselves. This way their opinion does not correspond to the teaching of the Vatican documents and is misleading for many Czech Catholics. Nevertheless, the influence of the Catholic bishops is diminishing in many aspects, including the question of gender.

Article 23 sentence 1 of the Polish Family and Guardianship Code (the FGC) of 1964 emphasises that spouses have equal rights and obligations in marriage. This regulation is commonly understood as establishing the principle of equality between a wife and a husband in Polish family law. That principle has its foundations in international law, including the Universal Declaration of Human Rights, which provides that men and women are entitled to equal rights as to marriage, during marriage, and at its dissolution. After the enactment of the Polish Constitution of 1997, the principle of equality between a husband and a wife derives directly from Article 32(1) and Article 33(1). It constitutes a basic element of the institutional guarantee of marriage which cannot be altered by ordinary legislation. The aim of this article is to discuss how the principle of equality of spouses ought to be understood and correctly applied under Polish family law. It should also be considered whether Polish law on marriage provides exceptions from the rule of equality between spouses and, if so, whether they are justified. Furthermore, it can be argued that Article 23 sentence 1 of the Family and Guardianship Code stipulates not only the fundamental principle of Polish law, but also grants each of the spouses a subjective right to be treated equally in the relationship by the other person. It should be analysed what exactly this right entails. There is no doubt that one spouse has neither more rights nor responsibilities in the marriage than the other. However, a properly understood right to equal treatment should also mean that one spouse cannot demand the other to perform specific functions and roles.

The article aims to present and analyze political and legal thought of Olympe de Gouges, a French revolutionary activist, who is considered one of the most important precursors of modern feminism. Her writings should be situated in the context of radical egalitarian doctrines, influential during the Enlightenment and the French Revolution. The paper also shows an impact of this pre-feminist thought on the private and public law of the Revolution. Las part is devoted to a comparison of de Gouges’ ideas with some contemporary feminist discourses.
