Opis:
Aid activities in Poland have a long history. Over the centuries, it took various forms and evolved from mutual assistance, philanthropy, and charity to organized, purposeful activities. Memories of my experience of working in institutional care and then of social welfare concern the period of the turn of the Polish People's Republic and the Third Polish Republic. The systemic changes initiated at that time were of fundamental importance in the development and professionalization of Polish social welfare. I belong to a group of social workers who started work in the 1960s. Therefore, I am an eyewitness and participant in the changes that took place on the "first line" of social welfare in one of the Polish municipalities in which I worked in those years. I tried to explain the reality of social workers in this period. In my memories I recall some events that may seem insignificant in the scale of general changes but reflect the atmosphere of those times. I trust that they will supplement the knowledge about the history of social welfare of this period.

The article is a presentation of the results of research conducted in Poland in April 2020, during the SARS-CoV-2 coronavirus epidemic, on the situation of employees of the nursery homes. The research was conducted using an electronic survey method on a group of 160 (N = 160) employees. The aim of the study was to provide a preliminary and ongoing analysis of the work conditions of employees of social assistance facilities during the SARS-CoV-2 epidemic (COVID-19). The article also indicates the context of the legal situation in which the research was conducted, in relation to the administrative bodies taking actions under special provisions to secure the situation of employees and residents of the social assistance facility. As a result of the research, it was found that the majority of employees covered by the survey indicated deficiencies in personal protective equipment, as well as a situation of insecurity at work. The thesis about the necessity to take urgent legal and factual actions aimed at securing DPS employees in a way that guarantees their safety as much as possible, taking into account the obvious possibility of infection, which, however, by providing protection measures and performing procedures – may be limited.

The article presents research on the family violence prevention system family from the perspective of social assistance. The position of social welfare and the role of social worker in this system are discussed. A specific social position and the key role of social worker in the system of prevention of violence have been confirmed. Study also shows the diversity of the system preventing domestic violence, which differs depending on the size of the municipality. In smaller communities, it is based primarily on the social workers and in the larger communties it is largely supported by other professionals: psychologists and lawyers.

The article discusses the social situation of people, who are older, in a difficult socio-economic conditions, disability or chronic illness. These people require support in the twenty-four-hour living caring and nursing services forms. The article presents the system of Polish social assistance in the care facilities aspects and recommendations of the European Commission with Expert Group on the Transition from Institutional to Community – based Care, that guarantee for human rights and a better quality of life. The change of the social policy system from institutional to environmental services and implemented among the local community is discussed in this study. The argumentation for the development of these services is undeniable, because human is at the center of all assistance activities.

The article attempts to present the process of professionalization of social work in Poland after 1989. It was shown in terms of the classical attribution model and in the concept of Abbott, in which the essence of the pro-fessionalization process is primarily the functioning of the profession in a complex system of internal and exter-nal dependencies. Analyses indicate that the process of professionalization of social work in Poland is currently far incomplete, and the ongoing and planned changes in the social welfare system are unlikely to favour its development. We deal with specific monopolistic practices of the state in shaping the institutional foundations of social assistance in accordance with the interests of the central administration, which seeks to shift responsibility for implemented activities to external entities, retaining full and even increased possibilities of exerting influence and control. This is also reflected in the ongoing attempt to standardize social services, which is ultimately an element of deprofessionalisation of social work

The purpose of the article is to draw attention to the challenges and threats faced by social assistance institutions in the face of the second month of the COVID-19 pandemic in Poland, with particular emphasis on disturbing phenomena and behaviours involving employees of these institutions. The text, on the one hand, supported by examples derived from personal experiences and reports of the social workers themselves, on the other, by the author's observations and reflections, can serve as a warning against hasty, chaotic actions undermining the morale and reputation of the social assistance system. In the current particularly difficult time for all, it should pass the test in responsible management, coherent cooperation, developing effective solutions and missionary character – serving the ones in need.

Świadczenie pielęgnacyjne jest jedną z form pomocy opiekunom osób z niepełnosprawnością. Tym samym wypełniana jest zasada pomocy państwa osobom, które nie są w stanie samodzielnie podołać napotkanym trudnością. Pomoc rządowa jest konstytucyjnym obowiązkiem państwa. Innym równie ważnym zadaniem polityki społecznej jest równe traktowanie wszystkich obywateli. Przyznawanie świadczenia pielęgnacyjnego stoi w sprzeczności z zasadą równości. Zapisy ustawy o świadczeniach rodzinnych wyłączają bowiem z kręgu osób uprawionych dorosłe osoby, u których niepełnosprawność powstała po ukończeniu 18. roku życia. Tak stworzona ustawa narusza zasadę równości wszystkich obywateli. Potwierdza to wyrok Trybunału Konstytucyjnego, a także wiele innych orzeczeń sądowych przyznających prawo do świadczenia pielęgnacyjnego osobom teoretycznie nieuprawionym. Artykuł jest syntetycznym przedstawieniem, czym jest świadczenie pielęgnacyjne, dlaczego zostało wprowadzone kryterium wiekowe powstania niepełnosprawności, a także ukazuje luki prawne, z których korzystają osoby, aby uzyskać prawo do w/w świadczenia. Przedstawione w artykule kwestie są jedynie wycinkiem obszernego tematu, od 2013 r. toczą się bowiem dyskusje podające w wątpliwość obowiązujące świadczenie, a wprowadzane nowelizacje nadal nie przyniosły oczekiwanych efektów.
Nursing benefit is one of the forms of help for caregivers of people with disabilities. Thus, the principle of state aid to people who are not able to cope with the difficulties encountered is fulfilled. Government assistance is a constitutional obligation of the state. Another equally important task of social policy is the equal treatment of all citizens. Granting the nursing benefit is contrary to the principle of equality. The provisions of the Law on family benefits exclude from the circle of eligible adult persons who became disiabled after the age of 18. The law thus created violates the principle of equality of all citizens. This is confirmed by the judgment of the Constitutional Tribunal, as well as many other court decisions granting the right to the nursing benefit to theoretically unauthorized persons. The article is a synthetic presentation of what the nursing benefit is, why the age criterion of the emergence of disability has been introduced, and it also shows the legal gaps used by people to obtain the right to the above-mentioned benefit. The issues presented in the article are only a fragment of an extensive topic, as since 2013 discussions have been taking place which question the existing benefit, and the introduced amendments have still not brought the expected results.

The family is considered the closest environment for people, a natural habitat of the proper development and education of the child. The family performs a lot of functions, including: care, education, socialization, fulfilling the economic and emotional needs and many other. The proper education and care functions consist in organisation of the free time, teaching self-care, fulfilling psychical and social needs of the family members. Nowadays, many families are experiencing an emotional crisis, intergenerational relationships are disturbed, which in turn leads to educational difficulties. The family not always can perform its functions. Social assistance under the Act on family support and foster care system to support families experiencing care and education difficulties, offers many forms of help for these families. However, they are not always enough. The aim of the article is to present other family-supporting programs implemented by GOPS in Lubicz.

In the light of the Constitution of the Republic of Poland the citizen has the right to health care. This also applies to elderly people in a nursing home (DPS). The deepening of indigestion, the coexistence of many diseases, their chronicity and the level of complications trigger the increase in demand for DPS for systematic, 24-hour geriatric medical care (medical care, nursing and rehabilitation services). Realizing the health needs of elderly people in DPS by health care providers is a source of controversy, hence the need for legislative changes to shift the burden of health financing in DPS to the Polish National Health Fund (NFZ).

Przedmiotem rozważań podjętych w artykule są kwestie dotyczące problemów, jakie powstają w pracy zawodowej pracowników socjalnych niejednokrotnie mających do czynienia z interwencjami u osób z zaburzeniami psychicznymi, które najczęściej nie chcą poddać się leczeniu. Co raz częściej rodziny twierdzą, że najlepszym rozwiązaniem byłoby ubezwłasnowolnienie takiego członka rodziny. Dodatkowo projekt ustawy o zmianie ustawy o ochronie zdrowia psychicznego zakłada wywieranie presji przez lekarzy, aby członkowie rodziny skorzystali z procedury ubezwłasnowolnienia. Celem artykułu jest wykazanie, że ubezwłasnowolnienie osoby powinno być ostatecznością oraz przedstawienie różnego rodzaju form wsparcia i pomocy zarówno dla chorego, jak i członków rodziny. Podstawową metodą badawczą była metoda dogmatyczna, tj. formalno-prawna, polegająca na wykorzystaniu dotychczasowego dorobku nauki prawa, która opiera się na analizie tekstów prawnych w tym zakresie. Ocenę tego zagadnienia poddano badaniu aktualnego ustawodawstwa i orzeczeń sądów w tym zakresie. Rozważania na temat konieczności ubezwłasnowolnienia zostały ujęte w trzech częściach. W pierwszej przedstawiono znaczenie ochrony zdrowia, w tym psychicznego, które podlega ochronie nie tylko konstytucyjnej, a także na podstawie innych ustaw. Część druga określa istotę ubezwłasnowolnienia częściowego i całkowitego, proces tej czynności, podmioty, które mogą wystąpić z wnioskiem o ubezwłasnowolnienie. Wykazuję konsekwencje prawne dla osoby ubezwłasnowolnionej, a także konsekwencje dla osoby, która złoży wniosek o ubezwłasnowolnienie lekkomyślnie, bądź w złej wierze. Odpowiadam na pytanie czy powinien być utworzony rejestr osób ubezwłasnowolnionych. W trzeciej części omawiam wnioskowy tryb przyjęcia do szpitala psychiatrycznego, jaki może być realizowany m.in. przez pracownika socjalnego, szeroki wachlarz pomocy finansowej, instytucjonalnej, pracy socjalnej, którą może zagwarantować organ pomocy społecznej dla osoby chorej, aby ubezwłasnowolnienie stanowiło ekstremum działania. Rezultatem tej pracy jest wykazanie, że jednostki organizacyjne pomocy społecznej, w tym pracownik socjalny, rodziny posiadają różne instrumenty wsparcia osoby w kryzysie zdrowia psychicznego.
The subject of considerations in the article are issues related to the problems occurring in the professional work of social workers, who, repeatedly, deal with interventions for people with mental disorders, who most often do not want to undergo treatment. Increasingly, families claim that the best solution would be to incapacitate such a family member. In addition, the draft act amending the Mental Health Protection Act assumes that doctors will put pressure on family members to use the incapacitation procedure. The aim of this article is to show that incapacitation should be a last resort and to present various forms of support and help for both the patient and family members. The basic research method was the dogmatic method, i.e., formal and legal, involving the use of the existing achievements of law science, which is based on the analysis of legal texts in this area. The assessment of this issue was subject to examination of the current legislation and courts decisions in this respect. Considerations on the necessity of incapacitation are presented in three parts. The first one discusses the importance of protection of health, including mental health, which is protected not only constitutionally, but also under other laws. The second part defines the essence of partial and total incapacitation, its process, entities that may apply for incapacitation. I present legal consequences for an incapacitated person as well as consequences for a person applying for incapacitation recklessly or in bad faith. I answer the question whether a register of incapacitated persons should be established. In the third part, I describe the procedure of application for admission to a psychiatric hospital, which may be carried out, inter alia, by a social worker, a wide range of financial, institutional and social work assistance that can be guaranteed by the social support body for the sick person, so that incapacitation is the extreme measure. The result of this article is to demonstrate that social assistance organisational units, including a social worker and families, have various instruments to support a person in a mental health crisis.
