    W artykule dokonano przeglądu wybranej terminologii prawa średniowiecznej Walii wraz z przekładem na język polski. Analizowane słownictwo podzielono na takie kategorie, jak urzędy dworskie, prawo rodzinne i małżeńskie, rzeczowe, zobowiązań, karne i postępowanie sądowe. Opracowanie stanowi przyczynek do walijsko-polskiego słownika średniowiecznej terminologii prawnej. Materiał badawczy zebrano na podstawie źródeł prawa, komentarzy i literatury przedmiotowej, zarówno polskiej, jak i obcej.
    This article presents an overview of selected legal terminology of Welsh medieval law. Welsh legal terms are appended with their Polish equivalents. The legal vocabulary pertains to the following categories: posts and professions, family and marital law, property law, the law of obligations, criminal law, and judicial proceedings. The paper aims at providing a Welsh-Polish glossary of legal terms. The material subjected to the analysis has been extracted from legal sources, commentaries and other literature.

    Granice (nie)przetłumaczalności krajowej terminologii prawniczej w kontekście europejskich tendencji harmonizacji Pełna ekwiwalencja konceptów prawnych pochodzących z różnych systemów prawnych w przypadku tłumaczeń prawniczych jest trudna do osiągniecia. Terminologia prawnicza jednego systemu prawnego nie daje się łatwo przenieść do innego systemu prawnego; jest to proces, który pod względem złożoności można porównać z tłumaczeniem pojęć kulturowych. Interpretacja, ekwiwalencja częściowa, ekwiwalencja opisowa, ekwiwalencja funkcjonalna to strategie często stosowane przez tłumaczy tekstów prawnych i prawniczych w celu poradzenia sobie z wyzwaniami związanymi z tłumaczeniem terminologii prawniczej. W niniejszym artykule omówiono granice (nie)przetłumaczalności pojęć prawnych z perspektywy rosnącej internacjonalizacji prawa Unii Europejskiej. Przedstawione zostały przykłady ilustrujące zjawisko wprowadzania zharmonizowanych, ponadnarodowych pojęć prawnych do ustawodawstwa krajowego. Następnie omówiono problem tłumaczenia za pośrednictwem trzeciego języka. W podsumowaniu znalazły się natomiast niektóre tendencje i trendy w tłumaczeniu prawniczym będące wynikiem trwającego procesu. Grenzen van de (on)vertaalbaarheid van de nationale rechtsterminologie in context van de Europese harmonisatietendensen Volledige equivalentie van juridische concepten uit verschillende rechtsstelsels is in de juridische vertaling moeilijk te bereiken. Juridische concepten in één rechtsstelsel zijn niet makkelijk over te dragen in een ander rechtsstelsel, een proces dat vergelijkbaar is met de complexiteit van het vertalen van cultuurgebonden concepten in het algemeen. Interpretatie, gedeeltelijke equivalentie, gebruik van omschrijvingsequivalenten, functionele equivalentie zijn strategieën die door juridische vertalers frequent worden toegepast om de uitdagingen bij het vertalen van juridische concepten te overwinnen. In dit artikel zullen we de grenzen van de (on)vertaalbaarheid van juridische concepten bespreken vanuit het perspectief van de groeiende internationalisering van het recht binnen de EU. Aan de hand van voorbeelden illustreren we de invoering van geharmoniseerde supranationale juridische concepten in nationale wetgeving. Vervolgens behandelen we het probleem van vertalen via een derde taal. Ten slotte zullen we enkele tendensen in het juridisch vertalen samenvatten als een resultaat van deze processen.
    Full equivalence between legal concepts from different legal systems is difficult to achieve in legal translation. Legal concepts in one legal system are not easy to transfer to another legal system, a process which is similar to the complexity of translating culture-bound concepts in general. Interpretation, partial equivalence, description equivalence, functional equivalent are frequent strategies applied by legal translators in order to overcome the challenges in translating legal concepts. In this article, we will discuss the boundaries of the (un)translatability of legal concepts from the perspective of the growing internationalization of law within the EU. On the basis of examples, we will illustrate the adoption of harmonized supranational legal concepts into national legislation. Next, we will deal with the problem of translating via a third language. Finally, we will summarize some tendencies in legal translation as a result of the process.

    De bijdrage presenteert het onderzoek binnen het project TransIus — From conventions to norms in the legal discourse, een samenwerking tussen Matej Bel University in Banská Bystrica en Comenius University in Bratislava. Het onderzoek beoogt een permanente verbetering van de kwaliteit van vertalingen van juridische teksten, gecombineerd met een eliminatie van terminologische onenigheid in de juridische taal. Vooral in combinatie met kleinere talen (in het kader van dit project Nederlands en Slowaaks) worden tolken geconfronteerd met onduidelijke situaties, veroorzaakt door culturele verschillen, een klein aantal sprekers en afwijkingen tussen beide rechtsstelsels. De terminologische onderzoeksmogelijkheden zijn in deze situatie zeer beperkt. Zo heeft het TransIus-project ook een interdisciplinair karakter, samenwerking met deskundigen. Advocaten zijn een van de belangrijkste pijlers van het projectteamwerk. Het artikel legt de hoofdkenmerken en specificaties van de juridische vertaling tussen deze talen uiteen. Het maakt een keuze uit bestaande evaluatiemodellen van verschillende auteurs als het meest toepasbaar voor de onderzochte situatie van juridische vertaling tussen talen van minder diffusie. Dit model wordt aangetoond door middel van een voorbeeld waarin een problematische vertaling van regeringsterminologie en mogelijke problemen voor verder onderzoek worden beschreven.
    The paper presents the research within the project TransIus — From conventions to norms in the legal discourse, a cooperation between Matej Bel University in Banská Bystrica and Comenius University in Bratislava. The research aims a permanent improving of quality of legal text translations, combined with elimination of terminological disunity of legal language. Especially in combinations with smaller languages (in the case of this project Dutch & Slovak), the interpreters face unclear situations, caused by cultural differences, a low amount of speakers and discrepancies between both legal systems. Terminological research possibilities in such situation are very restricted. Thus, the TransIus project has also an interdisciplinary character, co-operation with experts-lawyers is one of the elementary pillars of the project team work. The article explains the main features and specifics of legal translation between these languages. It makes a choice from existing evaluation models of various authors as the most applicable for the researched situation of legal translation between languages of lesser diffusion. This model is demonstrated by means of an example of problematic translation of governmental terminology and possible problems of the further research are described.
    Niniejszy artykuł prezentuje badania w ramach projektu TransIus — From conventions to norms in the legal discourse, prowadzonego we współpracy przez Uniwersytet Mateja Bela w Bańskiej Bystrzycy i Uniwersytet Komeńskiego w Bratysławie. Celem badań jest stała poprawa jakości tłumaczeń tekstów prawnych w połączeniu z eliminacją terminologicznej rozbieżności w języku prawnym. Zwłaszcza w odniesieniu do kombinacji językowych angażujących języki rzadziej używane (w przypadku niniejszego projektu to niderlandzki i słowacki) tłumacze stają w obliczu niejasnych sytuacji spowodowanych różnicami kulturowymi, małą liczbą użytkowników danego języka oraz rozbieżnościami w systemach prawnych. W takiej sytuacji możliwości badawcze w zakresie terminologii są bardzo ograniczone. Projekt TransIus ma zatem charakter interdyscyplinarny. Współpraca z ekspertami-prawnikami stanowi jeden z podstawowych filarów pracy zespołu badawczego. Artykuł opisuje główne cechy i specyfikę przekładu prawnego z jednego badanego języka na drugi. Z dotychczas istniejących modeli ewaluacji różnych autorów wybiera te najbardziej odpowiednie w badanej sytuacji tłumaczenia prawnego z języka rzadziej używanego na rzadziej używany. Model ten zaprezentowany jest za pomocą tłumaczenia terminologii oficjalnej, niepozbawionego problemów; opisane są także możliwe problemy związane z dalszym badaniem.

Le standard juridique de bon père de famille et la symétrie entre les expressions bon père de famille et bonne mère de famille en droit français Le but du présent article est d’explorer la relation entre les expressions bon père de famille et bonne mère de famille. L’expression bon père de famille renvoie au standard juridique de la personne raisonnable, récemment remplacée par les termes raisonnablement, raisonnable et personne raisonnable. Cet article envisage le contexte historique du standard de bon père de famille en droit français et présente l’analyse des occurrences des expressions bon père de famille et bonne mère de famille dans le corpus des textes juridiques.
    The aim of this paper is to explore the relationship between the expressions bon père de famille and bonne mère de famille. The expression bon père de famille refers to the reasonable person standard of the French law and has been recently replaced by the terms raisonnablement, raisonnable and personne raisonable. This paper discusses the historical background of the bon père de famille standard in the French law and presents the analysis of occurrences of both expressions in the corpus of legal texts.
