    Opis:
    The 20th anniversary of the World Conference against Racism, Racial Discrimination, Xenophobia and Related Intolerance, held in Durban in 2001, provides a good opportunity to look at the institutional arrangements undertaken to implement the Durban Declaration and Programme of Action, as well as to study and assess state practice in this regard. This article discusses the activities of expert bodies and the intergovernmental forms of co-operation established after the Durban Conference in order to implement its conclusions and recommendations. The author notes that while the post-Durban developments in the area of counteracting racism are substantial, structural racism, racial injustice, inequality, and discrimination still constitute a disturbing threat to both human dignity and the basic values of the United Nations. It is argued that the 20th anniversary of the Durban Conference should induce states and other relevant stakeholders to reflect on – and reinforce – the UN’s action against racism, racial discrimination, xenophobia, and related intolerance.

    The COVID-19 pandemic has had consequences in several dimensions within contemporary society. One of them is the protection of human rights and the functioning of human rights protection systems. There is a broad understanding that fighting against the COVID-19 pandemic should not interfere with the protection of human rights. In order to mitigate the spread of COVID-19, governments throughout the world introduced emergency measures which constrain individual freedoms as well as social and economic rights, but demonstrate some global solidarity on the other hand. In doing so, civil obligations are rarely addressed, regardless of how significantly they are impacted by the response to the pandemic. The norms and principles of human rights should guide governments’ responses to COVID-19. The author of this article analyses the issue in the context of standards offered by international organisations. He particularly highlights the recommendations offered by the Parliamentary Assembly of the Council of Europe in Resolution 2339 (2020), namely “Upholding human rights in times of crisis and pandemics: Gender, equality and nondiscrimination.”

    Rada Europy, która powstała 5 maja 1949 r., od początku istnienia opierała się na wspólnocie wartości, w szczególności na wspólnocie prawa, starając się harmonizować prawo państw członkowskich wokół wspólnych zasad, którymi są zasada demokracji, praworządności i poszanowania praw człowieka. Zasady te są wzajemnie komplementarne, gdyż żadna z nich nie może być urzeczywistniana bez pozostałych. W artykule wykazane zostało ich znaczenie zarówno w procedurze akcesyjnej, jak i po uzyskaniu członkostwa. Państwo, decydując się na członkostwo w Radzie Europy, bierze na siebie zestaw zobowiązań, które powinno realizować. W trakcie procedury akcesyjnej dokonywano więc oceny spełniania przez kandydata warunków członkostwa. Procedura ta odegrała kluczową rolę w oddziaływaniu Rady Europy na wdrożenie standardów demokratycznych w państwach Europy Środkowo-Wschodniej, gdy te aplikowały o członkostwo w Radzie. Natomiast po uzyskaniu członkostwa kontrola wypełniania przyjętych zobowiązań opiera się na procedurze monitoringowej Zgromadzenia Parlamentarnego oraz Komitetu Rady Ministrów Rady Europy. Państwo, które nie respektuje przyjętych w ramach organizacji standardów, podważa swoją legitymację do uczestniczenia w niej. Aksjologia jest bowiem istotną przesłanką wspólnego działania państw w ramach Rady Europy.
    The Council of Europe, established on 5 May 1949, has been based since its inception on a community of values, in particular a community of law, attempting to harmonize the law of the member states around common principles, which include the principles of democracy, the rule of law and respect for human rights. These principles are complementary to each other, as none of them can be realized without the others. The article shows their importance both in the accession procedure as well as after obtaining by a state membership in the organization. When a state decides to become a member of the Council of Europe, it assumes a set of obligations which it should fulfil. Therefore, during the accession procedure, the candidate’s compliance with the membership conditions is assessed. This procedure played a key role in the influence of the Council of Europe on the implementation of democratic standards in the countries of Central and Eastern Europe, when they applied for membership in the Council. On the other hand, after obtaining membership, the control of compliance with the assumed obligations is based on the monitoring procedure of the Parliamentary Assembly and the Committee of Ministers of the Council of Europe. A state which does not respect the standards adopted within the organization challenges its own right to participate in it, as axiology constitutes an important premise of joint action of states within the Council of Europe.
