Opis:
Usable floor area is one of the most important spatial attributes of buildings and premises. It is used, for example, to determine the basis for their taxation. Unfortunately, the question of proper determination of usable floor area in Poland has remained problematic for many years, which is closely related to the occurrence of various definitions of usable floor area in the currently binding legal acts. Consequently, usable floor area is not a universal attribute. This means that in certain cases significant discrepancies may occur between the usable floor area of the same structure, determined for different purposes. In addition, despite attempts made to unify the principles for the performance of surveys of building structures and their parts, this requirement still can not be recognized as fully met. Therefore, there is no doubt that the problem of reliability and availability of data defining the usable floor area of buildings is becoming even more important in view of the introduction of the ‘ad valorem’ tax, which has been planned for years. For this reason, this paper proposes a universal, multi-variant method of estimating usable floor area based on geometric and descriptive data of buildings contained in the cadastre. The Authors, taking into account the applicable legal regulations, have considered the possibilities of practical implementation of individual variants of this specific method. They have carried out empirical tests of effectiveness of the proposed approach. They have also defined tasks for which this method of determining the usable floor area of buildings would be particularly useful.

Opis:
According to the original wording of the Regulation on the register of land and buildings of 2001, in the real estate cadastre there was one attribute associated with the use of a building structure – its intended use, which was applicable until the amendment to the Regulation was introduced in 2013. Then, additional attributes were added, i.e. the type of the building according to the Classification of Fixed Assets (KST), the class of the building according to the Polish Classification of Types of Constructions (PKOB) and, at the same time, the main functional use and other functions of the building remained in the Regulation as well. The record data on buildings are captured for the real estate cadastre from other data sets, for example those maintained by architectural and construction authorities. At the same time, the data contained in the cadastre, after they have been entered or changed in the database, are transferred to other registers, such as tax records, or land and mortgage court registers. This study is the result of the analysis of the laws applicable to the specific units and registers. A list of discrepancies in the attributes occurring in the different registers was prepared. The practical part of the study paid particular attention to the legal bases and procedures for entering the function of a building in the real estate cadastre, which is extremely significant, as it is the attribute determining the property tax basis.

The aim of this paper is to present the need for changes of geodetic-legal procedures for the cadastre and real estate management. This problem was analyzed both in theoretical and practical terms. In order to better present the analyzed technical and legal procedures, a study of several cases of surveying documentation was made. On their example the problems associated with the surveying services were shows and the formal and legal procedures, on the basis of which described surveying works were done were verified. The problem presented is current and valid not only for the comfort of the surveyor's work, but also from the point of view of the structure and modernization of the real estate cadastre, constituting the backbone of the real estate management. The article emphasized the need to unify the databases of state registers and the digitization of the National Geodetic and Cartographic Resources (PZDGiK). Research has shown that despite the continuous changes of legislation, there are still many shortcomings and gaps, which often complicate the surveying works. The surveyor must analyze and verify all materials he uses, including those obtained from the Centre of Geodetic and Cartographic Documentation (ODGiK). The quality of the geodetic and cartographic elaboration depends largely on the work of the Centre of Geodetic and Cartographic Documentation. The need of modernization of the Land and Buildings Registry, which acts as a cadastre in Poland, has been demonstrated. Furthermore, the unification of data used as reference systems both for plane coordinates and elevation has been proposed.
