The terms mineral deposit, mineral commodity, mineral raw material are the basic as in economic geology as in geological and mining law. They are not however univocally defined and often influenced by actual legislative exigencies. The uniform terminology was proposed. Mineral commodity - any rock or rock constituent derived from it during mining, or confined to it liquid or gas, which exploited in natural state or after processing became mineral raw material. Mineral raw materials - products of mineral deposit exploitation; mineral substances detached from its natural place of occurrence, and prepared for utilization. Mineral deposit - natural accumulation of mineral substances – mineral commodity - which exploitation is possible and may be economically justified. Accompanying mineral commodity - natural accumulation of low value mineral commodity within or close to the deposit of other one (considered main or principal), which exploitation is possible and may be economically justified if principal commodity is mined. Anthropogenic deposit - man made accumulation of mineral substances which directly or after processing may be utilized as mineral raw material.

Opis:
Concession for mineral prospecting and mining, issued by governmental authorities according to the geological and mining law, is the obligatory exigency in Poland. The basic aim is the reasonable utilization of mineral resources as a non-renewable part of the environment, necessary for everyday life and sustainable development of society. The existing mode of concession procedure is imperfect. The most important changes should include 1) obligatory presentation ofprospecting projects, 2) determination of the time of mining concession validity, allowing development of the total evaluated deposit reserves, and 3) insurance against concession abandonment before exhausting of the total deposit reserves designed for mining.

Opis:
Current administrative and legal rules for obtaining permission for execution of a groundwater intake vary vastly depending on the intended purpose and depth of such an intake. In extreme cases, it might be necessary to prepare a number of reports and assessments, largely overlapping in content, and obtain several administrative decisions. In parallel, Polish geological and mining law allows for execution of a well up to a depth of 30 m and well yield <5m3/d without any permits or formal reports. As a result, investors abuse conditions of "normal use of waters”, and the geological and mining administration lacks any instruments of control in this area. On the backdrop of a presentation of legal requirements related to execution of groundwater intakes in Poland, the author discusses selected legal provisions in force, cross-examining their relevance. The suggestions for changes in procedures and regulations discussed presented in the paper should be considered as a starter for a discussion between hydrogeology experts, geological administration and lawyers.

Opis:
Changesin the demographic structure of the society and the development of civilisation diseases result in an increased interest in health-resort and spa and wellness services in Poland. Balneological raw materials will fill an important role in maintaining and improving the quality of life. The increase in demand for health-resort and disturbing reports on the possible collapse of the current pension system will probably force necessity of extending the retirement age. Undoubtedly, balneological raw materials will be crucial for efficient functioning of the society by providing broader health care prolonging physical fitness of the population. The awareness of occurring and coming changes makes the authors discuss the significance of the role of mineral resources in terms of not only innovation, defence and safety but also socio-cultural and civilisation.

In2013–2015, the PGI-NRI participated in the implementation of one of the leading projects of EU raw materials in recent years, Minerals4EU – European Information Network on mineral raw materials. Its goal was to create the first European-scale complex and a public information network of mineral raw materials that would work in a continuous system after the completion of the project. The scope of information gathered in the network and updated on a regular basis includes data on: production, trade, demand and market conditions in the field of primary and secondary minerals. The project partners were the teams representing geological surveys of 27 European countries and several specialized research institutes. PGI-NRI actively participated in two of the six workpackages of task forces, also helping the other ones. Apart from presenting the project tasks and the effects of its implementation the publication presents in a synthetic way the results of research on the condition of availability of mineral deposits in the European Union countries, carried out by the author in the preparation of foresight on raw materials for Europe. During the study, the main causes of restrictions in accessibility of mineral deposits were identified and their trends were rated and described, pointing out to the necessary actions and measures, using the examples of good practice in this area. The regulation of the ownership of mineral deposits by the legislator in Art. 10 of the Geological and Mining Law Act does not clearly indicate when a mineral deposit may be taken over the ownership of the land. The answer is to be found in Art. 143 of the Civil Code and the general clause contained in it, the criterion of socio-economic purpose of the land property. It determines the boundaries of the land property and the scope of permitted interference by the owner into the land. At the same time, this clause is ambiguous and not defined by law. This solution, although it raises some controversy, leaves some flexibility in its application in practice, although it means that the burden of interpreting the above-mentioned general clause has been shifted to the legal doctrine and case law of the courts. On the other hand, its definition allows for the identification of a mineral deposit that may be owned by the owner of the latter. The analysis of the available literature and jurisprudence allows for the emergence of certain trendsin this matter. The theses remain valid: the recognition of opencast mining as constituent parts of real estate and the opposite thesis that this interpretation cannot be applied automatically and indiscriminately. Above all, the thesis of the Supreme Court stands out against the background of the others, which indicates the designations of the criterion of the socio-economic use of land. It gives a full answer, indicating that the delimitation of the real estate boundaries taking into account the above-mentioned criterion should be made each time for a specific real estate, taking into account its location, destination in the localplan orthestudy and the way in which the owner intends to use it in accordance with the law (judgment V CSK 200/14).

The development of geothermal plants in Poland is accelerating and it is high on the priority list of the Ministry of the Environment. Thermal water is one of the cleanest renewable energy sources but its economic exploitation requires support at the administrative level and a favorable regulatory environment. Therefore, the Ministry of the Environment is implementing its policy of development of geothermy in Poland through a legislative initiative and information activities and support. That legislative initiative has taken the form of a government proposal of a new Geological and Mining Law. The new law, which was already submitted to the parliament, markedly simplifies procedures necessary for prospecting, exploration and exploitation of the thermal water. In addition, there was prepared an information packet for enterpreneuers planning investments in geothermy. The packet (www.mos.gov.pl/geotermia) contains guidelines for proper preparation of an application for concession and lists documents and permits required in the process of awarding concession, in accordance with regulations introduced by the Geological and Mining Law and the Energy Law, and information regarding the state aid and support of EU funds which entrepreneurs may obtain for financing the prospecting and exploration of the thermal waters deposits and construction of geothermal plants. Bearing in mind the need of further development of the geothermal plants and the new geological research and implementation of the new technologies, the Ministry of the Environment has awarded contracts for new research projects which are financed by the National Fund for Environmental Protection and Water Management (NFOOEiGW).

Opis:
For its development, Polish economy needs a number of mineral raw materials that are not present in the country. An important way to increase the country's raw material security is to search for the necessary raw materials abroad. Among such countries is the Republic of the Congo. Advantageous geographic location with access to the Atlantic Ocean, the presence of geological structures rich in various mineral resources, such as tin, tungsten, coltan (Ta-Nb ore), polymetals (Cu-Pb-Zn), iron (BIF deposits), potassium salts and phosphate rock, as well as favourable legal regulations promoting foreign investments, make the Republic of the Congo a country with which Poland should cooperate in the field of raw materials and mining industries. A relatively small part of the Republic of the Congo is well explored, but the potential of undiscovered mineral resources is very large. Poland, having a well-educated cadre of geologists, can and should share its experiences with specialists working in the geological survey of the Republic of the Congo. Such cooperation can bring many benefits to both cooperating countries.

The aim of the article is to discuss the amendment to the Act of 9 June 2011 – Geological and Mining Law (Journal of Laws from 2017, item 2126 with further amendments), as a consequence of the entry into force of the Act of 6 March 2018–Law of Entrepreneurs (Journal of Laws from 2018,item 646), as well as the assessment of relevance of the changes devised. The author analyzes in detail a legal nature of the concession and then the changes introduced to the Geological and Mining Law in Chapter I of Section III, concerning concession rules. Paying particular attention to the context, causes and effects of the changes, the author indicates that the amendment was in fact only a technical activity, however, not devoid of the practical significance. This article attempts to answer the question whether the legislative practice of transferring general provisions to the sectorial act, which is undoubtedly the Geological and Mining Law, will contribute to a better understanding of the regulations among their potential recipients.

Opis:
The Polish Geological and Mining Law (The Act) determines two types of mineral deposit ownership: State Treasury Ownership (STO) and Land Ownership (LO). The Act introduces the term - mining usufruct (term adequate to mining lease) that concerns extracting of STO or geological activity in rock mass belonging to the State. The Minister of Environment, on behalf of the State and with the exclusion of other persons, can benefit from the subject of mining properties or dispose of its right to STO exclusively by establishing mining usufruct. The establishment of mining usufruct shall take place in the form of a written agreement between the State and entrepreneur and requires paying predetermined remuneration to the State. The authors conclude that the Act contains imprecise regulations concerning the lower limit of land property. This causes numerous difficulties in recognizing which parts of land property belong to the State Treasury and which belong to the land owner. The authors suggest that it is necessary to differentiate in the Act two kinds of activities and consequently two types of agreement between the State and entrepreneur: 1) agreement of mining usufruct, and 2) agreement of geological usufruct.
