The paper discusses the extent to which it is possible to find the right Polish equivalents of such English concepts as acquisitive prescription (in property law), entitlements of the dependents (in the law of inheritance) and commercial impracticability (in the area of obligations). Although the general idea of the discussed concepts may easily be grasped and smuggled into such Polish institutions as zachowek, zasiedzenie (legitim), and rebus sic stantibus, deeper insight into the description of these concepts in the two legal systems discloses many differences in detail.

In last 20 years Slovenian civil law has experienced a revival and it tried to get rid of the former influences of socialism and communism. Slovenia does not have a uniform civil code. Civil law is governed by the four headline acts: Code of Obligation (from 2001 with changes), Property Code (from 2002 with changes), Marriage and Family Relations Act (from 1976, but with last official consolidated text from 2004 and later changes) and Succession Act (from 1976 with changes). Especially noticeable changes were made in the area of property law, which in last 20 years has undergone several substantive changes. The new Code of Obligations has largely succeeded former Yugoslav obligation law, but in some areas it has brought new radical changes (e.g. contract of donation, life care contract, loan agreement). Succession and family law are still governed by the law from year 1976, but family law was subjected important changes, especially regarding the children and foster care. In 2005 an Act on Same sex registered partnership. A new Family Code was also adopted, but the Slovenes in the referendum in March 2012 decided against the new Family code, so that it is now in the process of change. In 2012, a first draft of the Succession Act was also created. It was subjected least changes since 1991.

The inheritance law seems to be a field that is of little interest to the world of politics and arousing far less social emotions than family or criminal law. However, after World War II the Polish authorities used the inheritance law in order to actively shape and consolidate the socialist system. As it was stressed on many occasions, inheritance is inseparably connected to ownership, and that determines the nature of all other property institutions. The influence of ideology and politics on Polish inheritance law was especially visible during the works on codification of civil law in the period from 1947 to 1964. However, as it turns out, most representatives of the doctrine were able to bypass the political determinants in order to keep a high legal standard. The author strives to show how the scholars tried to save the classical inheritance law institutions by manipulating the political doctrine. By ideological justifications of the proposed legal solutions in fact they enabled to keep in the 1964 Civil Code most of the basic inheritance law rules of 1946. Unfortunately it was impossible to prevent the introduction of provisions on inheritance of farms into the Civil Code.

One of the most drastic legal solutions introduced after the outbreak of the October Revolution was the abolition of inheritance. In subsequent years the basic institutions of inheritance law have been gradually restored, but the scope of the inheritance law granted to citizens has remained narrow. The purpose of this paper is to indicate the potential impact of these Soviet patterns on contemporary Polish inheritance law. The article is divided into three parts. The first part presents a brief outline of the evolution of Soviet inheritance law, from the period of the October Revolution to 1945. There- after, the proposal to implement Soviet solutions into Polish law is presented. It was embodied in five theses for the project of inheritance law, prepared during the works of the Codification Commission in 1951. The last part describes the further history of this project. The article finishes with the concluding remarks in which the author seeks to indicate the legacy of the October Revolution in the current inheritance law in Poland.

After successful process of unification of Polish civil law in 1946, in the period 1947–1949 works on the codifications of this branch of law were held. In February 1947 the Co- dification Commission was established. The Commission was to prepare the version of Civil Code, based on the existing acts and decrees. The changes in the existing law could be done only exceptionally. The draft of inheritance law, as a part of civil code, was prepared by Seweryn Szer and Jan Witecki. The first reading was concluded in December 1948. There were some important changes in inheritance law, for example provisions concerning statutory scuccesion and – in particular, groups accepting suc- cession. At last, the draft of inheritance law was not even published. In 1949 the work on new code was stopped beacuse of political reasons (the Stalinisation of Poland).

This article attempts to answer the question of how works on the codification of civil law proceeded, following the political upheaval of 1948. The literature indicates that the work was interrupted and that another project of the Civil Code was not published until 1954. Codification efforts were indeed broken, but in September 1950 the Presidium of the Government adopted a significant resolution requiring the Minister of Justice to prepare a draft of the Civil Code in just 11 months. The author – on the basis of archival documents – is trying to reconstruct the course of this work and fill gaps in the existing literature. It turns out that the Ministry of Justice accomplished the resolution, even though the set time limit may have seemed unreal. By the end of August 1951 the project of the Civil Code with its reasons was finished. However, in view of the advanced work on a new constitution, the project was suspended and legislative work has not been continued.

The draft of legal regulations about consanguinity and guardianship was supposed to be a part of the codification of civil law, consisting of five parts (so called: books): general part, family law, property law, law of obligations and inheritance law. In the proposed draft the family law was placed as book II, according to pattern coming from the Swiss code. The draft was based on the decrees from 1945–1946, which unified Polish civil law. The authors of this draft have not changed much in the existing law. The proposed changes were improving the legal situation of children coming out of wedlock, there were also some changes in the property relations between parents and children proposed. Few amendments referred to law of adoption. The guardianship law was unchanged. The draft was presenting very high level of civil law. However, the works on the draft code were interrupted in 1949, because the communist authorities declared draft as “bourgeois” one and not suitable in the new political situation of Stalinist Poland.

Polish family law, as a part of civil law, has been unified in 1945–46. The old law, coming from the period of Polish partitions, has been replaced by the decrees, based on drafts prepared by the Codification Committee before WW II. The decree Family Law from 1946 regulated the legal relations coming from consanguinity. One of the most important problems to be solved by the legislator was the status of children born out of wedlock. The article presents the drafts and the discussion about improving the legal status of this category of children. The decree finally improved their position, although it did not eliminate legal distinction of the two groups of children. The legal status of children born out of wedlock was a little worse than those coming from marriage, but the difference was not big. The decree gave an opportunity to provide the children with legitimacy in many cases. The differences in the legal status of children were finally eliminated in Poland in 1950, by enactment of the Family Code.

The professors of law at the Faculty of Law of the University of Vilnius were: Simon Dilger, John George Schauer and Aaron Alexander Olizarowski. On the other hand it raises doubts whether, in accordance with the act of foundation, only one chair of civil law (Roman) were established. Undoubtedly, canon law was taught at the two cathedrals. With high probability, Aaron Alexander Olizarowski also taught canon law. However, all indications are that he could take second chair in civil law (Roman) and lectures on this discipline. It is true that Aaron Alexander Olizarowski also promoted a few doctors of canon law, but in this period Vilnius Academy were other specialists who are likely to teach canon law. In addition, he was a layman, which could also be an obstacle to entrust lectures in canon law. In addition, CV, publications and complete education Olizarowski’s indicate that undoubtedly took a second chair in civil law (Roman) and lectured in this discipline. Having a doctorate both laws was adequate preparation to teach this course. Thus, Alexander Olizarowski, educated abroad, was the only lawyer and the right candidate for the role of professor of civil law (Roman) at the University of Vilnius.

Celem artykułu jest zbadanie, w jaki sposób interpretowana była klauzula rebus sic stantibus (art. 269 kodeksu zobowiązań) przez sądy polskie (nieniemieckie) w Generalnym Gubernatorstwie. Przebadane zostaną tezy prawne, wydawane przez te sądy, które stanowiły instytucję ujednolicającą orzecznictwo, wobec likwidacji Sądu Najwyższego w Generalnym Gubernatorstwie. Okres wojny i okupacji były nadzwyczajną sytuacją, która niewątpliwie wpływała na stosunki umowne pomiędzy stronami. Polski ustawodawca w kodeksie zobowiązań z 1933 r. wprowadził klauzulę rebus sic stantibus, która pozwalała na sądową ingerencję w stosunki umowne, w trakcie wystąpienia nadzwyczajnych wypadków. Interesujące jest, w jaki sposób, w porządku prawnym Generalnego Gubernatorstwa reagowano na te okoliczności. W pracy wykorzystano źródła archiwalne, w których odnaleziono tezy prawne sądów polskich (nieniemieckich) dotyczące problematyki artykułu. Tezy prawne nie były oficjalnie publikowane, stąd konieczność wyselekcjonowania i opracowania materiału archiwalnego. Przedstawiono także przegląd najważniejszej literatury dogmatyczno-prawnej i historyczno-prawnej dotyczącej problematyki klauzuli rebus sic stantibus. Przeanalizowano odnalezione orzeczenia sądowe dotyczące art. 269 kodeksu zobowiązań, pod kątem rodzajów zobowiązań, do których stosowana była omawiana klauzula, kolejnym omówionym problemem, będzie kwestia tego, czy sądy polskie (nieniemieckie) odnosiły się do warunków zastosowania przepisu art. 269 kodeksu zobowiązań, w tym tych wypracowanych przez przedwojenne orzecznictwo i doktrynę. Problemem jest, co w warunkach okupacyjnych, w świetle orzecznictwa, oznaczało „nadzwyczajne wypadki”, czy sądy interpretowały to pojęcie niedookreślone w sposób ścieśniający, czy rozszerzający. Hipoteza badawcza artykułu zakłada, że sądy polskie (nieniemieckie) w okresie okupacji niemieckiej stosowały klauzulę rebus sic stantibus wyłącznie po spełnieniu warunków określonych przez porządek prawny.
The article aims to examine how the rebus sic stantibus clause (Article 269 of the Code of Obligations) was interpreted by Polish (non-German) courts in the General Government. The legal theses issued by these courts will be examined. It was an institution that was used to unify the jurisprudence, regarding the liquidation of the Supreme Court. The period of war and occupation was an extraordinary situation, that undoubtedly influenced the contractual relations between the parties. In the Code of obligations of 1933, the Polish legislator introduced the rebus sic stantibus clause, which allowed for judicial interference in contractual relations in the event of extraordinary accidents. It is interesting how the legal order of the General Government reacted to these circumstances. The paper uses archival sources, in which legal theses of Polish (non-German) courts, regarding the issue of the article, were found. Legal theses were not officially published, hence the need to select and develop archival material. A review of the most significant dogmatic-legal and historical-legal literature on the issue of the rebus sic stantibus clause is also presented in the paper. The next problem discussed will be whether Polish (non-German) courts complied with the conditions of application of Art. 269 of the Code of Obligations, including those developed by pre-war jurisprudence and doctrine. The problem is what, in the light of the jurisprudence, under the conditions of occupation, was meant by „extraordinary accidents”, whether the courts interpreted this notion narrowly or broadly. The research hypothesis of the article assumes that Polish (non-German) courts during the German occupation used the rebus sic stantibus clause only after meeting the conditions specified by the legal order.

The aim of this paper is to have a look at some institutions of civil law and family law in the light of the requirements of the Convention on the Rights of the Child, on the occasion of the 30th anniversary of this Convention. The child’s incapacity or limited capacity to act, the child marriage and the child’s right to be heard shall be envisaged from a legal historical perspective with a special regard to the age-limits and the modifications of these age-limits on the field of civil law and family law. The subject of the historical overview is the concerned regulations of Hungary, namely the changes in the Hungarian legal rules and the regulations of the effective Hungarian Civil Code which entered into force in 2014. The paper would like to provide a guide for a travel from the end of the nineteenth century to today’s legal rules on the field of age-limits in connection with the above-mentioned institutions which designate the child’s legal position concerning some children’s rights. Some issues of the judiciary concerning the child’s right to be heard in family law proceedings will be mentioned as well to highlight a problem of the everyday legal life. The final aim of this historical travel is to discover whether the discussed legal rules being in force today meet the requirements of the Convention on the Rights of the Child and to compare the legal attitude behind the effective legal rules and the attitude of the child-focused thinking, which shall be also analysed.

In interwar Poland, civil status records were kept under five separate legal regimes, which the Second Polish Republic inherited from the different partitioning powers. Only the Prussian and Hungarian systems, which were in force in the western voivodeships and in Spiš and Orava, were fully secular and professional. In the central, eastern, and southern voivodeships, the civil status records of the majority of the population were combined with church records, and thus were kept by the clergy. The cluster of outdated regulations, which were ill-adapted to the new state and were often mutually exclusive, caused a host of registration problems in each of the five systems in operation. Due to the unsuccessful attempts to unify this system throughout the country, efforts were made to organize it not only through legislation and ministerial circulars, but also through court judgments, including those issued in the administrative court system. The present paper analyzes eight judgments of the Supreme Administrative Tribunal that have been published in the official Collection of Judgments, as well as four rulings of the Tribunal presented in other sources on civil status records and related issues. The resulting overview is intended to present how the various provisions on civil status records were interpreted in the conditions prevailing in interwar Poland, as well as to illuminate the nature of the cases considered and their relevance in terms of their impact on further operation of the civil status records system.
