Opis:
The paper refers to the issue of the limitation period for instituting disciplinary proceedings for student disciplinary tort under the provisions of the Law on Higher Education and Science. The aim is to determine the legal nature of these institutions, assess the basic exponential problems associated with it, and finally consider the possible directions of amendment to the provisions in this regard. The considerations relate to the prescription of a student disciplinary tort, but apply to an identically regulated prescription for disciplinary doctoral torts. The study concludes with an amendment to art. 324 paragraph 4 of the Act.

The study concerns the system of disciplinary penalties in the Act of 6 July 1982 on attorney-at-law (Journal of Laws of 2020, item 75, as amended). The Act provides for the penalties of admonitions, reprimands, fines, suspension or revoking of law practicing or trainee’s rights, as well as the prohibition of patronage. Apart from penalties, additional measures may be imposed which act as penal measures known to criminal law. The normative status of both is not clear in the constitutional sense. Undoubtedly, they are repressive in nature, although due to the imprecise definition of a disciplinary tort, they may raise objections from the point of view of the rules of nullum crimen and nulla poena sine lega. Both the axiological structure of the catalog of punishments and the details of their adjudication and execution raise a number of unresolved doubts in the literature. There is also no clear method of determining the amount of the fine, especially for acts that are extended in time, as well as the method of calculating the length of the prohibitions set out in the Act. The study is an attempt to assess the legal nature of penalties and measures indicated in the Act, as well as to resolve the interpretation doubts indicated above.

The study seeks to define the group of people protected under the provisions on genocide both in the Polish criminal law and international criminal law. The provisions of the Convention of 9 December 1948 on the Prevention and Punishment of the Crime of Genocide, the Rome Statute of the International Criminal Court and the Statutes of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia and the International Criminal Tribunal for Rwanda contain a very similar definition of genocide. Killings and other acts listed in that legislation, committed in order to exterminate all or part of national, ethnic, racial or religious groups as such are prohibited as genocide. Similar conduct was prohibited in the provision of Article 118 of the Polish Penal Code. However, the protected group has been identified differently. It has been defined much more widely in Polish criminal law than in international law. A perpetrator of genocide acts with the purpose to exterminate all or part of a national, ethnic, racial, political or religious group or a group with a specific worldview. There are two important differences: the first is that international law acts prohibit intentional conduct while Article 118 prohibits purposeful conduct. The second difference is a much narrower definition of groups protected by international regulations. They do not protect a political group and a group with a certain worldview. This study analyses the consequences of this distinction, in particular the possibility of classifying the conduct aiming against a political group and a group with a particular worldview.
