The People’s Republic of China, along with the United States, the European Union, and the Russian Federation, is one of the four powers seeking to increase and maintain its influence in the Republic of Serbia. Since the decision was made in 2016 to establish a bilateral strategic partnership, political and economic cooperation between Serbia and China has been steadily strengthening. This article outlines the scope and basis of the political partnership and the most significant joint investments of the two countries, which, as a result, allows for an answer to be provided to the following research question: What are the benefits and risks for the Republic of Serbia from its strategic partnership with the People’s Republic of China? Thanks to the descriptive and exploratory values of this text, it is possible to conclude that strategic cooperation between Serbia and China contributes to the growth of Serbia’s economic potential and is reflected in the dynamics of the Republic of Serbia’s political relations with the European Union.

Opis:
The article examines the evolution of the political position of the head of government institution in the Serbian state. The analysis covers the different models of government that have developed in Serbia over the last 180 years. During the monarchical period, the prime minister’s position was a function of his relationship with the king and the political alignment in parliament. In turn, during the period of popular democracy and socialism, the prime minister’s position depended on the political alignment at the top of the communist elite. It is also an interesting exercise to analyse the evolution of the post-1990 position of the head of government, especially in the context of the new constitutional order and the rather turbulent changes on Serbia’s political scene.

This article shows Serbia’s road to the European Union, mainly Serbian’s problems. First problem was a cooperation with International Criminal Tribunal for the former Yugoslavia with was solved in 2011 and Serbia meantime could ratify the Stabilisation and Association Agreement and put forward an official proposal of membership in the European Union. Second and the biggest problem is now relations with Kosovo. In 2011 mostly under European Union’s infl uence Serbia had started negotiations with Kosovo but meantime did not agree with its indpendence. However the progress in cooperation with Kosovo made possible to start negotiations with the European Union and ratification of Agreement and now open two negotiation’s chapters. Currently government with a strong Serbian society support wants cooperate with the European Union because in this they see correct way of Serbia’s transformation. Serbian prime minister Aleksandar Vučić is planning to fi nish all negotiations by end of 2018 and become a member in 2020.

The Central European Free Trade Agreement (CEFTA) is known to have positively affected the EU accession of several central and eastern European states. The fairly modest progress of EU accessions of Western Balkan states is in stark contrast to the processes of the EU accession of the parties to the original version of CEFTA. This article analyses the role of WTO membership as an external factor determining the efficacy of CEFTA in advancing the process of EU integration in the Western Balkans (2007–2024). The article identifies two key advantages of WTO membership in the context of CEFTA’s role in the process of EU accession. The first advantage is related to the use of WTO dispute settlement to ensure compliance with standards either identical or similar to those established by CEFTA. The second advantage is based on the relatively new WTO Trade Facilitation Agreement (TFA), aimed at eliminating many of the barriers to international trade, which happen to be the key problems as regards regional economic integration in the Western Balkans. The article concludes that WTO membership could play a decisive role for the coordinated and efficient process of the European integration of Western Balkan states on the basis of CEFTA.

Maintaining peace in the Western Balkans and Kosovo has become a high aim for international organisations. Challenges in Kosovo such as the confl ict in the 1990’s and afterwards, as well as the lack of political unity and institutions capable of both civilian and military intervention have led to long-term involvement of the EU. It should be noted that the engagement of the EU was also caused by ethnic nationalism, socio–economic problems and interethnic tensions, mainly between Serbs and Albanians in Kosovo, as well as unresolved issues in bilateral relations. This paper analyses the role of the EU in maintaining peace through its civilian mission and enlargement policy. The ongoing EULEX civilian mission was aimed at establishing a multi-ethnic justice system and police force, as well as introducing and promoting the rule of law, public order and security. The enlargement policy is seen as an important process of interethnic and inter-state reconciliation.

Bilateral relations of small states represent a very limited field in academic debates and research within the science of international relations. In fact, there is a lack of research and relevant debates on what the determinants and factors of bilateral relations are between small states and how much those factors contribute to promoting it on one hand, while, on the other, how much same factors condition that cooperation, and, finally, how much small states independently determine and define their bilateral relations in their foreign policy activities. In this paper, using the example of bilateral relations between Serbia and North Macedonia in the period of the last ten years, the authors will try to answer the following main research question: What is the basis of the bilateral cooperation between Serbia and North Macedonia and what is its perspective? On those grounds, they will also answer the following questions: To what extent is this cooperation conditioned by internal political circumstances in either country; to what extent is this cooperation determined by regional circumstances; how much is it influenced by the so-called “major actors” in international relations; and, finally, to what extent is it actually a consequence of the sovereign decisions of the authorities in Belgrade and Skopje? With this methodological order of research questions, from the general to the individual in the theoretical sense through the prism of realists and structural realists, the authors will establish the perspective of bilateral relations between small states within the framework of the actual circumstances of international relations.

The protection of workers’ rights in bankruptcy proceedings is a matter of supreme importance in every country. Comparing national laws, one could conclude that the predominant solution is to grant workers the position of privileged creditors. In Serbia, workers are protected by means of two laws: the Labour Law, which is the lex generalis for this area, and the Bankruptcy Law, which has the role of lex specialis. In addition to protection during bankruptcy proceedings before commercial courts, workers can appeal to the state’s national guarantee institution, namely, the Solidarity Fund. Serbia is, therefore, among the countries which employ a mixed – protectionist system. By analysing the legal solutions related to these issues, the authors want to determine the correlation between national legal solutions and those at the European Union level, and to consider the problems in bringing these claims in legal practice. They have also reviewed the current legislation in some Western Balkans countries including Croatia as a member of the EU, and Bosnia and Herzegovina, which has candidate status akin to Serbia. The authors conclude that Serbian law has a modern, hybrid approach in securing the rights of workers in bankruptcy proceedings, but that there is room for improving regulations in this area. This could be achieved by, inter alia, increasing the volume of claims guaranteed to workers, restricting the reasons for initiating bankruptcy proceedings, making preliminary payments to workers in the initial stages of the proceedings, and keeping court records on the percentage of workers’ claims being realised in bankruptcy proceedings.
