Opis:
The development of geothermal plants in Poland is accelerating and it is high on the priority list of the Ministry of the Environment. Thermal water is one of the cleanest renewable energy sources but its economic exploitation requires support at the administrative level and a favorable regulatory environment. Therefore, the Ministry of the Environment is implementing its policy of development of geothermy in Poland through a legislative initiative and information activities and support. That legislative initiative has taken the form of a government proposal of a new Geological and Mining Law. The new law, which was already submitted to the parliament, markedly simplifies procedures necessary for prospecting, exploration and exploitation of the thermal water. In addition, there was prepared an information packet for enterpreneuers planning investments in geothermy. The packet (www.mos.gov.pl/geotermia) contains guidelines for proper preparation of an application for concession and lists documents and permits required in the process of awarding concession, in accordance with regulations introduced by the Geological and Mining Law and the Energy Law, and information regarding the state aid and support of EU funds which entrepreneurs may obtain for financing the prospecting and exploration of the thermal waters deposits and construction of geothermal plants. Bearing in mind the need of further development of the geothermal plants and the new geological research and implementation of the new technologies, the Ministry of the Environment has awarded contracts for new research projects which are financed by the National Fund for Environmental Protection and Water Management (NFOOEiGW).

The Polish Geological and Mining Law (The Act) determines two types of mineral deposit ownership: State Treasury Ownership (STO) and Land Ownership (LO). The Act introduces the term - mining usufruct (term adequate to mining lease) that concerns extracting of STO or geological activity in rock mass belonging to the State. The Minister of Environment, on behalf of the State and with the exclusion of other persons, can benefit from the subject of mining properties or dispose of its right to STO exclusively by establishing mining usufruct. The establishment of mining usufruct shall take place in the form of a written agreement between the State and entrepreneur and requires paying predetermined remuneration to the State. The authors conclude that the Act contains imprecise regulations concerning the lower limit of land property. This causes numerous difficulties in recognizing which parts of land property belong to the State Treasury and which belong to the land owner. The authors suggest that it is necessary to differentiate in the Act two kinds of activities and consequently two types of agreement between the State and entrepreneur: 1) agreement of mining usufruct, and 2) agreement of geological usufruct.

The aim of the article is to discuss the amendment to the Act of 9 June 2011 – Geological and Mining Law (Journal of Laws from 2017, item 2126 with further amendments), as a consequence of the entry into force of the Act of 6 March 2018–Law of Entrepreneurs (Journal of Laws from 2018,item 646), as well as the assessment of relevance of the changes devised. The author analyzes in detail a legal nature of the concession and then the changes introduced to the Geological and Mining Law in Chapter I of Section III, concerning concession rules. Paying particular attention to the context, causes and effects of the changes, the author indicates that the amendment was in fact only a technical activity, however, not devoid of the practical significance. This article attempts to answer the question whether the legislative practice of transferring general provisions to the sectorial act, which is undoubtedly the Geological and Mining Law, will contribute to a better understanding of the regulations among their potential recipients.

Opis:
Rational mineral deposits management should already begin at the prospecting and exploration stage. Properly performed exploration works, which lead to estimation resources of new deposits, not only develop the natural resources base but also give new information about geological structure of a country. Therefore it should be extremely important for the Government to be certain that this kind of activity is performed in an efficient and rational way. Unfortunately, geological and mining law and other regulations connected with exploration industry make it difficult – or even impossible – to operate in that way. The author shows some selected examples in which the existing regulations seem to be excessive and unnecessary. It concerns mainly an issue of planning and conducting geological works.

The Polish Geological Institute was established in 1919 as the national geological survey within the Ministry of Industry and Trade. The initiative of a group of parliament members to appoint the Polish Geological Institute was supported by the Polish Parliament on May 30, 1919, and the official opening of the Institute took place on May 7, 1919. Two years later the PGI status and budget were accepted by the Polish government and Józef Morozewicz has received director’s nomination from the Head of State Józef Piłsudski. In March 1938, the President of Poland accepted a new decree concerning geological survey of Poland which was composed of the Polish Geological Institute and the State Geological Council. The role of the PGI grew and the budget substantially increased, but this positive trend was stopped due to the beginning of World War II. During the first post-war years, regional and basic studies made it possible to establish a geological model of Poland leading to great discoveries of mineral deposits in the fifties. The decree of October 8, 1951 adjusted the organization forms of the geological survey to the system of central planning and the domination of state property, and the institute (with the name changed to the Geological Institute) became a scientific institution. During the first years the institute experienced good conditions of development, and a great progress in the knowledge of geology of Poland combined with the basic and regional studies that led to significant discoveries and documentation of mineral deposits. However, already in the seventies the first signs of crisis in geology became evident. In 1985, the Ministry of Environmental Protection and Mineral Resources was established, the Central Board of Geology was disbanded, and many tasks of geological survey returned to the institute, hence this turned out to be appropriate to return to the historical name, Polish Geological Institute, which took place on June 19, 1987. Since January 1, 2012, the Polish Geological Institute has served as the Polish geological survey on the basis of the Act of June 9, 2011, and earlier, since January 1, 2002, legally specified tasks of the Polish geological survey has been assigned to the PGI. On February 24, 2009 the Council of Ministers gave the PGI a status of National Research Institute, and this implied the adding this new status to the name of the Polish Geological Institute. For the century the Polish Geological Institute has successfully fulfilled all the basic responsibilities and commitments that are conventionally assigned to national geological surveys, and is a model example of modern national geological survey of very wide expertise.

Opis:
Financing of geological activities has been based, to a certain extent, on exploitation fees (royalties) paid by every subject exploiting natural raw materials. The rate of exploitation fee varies depending of the kind of the raw material. An amendment made in 2001 to the Polish Geological and Mining Law introduced new crucial changes concerning the exploitation fee. The efficiency of the new exploitation fee (since 2001) system is thor-oughly analyzed in comparison to the old one. Finally, the role and functions of the royalties system is discussed, as well the necessity of future changes in the Geological and Mining Law.

The publication deals with issues related to the functioning of the provincial geological administration. The article describes the development of exploration work in the field of unconventional hydrocarbon deposits (primarily shale gas) in Poland and presents the current progress of operations - number of licenses and license holders, completed drillings and special treatments (hydraulic fracturing). It also informs about the legislative changes planned by the governmental authorities whose aim is to boost the development of the oil and gas industry, as well as to ensure fair division of revenue from extraction of hydrocarbons between license holders, the State Treasury and local self-governments. The article also lists the most important initiatives of the Ministry of the Environment concerning the environmental and social conditions of shale gas exploration (environmental monitoring ofoperations and information and education activities).

The non-discrimination principle of the European Union has become a core basis of the Directive 94/22/EC of the European Parliament and of the Council of 30 May 1994, which introduced the non-discriminatory access to prospection, exploration and production of hydrocarbons. According to this directive, the EU members were obliged to choose between the non-discriminating methods of granting authorizations of hydrocarbons: either an open door system or a licensing round system. Directive 94/22/WE caused changes in Polish geological and mining law related to introduction of the obligatory tender procedure for licenses (concessions) for prospection, exploration and production of hydrocarbons. As a result of case C-569/10, the Court of Justice of the European Union ordered the next changes in Polish law involving, e.g., the possibility to apply for Polish concessions by entrepreneurs with no legal seat or industrial plant in Poland. This article comments changes in Polish geological and mining law in 1994-2017, caused by Directive 94/22/WE and jurisdiction of the Court of Justice of the EU. It shows that, due to European legislation, the two-sided proceedings have been introduced depending on the type of mineral resources constituting the mining usufruct in Poland. These different procedures for granting authorizations of hydrocarbons and other resources may justify creation of new, distinct hydrocarbons law in Poland or introduction of non-discriminative procedures, irrespective of the type of deposit.
