    Opis:
    The subject of the study is the issue of freedom of construction, shown against the background of obligations relating to the maintenance of buildings. The source of building freedom is the constitutional principle of property protection, which provides the owner with protection against unlawful infringement of his rights and excessive power of public administration bodies. However, the exercise of building freedom does not mean complete freedom in the use of the building structure, because it has its limits outlined in the implementation of the values indicated in the Constitution of the Republic of Poland. The study analyses the compliance of obligations concerning the maintenance of building structures with the Constitution of the Republic of Poland.

    Opis:
    The issue of restrictions imposed on ownership of a monument is an excellent example illustrating the tension between the unrestricted use of a property and the public interest manifested by the necessity to protect historical monuments. Monuments represent one of the most fundamental elements of the State’s cultural heritage. The protection of this heritage is an element of raison d’état, including the need to foster the memory of the cultural identity of the nation. The aim of the article is to pinpoint the basic problems connected with the balancing of the conflicting values concerning the protection of ownership rights and those regarding the assurance of continuity of the cultural heritage of the State and whole huanity. The Author addresses the issue of monument ownership restrictions from the perspective of the basic standards of ownership protection enshrined in the Polish Constitution and the European Convention on Human Rights. The considerations make reference to the notion of a restricted right of ownership (with particular regard to the principle of proportionality) and the problem of compensation for having one’s monument ownership restricted.

    Przedmiotem opracowania jest zagadnienie wolności budowlanej, ukazanej na tle obowiązków odnoszących się do utrzymania obiektów budowlanych. Źródłem wolności budowlanej jest konstytucyjna zasada ochrony własności, zapewniająca właścicielowi ochronę przed bezprawnym naruszeniem jego prawa i nadmiernym władztwem organów administracji publicznej. Jednakże korzystanie z wolności budowlanej nie oznacza zupełnej swobody w użytkowaniu obiektu budowlanego, bowiem ma ona swoje granice zakreślone w realizacji wartości wskazanych w Konstytucji RP. W opracowaniu została dokonana analiza zgodności obowiązków dotyczących utrzymania obiektów budowlanych z Konstytucją RP.
    The subject of the study is the issue of freedom construction, shown against the background of obligations related to the maintenance of buildings. The source of freedom construction is the constitutional principle of ownership, which provides the owner with protection against the unlawful violation of his right and the excessive authority of the public administration. However, the use of the freedom of construction does not mean complete freedom in the use of the building, because it has its boundaries in the realization of the values indicated in the Constitution of the Republic of Poland. An analysis of the conformity of obligations concerning the maintenance of buildings objects with the Constitution of the Republic of Poland was carried out.

    Problem prawnych form ograniczeń prawa własności zabytków jest znakomitym przykładem obrazującym stan napięcia między wolnością korzystania z własności a interesem publicznym wyrażającym się w konieczności ochrony zabytków. Zabytki stanowią jeden z kluczowych elementów dziedzictwa kulturowego państwa. Ochrona tego dziedzictwa jest elementem racji stanu państwa, obejmującej konieczność dbałości o pamięć na temat kulturowej tożsamości narodu. Celem artykułu jest wypunktowanie podstawowych problemów związanych z wyważeniem kolidujących wartości ochrony własności prywatnej oraz zabezpieczenia trwałości dziedzictwa kulturowego państwa i całej ludzkości. Zagadnienie ograniczeń prawa własności zabytków analizuję z perspektywy podstawowych standardów ochrony własności zawartych w Konstytucji RP i EKPC. Rozważania obejmują pojęcie ograniczeń własności, kryteria dopuszczalności ograniczeń (ze szczególnym uwzględnieniem zasady proporcjonalności) oraz problem odszkodowania z tytułu ograniczeń w korzystaniu z własności zabytku.
    The problem of restrictions of the right of property of historical monuments is an excellent example illustrating the tension between freedom of use of property and the public interest expressed by the need to monument’s protect. The historical monuments are one of the key elements of the cultural heritage of the state. The protection of the cultural heritage is a part of the raison d’état, including the need to care for the memory on the cultural identity of the nation. This article aims to discuss the fundamental problems associated with balancing the conflicting values: the protection of right of property and securing the sustainability of the cultural heritage of the state and of humanity. The issue of limiting the right of property of historical monuments are analyzed from the perspective of basic standards for the protection of property contained in the polish Constitution and in the European Convention on Human Rights. Considerations include the concept of property right restrictions, admissibility criteria of restrictions (with particular regard to the principle of proportionality), problem of the compensation for limiting the right of property of historical monuments.
