Opis:: At the time when Poland joined the European Union, the quality of the air in the country was far from the European standards. At the moment, the level of certain pollutants in the air is still high, which may result in legal proceedings of the European Union bodies against Poland, and consequent substantial financial charges. What is worse, it is estimated that as many as 45,000 Poles die every year due to air pollution. That is why NIK has decided to conduct an audit aimed at evaluating the activities of public entities undertaken with a view to improving the quality and protection of the air in the period between the year 2008 and the first half of the year 2014. The audit covered: the functioning of air monitoring, the development of air protection programmes by individual bodies of regional self-governments and the performance of tasks set out in these programs by competent self-government bodies, the financing of tasks related to air protection by regional funds for environmental protection and water management, as well as the coordination of activities and cooperation of organisational units with regard to the implementation of protection related measures. The audit was carried out in five regions (Małopolskie, Mazowieckie, Opolskie, Pomorskie and Śląskie), and it covered 25 auditees.

Opis:: Ten years ago, the audit was conducted entitled “Protection of the River Bug Catchment Area in the Years 2003-2006”. Apart from NIK, the audit was conducted by the Supreme Audit Institutions of Ukraine and Belarus. In 2015, the follow-up coordinated audit was carried out entitled “Protection of the River Bug Catchment Area against Pollution”. The audit was conducted on the initiative of the President of the Chamber of Accounts of Ukraine. The audit examined the implementation of the audit conclusions of 2006 aimed at achieving good quality of the waters of the River Bug catchment area, which means the compliance with the Water Framework Directive.

Opis:: The article focuses on the analysis of the legislative initiative aimed mainly to improve the air quality. Although it has not become a binding regulation, it should be recognised – mostly because it was the first, based on sensu largo penal law, actual attempt to reduce exhaust fumes emission. Moreover, this initiative is a good example to illustrate the trend in the penal policies that is bound to set standards in fighting adverse effects in the area of environmental protection. A critical analysis of the solutions proposed should give rise to developing new regulations, which make an indispensable instrument of the state’s policy related to fight for clean atmosphere.

Opis:: W reakcji na katastrofę ekologiczną, do której doszło na Odrze latem 2022 r. kluczowe organy administracji publicznej odpowiedzialne za bezpieczeństwo obywateli długo pozostawały bierne i nie podejmowały koniecznych działań. Nie zapewniły skutecznego obiegu informacji oraz nie uruchomiły odpowiednich struktur zarządzania kryzysowego. W konsekwencji alerty ostrzegawcze i zakazy korzystania z rzeki skierowano do ludności z co najmniej kilkunastodniowym opóźnieniem. Kryzys na Odrze obnażył brak należytej troski państwa o dobry stan wód. Był to efekt wieloletnich zaniechań jego organów, błędnych działań, a także niewystarczających rozwiązań prawnych.
In summer 2022, the catchment area of the Odra River was affected by an ecological catastrophe the scope of which had been unprecedented. In the river, where water was contaminated along hundreds of kilometres, fish and other organisms, such as clams and freshwater snails, died in large numbers. At least 350 tonnes of poisoned fish were recovered from the Odra River and its tributaries. The results of the analyses conducted by researchers from the Institute of Marine and Environmental Sciences of the University of Szczecin and experts from non-governmental organisations, which were published at the end of 2023, showed beyond doubt that over 3 million fish died (1,650 tonnes, i.e. 60 percent of their biomass), as well as almost 90 percent of organisms involved in the river’s self-purification processes. Taking into account the scale of the catastrophe and its consequences, it was justified to evaluate the activities of the government administration bodies and state legal persons responsible for reacting on the situation, especially in the light of publicly voiced accusations of their idleness, especially during the first phase of the crisis. It was also important to present the conditions stemming from the actions taken, or negligence that led to idleness. The NIK’s audit focused on two areas: preparedness of the state structures and the circumstances that led to the ecological crisis in the Odra River, as well as the way state bodies reacted on the situation. The article presents the findings of this audit.
