- The paper characterises some selected principles of the law concerning local government. The legal foundations have been discussed and the significance of the principle of subsidiarity, de-centralisation and independence with regard to the functioning of local government in the Polish legal system. According to the principle of subsidiarity, the public authorities are obliged to co-operate with the citizens and their organisations in performing public tasks. De-centralisation presumes that a definite scope of power be passed on to the units of local government. The condition of de-centralisation is independence of de-centralised units. Once citizens are granted independence in performing public tasks, that is they have the right to decide on how they are supposed to be carried out and their related responsibility, we have a “complete” de-centralisation. In the Polish legal order there are regulations that ensure the principle of subsidiarity, de-centralisation, and independence of local government. Their implementation depends on the will and engagement of the public authorities, with regard to both local organs and the legislative body.
