Opis:
The principle of openness, as one of the foremost principles of criminal proceedings, is realised above all during the main trial. The amendment act of law to the code of criminal procedure issued on 10 June 2016 introduced model changes in this regard. The article is devoted to a discussion of mainly these changes in the context of their consistency with the Constitution. The first change has to do with the fact that the public prosecutor has the right to express his or her objection toward the holding of a trial in camera, while such an objection is binding for the court. This regulation is a source of reservations of constitutional nature, for it violates the constitutional right to a fair adjudication of a case by the court. The second fundamental change consists in the establishment, as a principle, of audio-visual registering of the court session by the representatives of media outlets. In these terms, a critical analysis should be conducted upon the removal of the condition of the respect of the important interest of the participant of a criminal proceeding. However, a basically positive evaluation was received by the extension of the scope of the openness of the main trial, expressing a thesis about the constancy of this regulation with the Constitution.

Opis:
The principle of legalism places upon the public prosecutor the obligation o pressing charges to a court of law and then to support this claim in the course of the lawsuit. It seems obvious that in order to execute this duty in an appropriate manner, the public prosecutor should attend the trial and actively participate in it. However, in regulation Art. 46 §2 k.p.k., which was introduced by way of an amendment issued on 11 March 2016, the legislator stipulated a regulation which permits the public prosecutor not to appear during the trial, if the preliminary legal proceedings concluded in the form of investigation. Obviously, the task of this regulation is to accelerate the proceedings in cases of lesser calibre, which are cases in which an investigation is conducted. However, it is necessary to consider the aforementioned regulation in the context of the basic principles of a criminal lawsuit and the analysis of the consequences of such regulations. Therefore, in the first instance one made reference to the most important regulations contained in the basis acts of international law, i.e. the European Convention of Human Rights and the International Covenant on Civil and Political Rights which emphasise above all the significance of independence and impartiality, as well as the principle of a quick and efficient operation of the procedure. It was also necessary to refer the substantive regulation to the principle of the contradictoriness of the criminal lawsuit, which stipulates inter alia the separation of lawsuit-related roles and the passivity of the court in reference to the initiative of the parties who argue their cases.

The aim of the article is showing the legitimacy of the Supreme Bar Council’s legislative initiative to amend Article 245 of the Code of Criminal Procedure, aimed at improving the legal situation of detainees and to assess of the solutions suggested by the NRA, as well. The article analyzes the current state of the law from a legal standpoint of the compatibility of the current regulations with the standards arising from European law – which made it possible to identify areas of incompatibility and to examine whether thanks to the solutions suggested by the NRA, these legal discrepancies can be removed or at least – reduced.

This paper aims to answer the question whether the concept of dividing a criminal trial into two phases is still useful now, more than half a century after its last broader analysis. It also attempts to solve some specific problems related to the said analysis. The starting point for the considerations contained in the paper was to look at the concept of a two-phase criminal trial as a purely procedural construction and thus to reject its functional link with any model of substantive criminal law. The first part of the paper discusses the history of the concept of a two-phase criminal trial, as well as some of the arguments put forward by its supporters and opponents. In the course of further deliberations, the focus is on searching for elements of the concept in the current legal status. The final part of the text deals with the question whether and, possibly, in what form the concept of division of jurisdictional proceedings should become an element of the Polish criminal procedure. This is followed by numerous and widely justified de lege ferenda conclusions.

This article concerns the possibility of conducting proceedings in the absence of the accused or his or her defence counsel even though they have duly justified their absence. The study discusses grounds for applying Article 378a of the Polish Code of Criminal Procedure, alongside some issues connected with submission of a motion for the supplementary taking of evidence. The paper assesses the ratio legis of Article 378a of the Polish Code of Criminal Procedure in the context of the principle of a fair criminal trial, the right to court and the right to defence. The author analyses this legal norm de lege lata and formulates de lege ferenda postulates.
Artykuł dotyczy możliwości prowadzenia postępowania pod nieobecność oskarżonego lub jego obrońcy (per absentia), pomimo należytego usprawiedliwienia niestawiennictwa. W opracowaniu przedstawiono przesłanki stosowania art. 378a k.p.k., kwestie związane z wnioskiem o uzupełniające przeprowadzenie dowodu. Autor krytycznie ocenia ratio legis przepisu art. 378a ustawy karnoprocesowej w kontekście zasady rzetelnego procesu karnego, prawa do sądu i prawa do realnej obrony przed zarzutami oskarżenia. Autor formułuje postulaty de lege lata i de lege ferenda pod adresem ustawodawcy.

Opis:
The article touches upon the issue of internal transparency of rehabilitation proceedings and reinvestigations which take place following the annulment of the final judgment. Depending on the rehabilitation prerequisites, it is possible to obtain an acquittal or a judgment equal to an acquittal in three exceptional and appeal modes, i.e. cassation, revision and annulment with regard to persons who experienced repression on the grounds of their involvement in actions aimed at maintaining the independence of the Republic of Poland. The full inclusion of the defendant and their defender in the court proceedings guarantees that the efforts to expunge the defendant’s criminal record will be carried out in accordance with the rules of directness, contradictoriness, equality, orality, the right to defense and broadly understood rule of conscientiousness. This type of procedure upholds the possibility of voluntary participation of the defendant in proceedings aimed at establishing the probability or certainty of the emergence of grounds for employing exceptional appeal modes, while the restrictions, exclusion or expansion of the involvement of the defendant are regulated according to particular exceptions.
