Opis:
The interests of children are of paramount importance, therefore it is sometimes necessary for the authorities to interfere in matters relating to their custody, when a child is likely to have been wrongfully removed or retained in breach of the rights of custody attributed to a person, an institution or any other body (child abduction). Therefore a number of international and European Union legal acts impose on national legislators the obligation to introduce mechanisms involving central authorities into cooperation with each other and promoting cooperation amongst the competent authorities in their respective states to make proper discoveries to secure the prompt return of children. For this purpose, the Law of 26 January 2018 on the exercise of certain acts of the central authority in family matters relating to legal transactions under European Union law and international agreements was adopted. Pursuant to its provisions, Police offi cers shall, by virtue of their specifi c powers, assist the central authority and the courts on matters relating to the abduction of minors abroad. Their role is mainly linked to providing the authorities with relevant information, assisting the probation offi cer, and searching the place where the minor is presumed to be living.

Liaison officers play an important role in the international cooperation of police services. This applies not only to the mutual delegation of offi cers between states but also to international organisations. Consequently, a network of liaison officers delegated to Europol’s headquarters in The Hague is developed. Opis:
The fi ght against cybercrime requires effective and rapid solutions for the collection of digital evidence at the international level. An example of such an instrument is the European Investigation Order, which introduces a comprehensive system for obtaining evidence in cross-border cases. The legislation on this solution is contained in directive 2014/41/EU of the European Parliament and of the Council of 3 April 2014 on the European Investigation Order in criminal matters. The above regulations have been implemented into the Polish national law by the Act of 10 January 2018 amending the Act — The Code of Criminal Procedure and certain other acts. The European Investigation Order was presumably fi rst used by Polish law enforcement authorities in a case involving cybercrimes committed by a person using the aliases Thomas and Armaged0n. The use of this investigation measure made it possible to apprehend the offender many years after the fi rst offence was committed and the offender was identifi ed49. Despite this success, further changes to the European Investigation Order in national legislation are needed to improve the effectiveness of the fi ght against cybercrime. It should be proposed to modify the Prosecution Services’ Rules of Procedure as regards the authorities competent to issue European Investigation Orders. Currently, the authorities executing the European Investigation Order in Poland at the stage of preparatory proceedings are district prosecutor’s offi ces, whereas such powers should be vested in every prosecutor conducting preparatory proceedings.

Leaving the UE by the UK has brought a number of consequences for bilateral Polish-British police and justice cooperation. The subject of the article was to present legal regulations, which provide the basis for international cooperation for British law enforcement agencies. The author analyzed and then evaluated the effectiveness of instruments of mutual cooperation. The articles focuses also on the assessment of Brexit consequences and its possible impact on the Polish-British police cooperation. It is worth emphasising that cross-border law enforcement cooperation - which includes police, customs, secret services and other law enforcement agencies, mainly concerns the most serious threats such as terrorism, organised crime, human traffi cking, money laundering, drug traffi cking or cybercrime. The article shows that the most unfavourable changes result from dropping the Schengen acquis by the United Kingdom - is disconnection from the second generation Schengen Information System. The article includes also information about The Agreement on Trade and Economic Cooperation between the European Union and the European Atomic Energy Community and the United Kingdom of Great Britain and Northern Ireland, which has retained a number of important mechanisms for effective police cooperation between EU Member States and the United Kingdom. But although, as mentioned in the article, the Trade and Cooperation Agreement between the European Union and the United Kingdom provides upgrades of the tools of police and judicial cooperation, it is a matter of practise to verify these as sufficient.

The main part of the article is the study on the legal character of the South Irish Police cross-border cooperation. The analysis includes the verifi cation of the normative basics that facilitate security assurance in the cross-border region. The aim of this article is also to present the evolution of the practical aspect of police cooperation between Garda Síochána na hÉireann and the Northern Ireland Police Service. First, it shows the legal bases for such cooperation and then the existing experience of the police and criminal justice system. The author also points out procedural consequences of working together to prevent and combat crime.
