The Second Plenary Polish Synod took place from 1991 to 1999. The resolutions of the Synod came into force on the 28th February 2002. The resolutions represent the revival of all aspects of ecclesiastical life in Poland. Chapter 13 of these resolutions entitled: Polish Pastoral Ministry Abroad, was dedicated to the emigrant issue. It reflects a theological outlook on pastoral ministry among Polish emigrants especially those living in the former Soviet Union. The Synod endeavored to resolve all problems that may arise by creating Regulations and Advices. There is also an addendum: Frameworks of Polish Pastoral Ministry Abroad. Resolutions of the Synod reveal that although the Church in Poland is concerned about the religious side of the emigration issue, it does not ignore, but recognizes the lay aspects of emigration. The Regulations and Advices show us how the ordering, interpretation and diagnosis of the problems linked with emigration are conducive to the resolutions set by the Synod. An addendum, which gives a description of the structures of Polish ministry abroad from a historical aspect, shows us how differential that ministry is. It also shows how it is open for various initiatives in terms of mere emigration. "The resolutions of the Synod reveal the elusiveness of the emigration phenomenon and brings to light the fact that there are many legislative problems in the Church waiting to be resolved. The Church in Poland - as we can see from the resolutions of the Synod - is aware of the phenomenon of new and different kinds of emigration which create new and specific problems for Polish pastoral ministry abroad.

II Codice di Giovanni Paolo II si distingue per il suo carattere pastorale. Il suo scopo principale consiste nella realizzazione, al modo suo, della missione salvifica della Chiesa. Nel Codice la persona ci viene presentata in modo seguente: dimorante (advena) - nel luogo in cui ha il quasi-domicilio; forestiero (peregrinus) - se si trova fuori del domicilio e del quasi-domicilio che ancora ritiene; girovago ( vagus) - se non ha in alcun luogo il domicilio o il quasi-domicilio (can. 100). Vengono usati anche gli altri concetti che vogliono rilevare la multiforme situazione umana di essere in cammino. Il Codice di Diritto Canonico del 1983 non presuppone di presentare dei precetti particolari e ben sistemati in campo della pastorale dei migranti. In questo Documento troviamo soltanto le regole universali e ordinari che esigono una esplicazione e specificazione dentro la legge speciale. II Codice quindi ci offre solo la base per i chiarificazioni ulteriori che competono alla legislatura più specifica. Cosi si impone come lo strumento che sollecità constantemente la nostra sensibilità ai problemi della migrazione e ai diritti dei singoli migranti. Il Codice espone simultaneamente i principi che sono stati recentemente riesaminati in vista della mobilita umana. Quest’ insieme dei fatti fa percepire il nuovo Codice di Diritto Canonico come il Documento Ecclesiale in cui la pastorale dei migranti ha ottenuto il suo posto ben preciso e rilevante. Cosi è stata formulata e garantita la base solida per i futuri soluzioni giuridici in questo campo.

Congregazione per gli Istituti di Vita Consacrata e le Società di Vita Apostolica, assieme al Pontificio Consiglio della Pastorale per i Migranti ed I’Itineranti, hanno rivolto una lettera congiunta alle superiore ed ai superiori generali degli istituti di vita consacrata. Questa lettera deve incoraggiare, un sempre maggiore l’impegno, le persone consacrate sui vari aspetti di mobilità della Chiesa secondo l’Istruzione del Pontificio Consiglio della Pastorale per i Migranti ed I’Itineranti Erga migrantes caritas Christi (La carità di Cristo verso i migranti). Il documento invita ad una sfida particolare, specialmente per le persone consacrate, perché abbiano sempre nella pastorale dei migranti, un ruolo di primo piano sia per il carisma di congregazioni volto a tale specifico settore, che per l’apporto personale di singoli consacrati o di singole comunità appartenenti a vari istituti di vita religiosa e società di vita apostolica. Tutti e due documenti sottolineanno che, la Chiesa fa, e continua a fare, grande affidamento sul contributo dei consacrati a tale pastorale specifica.

The migration issues make an extensive and multifaceted subject in John Paul’s teaching. Expressions of these are, among other things, his Messages for the World Migration Day. In twenty-six years of his pontificate the Pope pointed out the problems of modern migration, which concern individual aspects of life of the Church and of the World. In his Messages the Pope also undertakes canonical issues of migration and shows us the ways to solve them. The Pope’s leading item is a statement that all migrants need special concern on account of their specific situation. It is a duty of the Church to provide a pastoral care for them. Pope John Paul II always defends human rights especially a human right to emigrate and he supports migrants’ right to maintain their own identity. The Pope pays special attention to their rights to form the family and to maintain the family rights.

The Code of Canon Law of the Eastern Catholic Churches - as a basic statute book - took up the issues that arose due to the phenomenon of modern migration. However, the practical application of these basic statutes is left to the discretion of individual Eastern Churches. The Code contains not only a description of the phenomenon of migration and its problems; it also insists on official status for the faithful in their churches which are sui iuris. This can be seen in the individual canons in which the legislator tries to integrate the migrants while respecting and preserving their own rite. The Code of Canon Law of the Eastern Catholic Churches also places particular emphasis on the necessity to recognize m igrants’ pastoral needs and provides appropriate structures for them. It accurately defines the rules for migrants when they are living under the Church’s authority. The Code’s wholehearted support of pastoral work for migrants has been welcomed in Eastern Churches’ fundamental code of law. As a result it would seem that The Code of Canon Law of the Eastern Catholic Churches will play a big part in shaping the legal system of the particular Eastern Churches.
