The text is addressed at first to young historians and historians of law. It stresses the peculiar importance of the science of the history of law and legal education in Polish historical science, especially in the period between 1850–1914. The science of history of law has been strongly connected with historical science, and law was a phenomenon shaped par excellence by history. In 19th century Poland, when the partitioners were replacing Polish law and Polish institutions by their own legal systems, Polish historians of law had to struggle to preserve national legal traditions. That is why the strong position of F. K. von Savigny’s historical school of law is presented in Polish Romanticism. The article describes the achievements of Polish historians of law in the field of national history science. It points out that many of the historians in this period were lawyers by education (Szymon Askenazy, Tadeusz Korzon, Władysław Smoleński, Marceli Handelsman, Władysław Konopczyński). Nowadays the role of the science of history of law is underestimated, although the cooperation of historians of law with the representatives of other historical disciplines is fruitful.

Wacław Komarnicki (1891–1954) was an outstanding Polish lawyer and academic. He was a constitutionalist and served in government in the II and III terms of the Second Polish Republic (1918–1939). Educated in Lyviv and at Dopat, Komarnicki taught law at the University of Stefan Batory in Vilnius, where he became a professor, and at the School of Political Science in Warsaw. He was also a member of the Polish Academy of Sciences, a political activist and Minister of Justice in the Polish Government in Exile in London, where he later died. His academic research and personal contribution in rela- tion to the March Constitution of 1921 and its amendment in August 1926, is deserving of particular attention.

Accepted by some groups of people and condemned by others, informal relationships have been recognized but not defined by the Polish legislator. In the absence of legal definition it is a task of legal scholars and judges to establish what kind of relationships can be classified as falling under the heading of the equivocal expressions used by the legislator in legal acts. Traditionally, concubinage is deemed as a relationship of that kind. However, it is highly controversial how this type of informal union should be defined. In the first part of this paper the author presents opinions of the legal scholars and judges on the constitutive features of concubinage and proposed definitions of the term. In the second part he analyzes presented data and proposes a typological defini- tion of concubinage which on the grounds of Polish legal tradition can be described as a heterosexual, stable, (not necessarily) notorious relationship of two (or more) people who live together (or not). The cohabitants cannot be legally married and have to form a life communion (characterized by the existence of emotional, physical and economic sensu largo bonds). The union has to be seen by them as an autotelic value and cannot (even potentially) be against the law.

The inheritance law seems to be a field that is of little interest to the world of politics and arousing far less social emotions than family or criminal law. However, after World War II the Polish authorities used the inheritance law in order to actively shape and consolidate the socialist system. As it was stressed on many occasions, inheritance is inseparably connected to ownership, and that determines the nature of all other property institutions. The influence of ideology and politics on Polish inheritance law was especially visible during the works on codification of civil law in the period from 1947 to 1964. However, as it turns out, most representatives of the doctrine were able to bypass the political determinants in order to keep a high legal standard. The author strives to show how the scholars tried to save the classical inheritance law institutions by manipulating the political doctrine. By ideological justifications of the proposed legal solutions in fact they enabled to keep in the 1964 Civil Code most of the basic inheritance law rules of 1946. Unfortunately it was impossible to prevent the introduction of provisions on inheritance of farms into the Civil Code.

The paper discusses the extent to which it is possible to find the right Polish equivalents of such English concepts as acquisitive prescription (in property law), entitlements of the dependents (in the law of inheritance) and commercial impracticability (in the area of obligations). Although the general idea of the discussed concepts may easily be grasped and smuggled into such Polish institutions as zachowek, zasiedzenie (legitim), and rebus sic stantibus, deeper insight into the description of these concepts in the two legal systems discloses many differences in detail.

The paper discussess the Faculty of Law of the Univeristy of Dorpat (today the Uni- versity of Tartu) up to the year 1918, as seen in the context. of the Polish students who studied there. After the November Uprising (1930-1931) Dorpat became a special place for Polish students in the XIX century, it being the only university in Russia where instruction was given in a language other than Russian. Young Polish patriots who did not want to study in Russian, travelled to this liberal German language university si- tuated in the city of Tartu. It was for this reason in XIX century that Dorpat become one of the most important places for educating the future Polish elite – politicians, doctors of medicine, lawyers, etc. Todays in Poland knowledge of this episode in our history is forgotten. The paper presents an overview of the University of Dorpat includ- ing in particular the history of its law faculty, outlines the law faculty’s curricula, and references some of the notable Poles who studied there.

Rudolf Schlesinger (1909–1996) was a brilliant German American scholar of Jewish de- scent. He was born and raised in Germany, where he received his first law education. Shortly before the outbreak of World War II, he had left his homeland and moved to the US where he became a teacher at Cornell Law School. In recognition of his work at Cornell, Schlesinger received the prestigious William Nelson Cromwell Profes- sorship. In 1975 he left Cornell for Hastings College of the Law, where he continued research there for two decades until his retirement in 1994. Rudolf Schlesinger is well known for his new comparative law methodology, which was elaborated during his stay at Cornell Law School. This methodology, known as case method, was described by Schlesinger in his monumental work Formation of Contracts: A Study of the Common Core of Legal Systems (1968). Schlesinger’s ultimate goal in this project, was to identify and define similarities between legal systems. In Schlesinger mind these similarities, known as Common Core, should play a key role in development of both private and international law.

Polish family law, as a part of civil law, has been unified in 1945–46. The old law, coming from the period of Polish partitions, has been replaced by the decrees, based on drafts prepared by the Codification Committee before WW II. The decree Family Law from 1946 regulated the legal relations coming from consanguinity. One of the most important problems to be solved by the legislator was the status of children born out of wedlock. The article presents the drafts and the discussion about improving the legal status of this category of children. The decree finally improved their position, although it did not eliminate legal distinction of the two groups of children. The legal status of children born out of wedlock was a little worse than those coming from marriage, but the difference was not big. The decree gave an opportunity to provide the children with legitimacy in many cases. The differences in the legal status of children were finally eliminated in Poland in 1950, by enactment of the Family Code.

The article concerns the role of Roman law in the education of Polish lawyers. The author compares the conditions and methods of teaching the law of ancient Romans at law faculties in Poland during the period between the two World Wars with those of today. In conclusion, the author states that Roman law is undoubtedly one of the most important components of ancient culture, which has exerted a specific influence on shaping the modern world. The study of Roman law offers a possibility of histori- cal perspective on law, enriches students’ knowledge on the theory and dogmatics of law and teaches the ways of legal thinking. It is impossible to comprehensively under- stand the evolution and functioning of many modern European legal systems, which stem from solutions formerly adopted already in the law of ancient Rome, without the competence derived from the study of Roman law.

The article focuses on the problem of criminal law codification at the beginning of the Polish Peoples Republic. It shows that there were not many lawyers at that time who had given thought to criminal law in the context of communist law theory. It also describes, that the communist theory of criminal law was not an instrument that would allow to prepare a new “communist criminal code”, because it did not possess correct solutions for the new project. Despite this fact, for political and ideological reasons, the process of codification started in Poland at the end of 1950. The first part of the code was ready by the end of 1951, but the entire code was not completed until 1956.

The article presented deals with legal, economic and historical aspects of Polish cheques law. The study is divided into five parts. Three of them concern a general issue of codification and unification of law in reborn Poland after the 1st World War, the international unification of cheques law, as well as they give an outline of form and nature of a cheque (or check in American English) as a type of bill of exchange, and depict various cheque’s functions, such as payment, currency, guarnantee and credit ones. The fourth part comprise three sections: the state of cheques law at the first period of the Second Republic of Poland (1918–1924); the Polish cheques law – a decree passed by the President of the Republic of Poland (14th November 1924), and finally the Act of Cheques Law – a bill enacted by the Polish Parliament (28th April 1936). The activity of the Polish Commission of Codification is regarded as the most important for legislative results in this branch of law. The attempt of international simplification and unification of law relating to cheques took place in Geneva (1931). On 19 March 1931 three conventions concerning this matter were signed: 1) the Convention providing a Uniform Law for Cheques (with two annexes and a protocol); 2) the Convention for the Settlement of Certain Conflicts of Laws in connection with Cheques (with a protocol); 3) the Convention on the Stamp Laws in connection with Cheques (and a protocol). Poland is of part these conventions and the Polish Cheques Law of April 28, since 1936 still is in force without essential changes, is consistent with these regulations.

In Polish penal law the term “closest family member” has existed for decades. Since 1932, however, the circle of people encapsulated by that term has changed si- gnificantly. This article tracks those changes from the Polish Penal code of 1932 through to the revised Penal Code of 1969 and on up to 1997. In the Code of 1932, “closest family member” was defined as people connected to an individual by way of marriage, cognition or affinity. In the Code of 1969, this was expanded to incorporate adopted family members and their spouses, as well as a person with whom the individual lived in cohabitation. From the outset, this latter category generated issues relating to the status of adjudication of a cohabitating partner. Contemporarily, primary discussion revolves around homosexual couples. From the analysis of judicial decision and do- ctrine, it is clear that views in this respect remain divided. However, there is evidence that articulates greater appreciation that homosexual couples can be acknowledged as immediate family. Notwithstanding, doctrine and judicial decision is not unitary.

The formation of government procurement law during the Second Polish Republic ma- intained in inseparable connection with contract law. Such consistent development of those fields of law have been withhold in the early years of the Polish People’s Republic. It is generally emphasized that after 1948 the inadequacy of Polish Code of Obligations in relation to the new social and economical conditions became unmistakable. The ter- minal point of validity of the traditional understanding of “government procurement law” is marked as the date of entry into force of the centralized state planning in so- cialist economy Act of 19th April 1950. Independent contracts maintained only within the edge markets and on the margins of economic trade. The concept of “government procurement law” temporarily vanished from law and legal language. To summarize it must be noted that the legislations from the interwar years in the sphere of government procurement law are regarded as valuable creation of polish legislative theory.

In establishing the thematic scope of this work, I assumed that its subject would be the process of the formation of border services in interwar Poland. This means a deliberate and complete disregard for the essentially distinct administrative role played by the border guard. The presentation of the Border Guard from an administrative perspective changes the situation so profoundly that a thorough discussion of its implications would certainly double the volume of the publication. A superficial treatment of the administrative issue would lead to misunderstandings. Furthermore, a superficial omission of the administrative issue was deemed necessary because the formations were mainly military in nature. Before going into details and elaborations, I would like to present my main research objective, which is the following question: what was the evolution of the legal status of Polish border formations in the inter-war period? In view of this objective, it is necessary to present the work from a historical perspective. The chronology of the facts is important for the subject matter, as it serves to systematise the considerations. The structure of the work and the research method were adjusted to the above-mentioned assumptions of the publication, which shows the reasons for the creation and the process of transformation of the border formations in relation to various types of institutional solutions, up to the moment of the creation of the Border Protection Corps and the Border Guard Corps, operating under these names until 1939. The potential conclusions resulting from this chapter concern: the presentation of the institutional construction of the border formations in the years 1918–1939 and the demonstration that in the interwar period they were the main organs of the Second Polish Republic, which guaranteed the inviolability of state territory and the security of the citizens on the subordinate territory.

The author indicates the reasons that may have led to his appointment as a member of the Codification Commission. The study also presents Bronisław Hełczyński’s personal contribution to the work on the unification and codification of the commercial law of the Republic of Poland. The author notes that Hełczyński was one of several lawyers who edited the Polish Commercial Code from 1934. The article also shows his achievements in the development of marine law and insurance law.
