Opis:
The article analyses those acts of the EU acquis that determine the legal status of a migrating EU citizen’s family members. It is noteworthy that the definition of a family member includes not only spouses and dependent children but also partners in a registered relationship (provided that the domestic law of a given EU country provides for such relationships) and parents. Furthermore, owing to the principle of family reunion, entry is made easier for those persons who are not covered by the legal definition of a family member but are otherwise connected with the migrating person. In its judicature, the Court of Justice of the European Communities permits a broad interpretation of the scope of subjects who are entitled to enjoy the status of a family member. An analysis of the judicature to date and provisions of the EU secondary legislation indicates that the possibility to enjoy the right to residence as a family member depends on the EU migrating citizen’s acquisition of the necessary status as an entitled subject. The scope of entitlement of family members does not depend on the social background but is conditional upon the kind of status of the EU citizen. Occasionally the acquis distinguishes between the rights of working persons and those seeking employment and, on the other hand, the rights deriving from the right to residence. Moreover, premises upon which the right to residence and movement can be granted vary according to a person’s background. All regulations pertaining to the freedom of personal movement should be interpreted in the spirit of family reunification, which results in a ban on automatic expulsion if no formal conditions are met. The right to rejoin one’s family as well as freedom of movement itself are not absolute rights and are subject to restrictions, which are justified if the receiving state deems it necessary to protect its public order, safety or health. Another restriction holds if a person is employed in a public administration agency.

The right to education belongs to the fundamental rights of an individual in the contemporary society. Maintaining and development of the society's potential depends on realization of this right. Hence, the right to education should be perceived not only as an individual value, but also as an important good of the whole society. The universal dimension of the right to education is stressed by international documents on human rights, in this way effecting standardization of defining the rights of an individual also on the national level. The Constitution of the Republic of Poland of 1997 in Art. 70 recognizes the right of every citizen to education, at the same time  pointing to the public authorities' duty to secure general and equal access to education for all the citizens. One of the ways of implementing the rules of general and equal access to education is the constitutional rule of educational performances being free. Hence, the rule of free education plays the role of a subsidiary means to achieve the aim, which is a general and equal access to education. As an exception, the constitution allows the possibility of introducing paid education in higher education institutions. However, this only concerns public institutions and it cannot include all educational performances. Introducing a fee is possible by way of an act, and its amount is limited by the legal order. In the interpretation decision of the Constitutional Tribunal it was said that it is permissible to introduce fees in public higher education institutions in the range and amount that is indispensable because of the costs of education.

The paper brings home to us the problems connected with the broadly understood social human rights, as they are regulated in the European Chart of Basic Rights. Economic rights, strictly speaking, social and cultural rights have been placed in the Chart aside to civil and political rights, making a comprehensive catalogue of human rights. Irrespective of their kind they have the same character, as it results from the political significance of the Chart. They exert an impact only at the level of the interpretation of the norms of the communal right in the domain of human rights. According to the Chart, social human rights draw on the solutions accepted in the most important European documents of this kind. Therefore the right to the protection of the natural environment and the protection of consumers is stressed with stronger emphasis.

The following article examines the constitutional principle of universal and equal access to education enabling each person to exercise their right to education. The other provisions concerning the right to education contained in Article 70 of the Constitution are to be interpreted in the light of this principle. This applies to the right to choose and establish schools, right to receive financial help, the autonomy of higher education institutions, as well as the principle of gratuitousness of education and permissibility of making certain educational services payable. The above rights constitute instruments whereby the Constitution guarantees universal and equal access to education.

The article deals with Professor Mazurek’s interpretation of social human rights. The article presents the views of Alfred Verdros and Jacques Maritain whose philosophy influenced Professor’s scientific views. Central in his considerations is the dignity of human being, innate and indivisible. It is a universal value hence the laws derived therefrom are also universal and inalienable, creating an integral whole. They are also mutually dependent. The exercise of social rights conditions the use of liberty rights and vice versa. The purpose of proclamation and protection of human rights are not the rights themselves but the protection of human being on account of their dignity, and a guarantee of his/her integral development.

The article aims at presenting the evolution of people’s guarantee of their social rights enshrined in Polish constitutions, beginning with the March Constitution of 1921. That constitution addressed the issue of social rights but to a limited degree. It pointed to the freedom of work, freedom of assembly and the right to social security. Such perspective did not differ much from the accepted standards of constitutional regulation of the time. Subsequently, the constitution of 1935 disregarded human rights, emphasising only civil obligations. The constitution of 1952, however, did feature a long catalogue of personal social rights. It is of note that the subject now was not a “human” but “citizen”, therefore the rights contained therein were deprived of their universal nature. The superiority of social rights over the political ones was now stressed. The interpretation and implementation of human rights were influenced by values that were thought to form the basis of legal order, such as social ownership. The interpretation of social rights changed along with the political and socioeconomic transformation in the constitution of 1992. Yet, the most radical alterations are contained in the Constitution enacted in 1997. These changes were significant not because the array of rights was now markedly greater, but because the axiological dimension which affected the interpretation of the rights was altered. The following values and principles were assumed to be fundamental: the principle of a democratic state of law, the principle of social market economy, the freedom of economic enterprise and private ownership. All recognised freedoms and rights of persons now followed from the inherent dignity of human beings. Human dignity, at the same time, forms the source and limits of rights and freedoms.

The aim of this article is to present some characteristic ways of understanding social human rights in chosen constitutions of European countries. An overview of constitutions drafted in the past decade reveals a tendency towards a “realistic” interpretation of social rights in these documents, i.e. as public tasks whose undertaking is a constitutional duty of the authorities. These regulations may not directly substantiate a claim addressed to the State. An analysis of catalogues of social rights in constitutions of post-socialist states points to two lines of development. On the one hand, new laws concerning mainly forming unions were added (including a right to strike), but on the other hand, the purpose of including social rights in a catalogue of constitutional rights was negated.

According to international obligations the Republic of Poland provides its citizens with the right to have their health protected as stipulated in Article 68 of the Constitution. The way this regulation is constructed points to its general constitutional character as it spells out goals of the State with no indication as to the means of their realisation. The normative nature of Art. 68 is visible in its imperative for public authorities to obey and enforce the right of health protection. Public authority agencies are obliged provide each citizen with equal access to health care services which are subsidised by means of public budget, with special regard to children, pregnant women, the elderly, and the disabled. Every human has a right to have their right protected, yet access to services financed with public money is provided only to the citizens.
