Okres w dziejach Danii zapoczątkowany objęciem władzy przez Waldemara I w 1157 r., a zakończony śmiercią jego najmłodszego syna Waldemara II (1241) zwanego przez potomnych Zwycięzcą lub Prawodawcą uznawany jest w historiografii duńskiej za czas znaczących zmian społecznych, politycznych oraz prawnych. Niekiedy jest on wręcz określany mianem złotego okresu dziejów Królestwa w średniowieczu tzw. epoki Waldemarów. Po latach wewnętrznych walk o władzę, faktycznego rozbicia dzielnicowego i uznania zwierzchności lennej cesarza, blisko 100-letnie panowanie Waldemara I i jego dwóch synów przyniosło ponowną konsolidację państwa, z którą wiązało się poszerzenie władzy królewskiej, w tym prawodawczych uprawnień władców. Procesowi temu towarzyszyła współpraca na linii państwo – Kościół, którego wsparcie i aprobata doprowadziły nie tylko do szeregu podbojów terytorialnych, uporządkowania skarbowości i aparatu administracyjnego, ale także do spisania obowiązujących praw. Należy podkreślić, że począwszy od wydania w 1200 r. Prawa króla Kanuta o zabójstwach, monarcha zaczyna występować jako samodzielny prawodawca, co mając na uwadze zwyczajowe uprawnienia prawodawcze, przysługujące wiecom dzielnicowym (ting), stanowi istotne novum. Za zwieńczenie wzmożonej działalności legislacyjnej władców „epoki Waldemarów” uznać należy „danie” w 1241 pierwszego w dziejach Danii spisu praw dzielnicy Jutlandii – Jyske Lov, które opatrzone zostało sankcją królewską. Prawo to poprzedzone jest przedmową, którą uznać można za sui generis ustawę zasadniczą wskazującą m.in. zakres praw i obowiązków monarchy, w tym uprawnień prawodawczych króla. Analiza wybranych rozporządzeń królewskich z I poł. XIII w., w tym przede wszystkim przedmowy do Jyske Lov pozwoli, przy uwzględnieniu tła politycznego, przybliżyć zakres władzy królewskiej władców „epoki Waldemarów”, ze szczególnym uwzględnieniem uprawnień prawodawczych monarchy.
The period in Danish history which began with the accession of power by Valdemar I in 1157 and ended with the death of his youngest son, Valdemar II (1241), known by posterity as the Victorious or the Lawgiver, is considered in Danish historiography as a time of significant social, political and legal changes. It is sometimes even named as the golden period of the Kingdom’s history in the Middle Ages, the so-called “Valdemar Era”. After years of internal struggles for power, real feudal fragmentation, and recognition of the emperor’s fief sovereignty, the nearly 100-year reign of Valdemar I and his two sons brought a re-consolidation of the state that included an expansion of royal authority, including the legislative powers of the rulers. This process was accompanied by cooperation between the state and the Church, whose support and approval led not only to a series of territorial conquests, the ordering of the treasury and the administrative apparatus, but also to the writing of the laws in force. It should be noted that beginning with the issuance of King Canute’s Law of Murder in 1200, the monarch begins to act as an independent legislator, which, given the customary legislative powers vested in the district councils (ting), is a significant innovation. As a culmination of the increased legislative activity of the rulers of the „Valdemar Era”, in 1241, the first Danish law on the Jutland district, Jyske Lov, was „given” with royal sanction. This law is preceded by a prologue, which can be regarded as a sui generis fundamental statute indicating, among other things, the scope of the monarch’s rights and duties, including the king’s legislative powers. The analysis of selected royal decrees from the first half of the 13th century, including especially the prologue to Jyske Lov, will allow, taking into account the political background, to present the scope of royal authority of the rulers of the ≪Valdemar Era≫”, with particular emphasis on the monarch’s legislative powers.

The professors of law at the Faculty of Law of the University of Vilnius were: Simon Dilger, John George Schauer and Aaron Alexander Olizarowski. On the other hand it raises doubts whether, in accordance with the act of foundation, only one chair of civil law (Roman) were established. Undoubtedly, canon law was taught at the two cathedrals. With high probability, Aaron Alexander Olizarowski also taught canon law. However, all indications are that he could take second chair in civil law (Roman) and lectures on this discipline. It is true that Aaron Alexander Olizarowski also promoted a few doctors of canon law, but in this period Vilnius Academy were other specialists who are likely to teach canon law. In addition, he was a layman, which could also be an obstacle to entrust lectures in canon law. In addition, CV, publications and complete education Olizarowski’s indicate that undoubtedly took a second chair in civil law (Roman) and lectured in this discipline. Having a doctorate both laws was adequate preparation to teach this course. Thus, Alexander Olizarowski, educated abroad, was the only lawyer and the right candidate for the role of professor of civil law (Roman) at the University of Vilnius.

This article attempts to answer the question of how works on the codification of civil law proceeded, following the political upheaval of 1948. The literature indicates that the work was interrupted and that another project of the Civil Code was not published until 1954. Codification efforts were indeed broken, but in September 1950 the Presidium of the Government adopted a significant resolution requiring the Minister of Justice to prepare a draft of the Civil Code in just 11 months. The author – on the basis of archival documents – is trying to reconstruct the course of this work and fill gaps in the existing literature. It turns out that the Ministry of Justice accomplished the resolution, even though the set time limit may have seemed unreal. By the end of August 1951 the project of the Civil Code with its reasons was finished. However, in view of the advanced work on a new constitution, the project was suspended and legislative work has not been continued.

The main point of this text is an attempt to present a few duties of the praetor and try to stipulate the origins of them. First of all it should be noted that the term praetor was not consistently used to describe only the jurisdictional magistrate, and it was used in relation, for example, to the consuls. This was probably because the sound etymological sense of the word (praeire: “to go before, to precede, to lead the way”). The appointment of praetor urbanus in 367 BC under leges Licniae Sextiae was not associated with the need to carry out a jurisdictional competence. The origins of the magistrate were strictly military in its nature, which since the end of the third century BC gave way to the area of jurisdiction. Raised considerations apply also to the praetor for foreigners (praetor peregrinus), who has not resolved disputes between the Romans and foreigners (peregrini), and his role was to ensure the military security of Italy. The jurisdictional competence of the pretorship as the most “famous” begins to emerge in the late third century BC, which is likely to be linked not only with the increase in the number of praetors, but mainly obviates external threat from the Carthage. It seems to indicate that the jurisdictional competence (civil and criminal) was not assigned to pretorship at the beginning of this office. It appears at least at the end of the third century BC and starts to become predominant among others which were associated with this office in ancient Rome.

One of the most drastic legal solutions introduced after the outbreak of the October Revolution was the abolition of inheritance. In subsequent years the basic institutions of inheritance law have been gradually restored, but the scope of the inheritance law granted to citizens has remained narrow. The purpose of this paper is to indicate the potential impact of these Soviet patterns on contemporary Polish inheritance law. The article is divided into three parts. The first part presents a brief outline of the evolution of Soviet inheritance law, from the period of the October Revolution to 1945. There- after, the proposal to implement Soviet solutions into Polish law is presented. It was embodied in five theses for the project of inheritance law, prepared during the works of the Codification Commission in 1951. The last part describes the further history of this project. The article finishes with the concluding remarks in which the author seeks to indicate the legacy of the October Revolution in the current inheritance law in Poland.

After the 2nd World War the Misdemeanour Law of European socialist countries inc- luded, apart from the traditional penalties, measures of an educational character. The assumption of gradual abolition of repressive measures accompanying the development of a socialist society lay in the basis for introducing them. Typically, a fine was the basic sanction for committing an offence. The highest upper limit of fine was provided for in the legislation of Hungary, Bulgaria and Poland. It was the Polish Misdemeanour Law which used the maximum allowable fine most often. Custodial detention was common in the Misdemeanour Laws of Yugoslavia as well as in Poland, which also used the al- ternative penalty of arrest and detention in cases of non-payment of a fine. In Hungary and the Soviet Union, the penalty of detention was of exceptional character. However, as its upper time limit of detention was three times higher than in other countries, the Polish Misdemeanour Law is to be perceived as being the most restrictive. The pu- nishment of a three-months detention for every third misdemeanour committed, was provided for in the Misdemeanour Law codification of 1971 of the People’s Poland.

In a post-modern, multicultural world, the present head of the Roman Catholic Church, similarly to his predecessor Benedict XVI, consistently promotes natural rights theory as a common, universal, moral heritage which determines and reflects on the individual, social and political orders of life. What underpins the Pope’s view is the philosophical anthropology that reflects the immutability of being in its duration and structures, and that exposes, more distinctly than promoted by his predecessors, the need for related- ness with other human beings. His theory of natural law, not only on a philosophical but also religious level, presupposes recognition of this concept on the basis of faith in revealed truth. For the Pope, this approach translates to recognizing the supremacy of morality over the law that may obtain universal qualities if it accepts its subordination to ethical values. For Pope Francis, such a prospective is a basis for dialogue between differ- ent cultures and religions. Simultaneously, it allows to formulate canons of common law in the public and private dimension, whose sources should be sought in the idea of dig- nity and in immutable human rights that arise from it. However in the context of the in- terpretation of some fundamental rights, it should be noticed that the emphasis present during transmission to the public is slightly different in terms of their contents, which causes numerous ambiguous comments. Undoubtedly, the theory of law proposed by Pope Francis arises out of the need to identify an effective counterbalance to the current culture of so-called subjective and shallow truths which implement individual, selfish projects of social, economic and political existence.

The article “Changes in the constitutional matter affecting the structure of the judiciary during the regime of 19 May 1934” covers the changes in Bulgaria when on 19 May 1934, after a successful coup, the political circle ‘Zveno’ and the Military Union came to power. The coup was carried out in drastic violation of the constitution. A number of reforms had been undertaken in the country, some of which affected the constitutional structure. Particularly serious were those in the field of Bulgarian judicial organisation. The coup was carried out without the participation of the tsar, but was legitimized by him. The participants in the May 19 coup considered it necessary to change the procedure for the installation of the National Assembly. The constitutional powers of the Grand National Assembly were taken away by the government. The electoral right and the right of association guaranteed by the Tarnovo Constitution were violated. Amendments were also made to the administrative-territorial division of the country, which were implemented by ignoring the Constitution, where the names of the territorial units are explicitly mentioned. All these changes, euphemistically called “renewal”, affected the judicial system as well. The government of Kimon Georgiev, on the basis of Article 47 of the Tarnovo Constitution, issued on 24 November 1934 the Decree-Law on the Structure of the Courts. Interestingly, the structure of the 1926 law was adopted. Most of its text was reproduced, and the additions made concern primarily the internal structuring of some chapters and the introduction of new paragraphs. It was a major reform of the Bulgarian judicial system.

This article presents the issue of the reactivation of the administrative judiciary in Po- land in the years 1944–1952. The judicial control administration existed in the Second Republic of Poland, but World War II interrupted its activities. The Polish commu- nist authorities, in comparing the Manifesto of July 1944 and the “Small Constitution” of 1947 with the basic principles of the “March Constitution” of 1921, indirectly pointed to the necessity of re-establishing such a jurisdiction. However, the revolutionary social reforms, which primarily related to agricultural reform and nationalization, meant that control over the administration, exercised by an independent court or other authorities, did not fit within the process of building the new system. Consequently, the 1952 Con- stitution of the Polish People’s Republic, completely shattered the chance of reactivating such form of control.

Opis:
Culture and nature are the main formative factors of human behaviour. Furthermore, culture also determines the variations of societies. The integral elements of culture are law and politics that interact with each other. The influence of politics on the law in- creases during social crisis and radical historical transformations. An example of these effects can be illustrated by the situation on Polish territory at the beginning of the 19th century. A forceful correlation between politics and law is noticeable in Wincenty Hipolit Gawarecki’s literary output, where he shows the origin and the essence of the court of conciliation in the Duchy of Warsaw and the Congress Kingdom.

The subject of the article is an analysis of the President’s extraordinary powers in the Constitution of the Republic of Poland of April 23, 1935 (the so-called April Constitution). It adopted a system of government in which the President held the function of the highest factor in the state (hyper-presidentialism). Supreme state organs, including parliament, government and courts, were subordinate to him. If it was necessary to use the Armed Forces to defend the state, the President could impose martial law. In such a situation, the Constitution allowed for the implementation of a number of extraordinary powers, including issuing decrees with the force of law and the establishment of parliamentary chambers (the Sejm and the Senate) in a reduced composition. In the event of war, the President was given the opportunity to appoint the Supreme Commander and to appoint his successor, whose term of office expired three months after the conclusion of peace. The President also had extraordinary powers during the state of emergency. According to the author of the article, against the background of the April Constitution, the President could also exercise extraordinary powers in the event of failure by the subordinate organs of the state to perform the tasks assigned to them by the Constitution.
Przedmiotem artykułu jest analiza uprawnień nadzwyczajnych Prezydenta w Konstytucji Rzeczypospolitej Polskiej z dnia 23 kwietnia 1935 r. (tzw. Konstytucji kwietniowej). Przyjmowała ona system rządów, w którym Prezydent sprawował funkcję najwyższego czynnika w państwie (hiperprezydencjalizm). Podlegały mu naczelne organy państwa, łącznie z parlamentem, rządem i sądami. W razie konieczności użycia Sił Zbrojnych do obrony państwa Prezydent mógł wprowadzić stan wojenny. Konstytucja pozwalała w takiej sytuacji na realizację szeregu uprawnień nadzwyczajnych, w tym wydawanie dekretów z mocą ustawy i powołanie izb parlamentarnych (Sejmu i Senatu) w zmniejszonym składzie. W razie wybuchu wojny Prezydent uzyskiwał możliwość mianowania Naczelnego Wodza oraz powołania swojego następcy, którego kadencja upływała trzy miesiące po zawarciu pokoju. Prezydent dysponował również uprawnieniami nadzwyczajnymi w czasie stanu wyjątkowego. Zdaniem autora artykułu na tle Konstytucji kwietniowej Prezydent mógł także realizować uprawnienia nadzwyczajne w razie niewykonywania przez podległe mu organy państwa zadań przypisanych im przez Konstytucję.

During the existence of the Polish People’s Republic (1944–1989), the dominant ideology was that of Marxism-Leninism. It wielded strong influence on the official world-view. The ideology aspired to explain, in reality, all phenomena and processes. However, wi- thin a short period of time it became apparent that Marxism-Leninism had its weaknes- ses, for example, developing the sciences was conditional upon their non-interference with the objects of Marxism-Leninism. One such science that fell in this arena was the cybernetics of law. Hence, the purpose of this article is to give a short presentation of ge- neral assumptions and relation between the cybernetics of law and Marxism-Leninism during the period of “real socialism” in the Polish People’s Republic.

Opis:
Accounting for criminal acts committed by the communist Polish state and its officers requires establishing the principles of their responsibility. An act passed by the Sejm of the Republic of Poland delivered legal grounds to this responsibility from 18 December 1998, concerning the Institute of National Memory – a committee for pursuing cases of felony against the Polish nation. The provisions of this act enable officers of the former communist regime, which conducted criminal proceedings in matters having a political base, to be brought to justice. Judging and sentencing the civil servants responsible for bending the law to realise the political objectives of the Polish United Workers’ Party and communist authorities,constitutes a just and appropriate way of dealing with these past events. Complementing justice in this respect should be a warning to future generations that immorality and injustice will always be subject to retribution.

Opis:
Military laws, taking into account the entities issuing them, can be divided into five types. These are hetman’s articles (announced by the chief commanders), royal articles (issued by the rulers), parliamentary articles (adopted by various representative bodies), confederate’s articles (self-governing announced by all soldiers) and the urban articles, created by or under the authority of the city council. The paper presents characteristics of “urban military articles.” These were the normative acts issued in the modern era directly by the city council or bodies acting under its authority. Promulgated acts were shorter than the other military articles, as in this case, military law was only comple- mentary to the system of municipal law. These documents were primarily to ensure ef- ficient supervision and control of the civilian municipal authorities over military troops. Civilians and private property was covered by special protection. Urban military articles imposed upon soldiers a fairly rigid moral framework, particular attention being given to the problems of alcoholism, prostitution, gambling, and even participation in urban amusements and festivities. More lenient penalties were applied in the urban military articles, which occurred the more strikingly the greater the proportion of urban citizens serving in the military. A sentence of imprisonment was provided more willingly, obvi- ously using institutions operating in the cities.
