Opis:
Legal history in Poland is imperiled by a few threats. One of them is a model of the university education, promoted by the heads of faculties, which is devoted to strictly legal subjects. It may happen, that historical subjects will be eliminated or vastly limited in the course of the implementation of this model. Such kind of pressure inclines legal historians to emphasize their utility to contemporary legal science. However, it is worth noticing, that there are different dangers that lie in wait for Roman law and for Polish legal history. Basing instruction upon incomplete sources in showing a distant genesis of contemporary legal institutions causes an excessive simplification, which is a serious threat to the reliability of scientific research. The Polish legal history researcher will be helpful to a specialist of contemporary law only occasionally and in most of those rare cases his research will be used to point out the birth of a certain legal institution in Polish law. Another threat to Polish legal history is an intensive interest in mostly recent history. Although, after years of censorship in the state of real socialism, this situation is intelligible, as it resulted in abandoning the research of old-Polish times, nowadays conducted by only a few scholars. As far as the group of Romanists is concerned, they tend to indicate the Roman roots of almost all past, present and future legal institutions. However, this is cannot be done when applying all rigors of scientific research. A drop of the scientific level of publications may be observed as well. Authors do not investigate sources of the practice of the law, the use of legal history literature is insufficient and the publications of historians of other specializations are used only to a minimal degree. Legal historians in Poland have to deal with these main problems, if they hope for the further development of their discipline.

The author presents Genesis, the ways and aims of legal education in Hungarian uni-versities, with a special focus on the Faculty of Law in Trnava, which was establishedin January 1667 (now Eötvös Loránd University in Budapest). The tradition of legaleducation has common European roots and is connected with the medieval foundationof universities in Bologna, where the priority was given to Roman law education.Due to the process of specialization and new tendencies in teaching in West Euro-pean universities, the Hungarian universities were also modernized and enlarged. Theexceptional position in education was dedicated to Roman and canonical law, but inthe Kingdom of Hungary domestic national law was also taught – a practice that hasexisted at the Faculty of Law in Trnava from its very beginnings.

In the first decade of the Polish People’s Republic the authorities undertook a number of actions that were aimed at changing the previous nature of the judiciary, which was planned to be transformed into one of the tools for exercising power. The transformation process covered not only the judges of that time who performed their duties as members of the administration of justice of the Polish People’s Republic. The authorities also undertook actions aimed at shaping future judges according to new political-ideological requirements. Changes planned in the process of educating future lawyers were supposed to serve this purpose. The reform of academic law studies developed by new authorities was supposed to break with the traditional way of educating lawyers. Rejection of subjects regarded as useless, with historical-legal studies at the top of the list, was to be accom- panied by the introduction of political-ideological subjects. The reform of law studies was also supposed to cover the very organisation of course studies. At the same time, the authorities created the so-called law high schools where, among others, future judges were supposed to be educated. Substantial curriculum was limi- ted as much as possible in favour of the political-ideological training of judges of the people’s administration of justice.

The paper discussess the Faculty of Law of the Univeristy of Dorpat (today the Uni- versity of Tartu) up to the year 1918, as seen in the context. of the Polish students who studied there. After the November Uprising (1930-1931) Dorpat became a special place for Polish students in the XIX century, it being the only university in Russia where instruction was given in a language other than Russian. Young Polish patriots who did not want to study in Russian, travelled to this liberal German language university si- tuated in the city of Tartu. It was for this reason in XIX century that Dorpat become one of the most important places for educating the future Polish elite – politicians, doctors of medicine, lawyers, etc. Todays in Poland knowledge of this episode in our history is forgotten. The paper presents an overview of the University of Dorpat includ- ing in particular the history of its law faculty, outlines the law faculty’s curricula, and references some of the notable Poles who studied there.

This essay presents a short analysis of Stalin solicitors in their efforts to establish a Rus- sian legal journal on the Polish market. The “Voprosov ugolovnogo i grażdanskogo prava”, was released as a quarterly addition to a monthly journal “Nowe Prawo”. With the first edition published on the 16th of March 1951, the journal was originally aimed at legal academics in the USSR and other socialist republics. Its’ main purpose was to explore Polish criminal and civil laws and to present a study on development of the socialist system in Poland. The content of journal articles reaffirmed commitment of the Polish legal academia in implementation of Soviet ideology in teaching law.
