The text is addressed at first to young historians and historians of law. It stresses the peculiar importance of the science of the history of law and legal education in Polish historical science, especially in the period between 1850–1914. The science of history of law has been strongly connected with historical science, and law was a phenomenon shaped par excellence by history. In 19th century Poland, when the partitioners were replacing Polish law and Polish institutions by their own legal systems, Polish historians of law had to struggle to preserve national legal traditions. That is why the strong position of F. K. von Savigny’s historical school of law is presented in Polish Romanticism. The article describes the achievements of Polish historians of law in the field of national history science. It points out that many of the historians in this period were lawyers by education (Szymon Askenazy, Tadeusz Korzon, Władysław Smoleński, Marceli Handelsman, Władysław Konopczyński). Nowadays the role of the science of history of law is underestimated, although the cooperation of historians of law with the representatives of other historical disciplines is fruitful.

Legal history in Poland is imperiled by a few threats. One of them is a model of the university education, promoted by the heads of faculties, which is devoted to strictly legal subjects. It may happen, that historical subjects will be eliminated or vastly limited in the course of the implementation of this model. Such kind of pressure inclines legal historians to emphasize their utility to contemporary legal science. However, it is worth noticing, that there are different dangers that lie in wait for Roman law and for Polish legal history. Basing instruction upon incomplete sources in showing a distant genesis of contemporary legal institutions causes an excessive simplification, which is a serious threat to the reliability of scientific research. The Polish legal history researcher will be helpful to a specialist of contemporary law only occasionally and in most of those rare cases his research will be used to point out the birth of a certain legal institution in Polish law. Another threat to Polish legal history is an intensive interest in mostly recent history. Although, after years of censorship in the state of real socialism, this situation is intelligible, as it resulted in abandoning the research of old-Polish times, nowadays conducted by only a few scholars. As far as the group of Romanists is concerned, they tend to indicate the Roman roots of almost all past, present and future legal institutions. However, this is cannot be done when applying all rigors of scientific research. A drop of the scientific level of publications may be observed as well. Authors do not investigate sources of the practice of the law, the use of legal history literature is insufficient and the publications of historians of other specializations are used only to a minimal degree. Legal historians in Poland have to deal with these main problems, if they hope for the further development of their discipline.

Anzelm [Paul Johann Anselm] Feuerbach (1775–1833), the founder of the theory of psychological compulsion (Theorie des psychologischen Zwanges), was also famous as an author of criminal stories. In 1827 he published a book titled Aktenmäßige Darstellung merwürdigen Verbrechen, which contained more than 30 stories based on criminal cases involving manslaughter. One of these stories, with the original title Andreas Bichel, der Mädchenschlächter (Andreas Bichel, the slaughterer of girls), presents the history of a noto- rious murderer of young women. The motive of his acts was basically robbery. Law, especially legal proceedings, plays an important role in this story.

W poniższym artykule postaram się przedstawić sprawę Niemieckiej Listy Narodowościowej na Górnym Śląsku widzianą z trzech perspektyw historyczno-prawnych razem z krótkim omówieniem jak wpłynęła ona na los Górnoślązaków oraz kształtujące się w jej świetle relacje polsko-niemieckie. Po krótkim opisie najważniejszych skutków wprowadzenia Niemieckiej Listy Narodowościowej na Górnym Śląsku oraz jej wpływu na relacje ludności polskiej i niemieckiej przejdę do opisu pierwszej części historyczno-prawnej, w której zaprezentuję  literalne brzmienie czwartej konwencji haskiej (ze szczególnym uwzględnieniem działu trzeciego traktującego o wykonywaniu okupacji) wraz z przykładem jej zastosowania po pierwszej wojnie światowej. W kolejnej części przedstawię polską wykładnię jej postanowień w kontekście oceny legalności wprowadzenia Niemieckiej Listy Narodowościowej na Górnym Śląsku. W ostatniej części przedstawię odmienne stanowisko prawników niemieckich, aby możliwe stało się osiągnięcie mojego głównego celu badawczego, jakim było przedstawienie (w sposób porównawczy) jak ważną rolę w prawie międzynarodowym odgrywa jego wykładnia – chociaż teksty konwencji są najczęściej formułowane w jasny sposób i po pierwszym zetknięciu się z ich brzmieniem nie budzą w interpretatorze wątpliwości, to mimo wszystko stwarzają możliwość szerokiej, często jawnie godzącej w fundamenty całego porządku międzynarodowego wykładni. Choć sam przykład jest historyczny, tematyka różnic w wykładni prawa międzynarodowego jest w dzisiejszych czasach, przy postępującej globalizacji oraz integracji międzynarodowej, szczególnie ważna. W artykule wykorzystane zostały zarówno teksty aktów prawnych (czwartej konwencji haskiej i paktu Brianda-Kellogga), jak i ich późniejsze interpretacje przez prawników polskich oraz niemieckich. W części dotyczącej stosunków polsko-niemieckich w świetle Niemieckiej Listy Narodowościowej.
In the following article, I will attempt to present the matter of the German Nationality List in Upper Silesia from three historical and legal perspectives, as well as a brief overview of how it influenced the fate of the Upper Silesians and the Polish-German relations. After a short description of the most important results of the introduction of the German Nationality List in Upper Silesia and its impact on the relations between the Polish and German people, I will present the literal wording of the Fourth Hague Convention (with particular emphasis on the third chapter including the exercise of occupation) and show an example of its use after the First World War. In the next part, I will present the Polish legal interpretation of its provisions in the context of assessing the legality of introducing the German Nationality List in Upper Silesia. In the last part, I will present the different standpoint of German lawyers to achieve my main research goal, which was to present (in a comparative way) the importance of the legal interpretation in international law - although texts of the conventions are most often formulated clearly and initially their wording does not raise any doubts in the interpreter, they create the possibility of a broad interpretation, often openly undermining the foundations of the entire international order. Although the example itself is historical, the subject of differences in the interpretation of international law is particularly important nowadays, with the advancing globalization and international integration. The article uses both the texts of legal acts (the Fourth Hague Convention and the Briand-Kellogg Pact) and their subsequent interpretations by Polish and German lawyers. In the part concerning Polish-German relations in the light of the German Nationality List in Upper Silesia, the memories of witnesses of history were also used.

The paper discusses Fibrosa S.A. v. Fairbairn Lawson Combe Barbour Ltd (1942), a case considered as one of several landmark cases in the English law of restitution. What was at stake in litigation before the House of Lords was whether a Polish plaintiff should recover a prepayment transferred pursuant to a contract that had become frustrated because of the outbreak of war in 1939. The lords had to decide on the application of two potentially dissonant doctrines – frustration and total failure of consideration. But what made the Fibrosa case famous was an obiter dictum delivered by lord Wright. This eminent judge declared that English law should provide remedies for unjust enrichment. That is the very reason why the case is still being cited by the lawyers today.

Jan Baszkiewicz, the eminent political and legal thought historian, in the years 1959–1968 was associated with the University of Wrocław, working at the Faculty of Law and Administration. The nine-year Wrocław period was very important in Jan Baszkiewicz’s life. First employed at the Chair of General History of State and Law and, later, at the Chair of History of Political and Legal Doctrines, Jan Baszkiewicz can be deemed the father of the Wrocław history of political and legal doctrines. For didactic purposes, he developed academic course materials on the above subject, on which History of Political and Legal Doctrines, published together with Franciszek Ryszka in 1969, was based. It was the first Polish academic textbook fully discussing the history of political and legal thought from antiquity to contemporary times. During his stay in Wrocław, Jan Baszkiewicz published Sovereign State in the Feudal Political Doctrine until the Early 14th Century (Warsaw 1964), one of the most significant studies among all of his scientific achievements, which has later become a classic of the genre and strengthened Jan Baszkiewicz’s position among Polish state and law historians. He also performed important organisational functions. In 1960, Jan Baszkiewicz was appointed the Head of the Department of Political Doctrines, and, in 1963, of the Chair of Political and Le- gal Doctrines. From 1962 until 1964, he was Deputy Dean for Didactics of the Faculty of Law. In September 1965, Jan Baszkiewicz was appointed Deputy Vice-Chancellor for Academic Affairs and Youth of the University of Wrocław and fulfilled that role through to the March 1968 Polish political crisis. Due to the attitude he demonstrated towards that situation, he was forced to move from Wrocław to the University of Si- lesia in Katowice. In 2003, the University of Wrocław conferred an honorary doctorate upon him.

The paper discusses the extent to which it is possible to find the right Polish equivalents of such English concepts as acquisitive prescription (in property law), entitlements of the dependents (in the law of inheritance) and commercial impracticability (in the area of obligations). Although the general idea of the discussed concepts may easily be grasped and smuggled into such Polish institutions as zachowek, zasiedzenie (legitim), and rebus sic stantibus, deeper insight into the description of these concepts in the two legal systems discloses many differences in detail.

Rudolf Schlesinger (1909–1996) was a brilliant German American scholar of Jewish de- scent. He was born and raised in Germany, where he received his first law education. Shortly before the outbreak of World War II, he had left his homeland and moved to the US where he became a teacher at Cornell Law School. In recognition of his work at Cornell, Schlesinger received the prestigious William Nelson Cromwell Profes- sorship. In 1975 he left Cornell for Hastings College of the Law, where he continued research there for two decades until his retirement in 1994. Rudolf Schlesinger is well known for his new comparative law methodology, which was elaborated during his stay at Cornell Law School. This methodology, known as case method, was described by Schlesinger in his monumental work Formation of Contracts: A Study of the Common Core of Legal Systems (1968). Schlesinger’s ultimate goal in this project, was to identify and define similarities between legal systems. In Schlesinger mind these similarities, known as Common Core, should play a key role in development of both private and international law.

The aim of this paper is to have a look at some institutions of civil law and family law in the light of the requirements of the Convention on the Rights of the Child, on the occasion of the 30th anniversary of this Convention. The child’s incapacity or limited capacity to act, the child marriage and the child’s right to be heard shall be envisaged from a legal historical perspective with a special regard to the age-limits and the modifications of these age-limits on the field of civil law and family law. The subject of the historical overview is the concerned regulations of Hungary, namely the changes in the Hungarian legal rules and the regulations of the effective Hungarian Civil Code which entered into force in 2014. The paper would like to provide a guide for a travel from the end of the nineteenth century to today’s legal rules on the field of age-limits in connection with the above-mentioned institutions which designate the child’s legal position concerning some children’s rights. Some issues of the judiciary concerning the child’s right to be heard in family law proceedings will be mentioned as well to highlight a problem of the everyday legal life. The final aim of this historical travel is to discover whether the discussed legal rules being in force today meet the requirements of the Convention on the Rights of the Child and to compare the legal attitude behind the effective legal rules and the attitude of the child-focused thinking, which shall be also analysed.

After Poland restored its independence in 1918, the subject of Polish citizenship was regulated by the provisions of international law, particularly those found in the Versa- illes Treaty of 24 June 1919, as well as by those formulated in the Treaty with Austria signed in St. Germain en Laye on 10. Sept. 1919, those laid down in the Treaty of Riga of 18 March 1921, and additionally, by the provisions of domestic law, namely the provisions of the Statute on Citizenship of the Polish State of 20 Jan. 1920. It was as early as during the work on the aforementioned Statute that there appeared problems that, in the years which followed, became detectable in decisions taken by the Supreme Administrative Tribunal. It was the latter that – within the scope of its competence – controlled the legality of decisions made on the occasion of adjudicating in matters concerned with the application of provisions on citizenship of the Polish state. In the judicial decisions of the Tribunal, which was established in 1922, there dominated those concerned with the certification of citizenship for which there applied the individuals who acquired the citizenship by virtue of law. The Tribunal also frequently decided in matters referring to making an option of citizenship, the option being allowed by the Versailles Treaty. The Tribunal cautiously appraised the proceedings designed to expel an individual from the territory of Poland. What the Tribunal considered to be a defect in the proceedings was inter alia too general a justification of decisions that referred to the refusal of granting citizenship to the person applying for it. Although the doctrine of the time regarded the act of granting citizenship as the decision that the compe- tent organ made within its discretionary power, the Supreme Administrative Tribunal oversaw each case to ensure that the boundaries of the discretionary power were not exceeded. Likewise, in each case the Tribunal considered itself to be the organ that was competent to check the regularity of proceedings. In each case the Tribunal made a pe- netrating interpretation of provisions and would repeatedly return to the most difficult questions. Among the latter there were inter alia the interpretation of such notions as affiliation with the commune, domicile and the place of settling and military service as titles that justified the acquisition of citizenship. As a result of its control over the ad- ministrative practice, the Tribunal managed to reveal many infringements of provisions. This led to the quashing of decisions that were subject to complaints. In this respect the activities of the Tribunal deserve credit.
