Accepted by some groups of people and condemned by others, informal relationships have been recognized but not defined by the Polish legislator. In the absence of legal definition it is a task of legal scholars and judges to establish what kind of relationships can be classified as falling under the heading of the equivocal expressions used by the legislator in legal acts. Traditionally, concubinage is deemed as a relationship of that kind. However, it is highly controversial how this type of informal union should be defined. In the first part of this paper the author presents opinions of the legal scholars and judges on the constitutive features of concubinage and proposed definitions of the term. In the second part he analyzes presented data and proposes a typological defini- tion of concubinage which on the grounds of Polish legal tradition can be described as a heterosexual, stable, (not necessarily) notorious relationship of two (or more) people who live together (or not). The cohabitants cannot be legally married and have to form a life communion (characterized by the existence of emotional, physical and economic sensu largo bonds). The union has to be seen by them as an autotelic value and cannot (even potentially) be against the law.

Opis:
The aim of this paper is to have a look at some institutions of civil law and family law in the light of the requirements of the Convention on the Rights of the Child, on the occasion of the 30th anniversary of this Convention. The child’s incapacity or limited capacity to act, the child marriage and the child’s right to be heard shall be envisaged from a legal historical perspective with a special regard to the age-limits and the modifications of these age-limits on the field of civil law and family law. The subject of the historical overview is the concerned regulations of Hungary, namely the changes in the Hungarian legal rules and the regulations of the effective Hungarian Civil Code which entered into force in 2014. The paper would like to provide a guide for a travel from the end of the nineteenth century to today’s legal rules on the field of age-limits in connection with the above-mentioned institutions which designate the child’s legal position concerning some children’s rights. Some issues of the judiciary concerning the child’s right to be heard in family law proceedings will be mentioned as well to highlight a problem of the everyday legal life. The final aim of this historical travel is to discover whether the discussed legal rules being in force today meet the requirements of the Convention on the Rights of the Child and to compare the legal attitude behind the effective legal rules and the attitude of the child-focused thinking, which shall be also analysed.

Opis:
Polish family law, as a part of civil law, has been unified in 1945–46. The old law, coming from the period of Polish partitions, has been replaced by the decrees, based on drafts prepared by the Codification Committee before WW II. The decree Family Law from 1946 regulated the legal relations coming from consanguinity. One of the most important problems to be solved by the legislator was the status of children born out of wedlock. The article presents the drafts and the discussion about improving the legal status of this category of children. The decree finally improved their position, although it did not eliminate legal distinction of the two groups of children. The legal status of children born out of wedlock was a little worse than those coming from marriage, but the difference was not big. The decree gave an opportunity to provide the children with legitimacy in many cases. The differences in the legal status of children were finally eliminated in Poland in 1950, by enactment of the Family Code.

Opis:
This paper addresses the issue of child protection in the Italian legal system from a pedagogical perspective. This viewpoint recognizes the significance of law as an integral part of the pedagogical discourse. On the one hand, legal provisions directly impact the design of educational services, defining boundaries and opportunities for educational actions and for the related pedagogical documentation. On the other hand, the legal discourse itself offers a specific standpoint on the main challenges faced by educators, teachers, and pedagogists in their work. This includes issues related to families, child protection and custody, FAPA orders, foster care and adoption, family emergencies, and the role of court consultants. In this context, the paper discusses the most relevant legal aspects concerning child protection in the Italian legal system. It provides a pedagogical commentary on both legal rules and one of the services that exemplifies the critical and fruitful relationship between law and pedagogy: Neutral Space (on supervised visitation). This service is planned and overseen by educators on behalf of the Social Services. By examining this topic, the paper explores how the legal regulations not only establish boundaries and possibilities for educational action but also contributes to a deeper understanding of the pedagogical nature of the service. By adopting this approach, the paper aims to shed light on how the juridical framework not only influences educational practices but also facilitates a more comprehensive integration of pedagogy within the service.

Jeszcze do początków XIX w. dobór środków wychowawczych przez rodziców i opiekunów w stosunku do znajdujących się pod ich pieczą dzieci, w tym tych służących dyscyplinowaniu najmłodszych, nie był zazwyczaj prawnie ograniczany. Zmianę w tej kwestii możemy zaobserwować wraz z pojawianiem się w dużych europejskich kodyfikacjach prawa cywilnego regulacji z zakresu prawa rodzinnego. Każda z tych obowiązujących na znajdujących się pod zaborami XIX-wiecznych ziemiach polskich w wyraźny sposób odnosiła się do uprawnienia karcenia nieposłusznego dziecka. W każdej z nich dyscyplinowanie zostało dozwolone, jednocześnie w każdej temat ten został uregulowany odmiennie, zarówno w zakresie określenia jego podstaw, stosunków do władzy ojcowskiej/rodzicielskiej, jak i ustanowionych ograniczeń i środków ochrony dziecka. Po II wojnie światowej w polskim ustawodawstwie możemy zauważyć coraz większą ingerencję w autonomię rodziców i opiekunów, kiedy karcenie znikło z katalogu jawnie wymienionych uprawnień wychowawczych, aż po czasy najnowsze, kiedy w 2010 r. wprost zakazano cielesnego karania najmłodszych. W niniejszej pracy autor podejmuje próbę przeglądu i krótkiego podsumowania uregulowań w temacie dyscyplinowania dzieci w podstawowych aktach prawnych obowiązujących na ziemiach polskich od początku XIX w., przechodząc przez początek XX w. i okres międzywojenny, czasy okupacji i Polski Ludowej, aż po obecny stan prawny. Oprócz uprawnienia karcenia wynikającego z władzy rodzicielskiej zbadano także analogiczne przepisy dotyczące opiekuna.
Until the early 19th century, the selection of educational measures by parents and guardians in relation to the children under their care, including those serving to discipline the youngest, was not usually legally restricted. A change in this issue can be observed with the emergence of family law regulations in large European civil law codifications. Each of these regulations in force on the Polish territories of the 19th century, partitioned between three neighbouring powers, clearly referred to the power to discipline a disobedient child. Such disciplining was allowed in each of them, though it was regulated differently, both in terms of defining its grounds, relations to paternal/parental authority, as well as the established restrictions and measures to protect the child. After the Second World War, in Polish legislation we can observe an increasing interference in the autonomy of parents and guardians, when disciplining disappeared from the catalogue of explicitly mentioned educational measures, until the most recent times, when corporal punishment of the youngest was explicitly prohibited in 2010. In the following article, the author attempts to review and briefly summarize the regulations on disciplining children in the basic legal acts in force in Poland since the beginning of the 19th century, going through the early 20th century and the interwar period, the times of the occupation and People's Republic of Poland, until the current legal status. In addition to the parental powers, the author examines similar provisions regarding the legal guardian.
