    The article attempts to thoroughly discuss and interpret actions and mechanisms strictly related to corruption, associated with the abuse of authority, mandated responsibilities and decision-making competences. The author discusses broad understanding of the notion of corruption, provides his own definition of corruption and presents substantive arguments to justify his reasoning and perception of specific events and processes. In his article, the author also analyses the proceedings patterns which are characteristic of the so-called legal corruption. Special attention is paid to the motives and objectives of actions taken, as well as the consequences of such practices. In the later part of the study, the premises and circumstances are discussed, which are significant for the abuse of power qualified under the provisions of Article 231 of the Criminal Code.

    Opis:
    For many years, the Supreme Audit Office has been , so to speak, a warning system for corruption threats. NIK considers corruption in the broad sense of the term, as all forms of abuse of public functions for illegal private gains. During their examinations, NIK auditors indicate corruption prone mechanisms, i.e. irregularities that cause or increase the risk of corruption. They can be most often encountered in the area of service outsourcing by public entities, especially advisory, expert and legal services where there is a high level of freedom and where certain weaknesses of control of the process exist. The other area with serious corruption threats is location of investments and the functioning of the construction supervision. The article comprises an analysis of eleven audits conducted by NIK in 2016, presenting corruption prone mechanisms in the functioning of the public institutions audited.

    The programme is a continuation and intensification of the former preventive and repressive measures against corruption. After a five-year break, at the time of growing social disapproval for the governing authorities’ measures taken in the field, a concrete policy is being introduced in a comprehensive document.     The main objective of the article is to clarify and broaden knowledge on the organisational and legal conditions that are of importance from the perspective of concrete managerial processes and decisions which we meet in practice. In the article, the results of research are also presented that mainly consisted in analysing the provisions of the anti-corruption act, and assessing various cases where these provisions are not complied with. The utilitarian objective has been also set, namely paying attention to significant aspects of the interpretation of some cases of breaching the anti-corruption act and the excessive salary act (Polish: ustawa kominowa).

    There are many entities in Poland that deal with the fight against corruption, and although no clear outcomes of their activities can be observed, the country has been rating higher and higher in the reports of the Transparency International. A vast majority of the Polish society, like in other European Union Member States, are convinced that the scale of corruption is big. Supreme Audit Institutions have been for many years engaging in the fight against corruption. The Working Group on the Fight against Corruption and Money Laundering, which is one of the structures of the International Organisation of Supreme Audit Institutions – INTOSAI, among one of its objectives for the years 2011-2016 listed the following: to define and promote a strategy to fight corruption and money laundering. At the moment, works have been finalised within the Group on guidelines on good governance of public assets. The document has been developed by a sub-group led by the Supreme Audit Office of Poland.

    The state administration and self-government administration are the areas which are regarded the most threatened with corruption. This especially refers to processes in which a decision is made by one person or a small group of people. Persons who perform public functions are then most exposed to various kinds of attempts to impact on their impartiality in the decision-making process. That is why the state needs to take measures to reduce such situations. In his article, the author analyses the following constructs: abuse of power, bribery, false declaration and third degree. The crimes discussed in the article infringe the principle of impartiality and equal treatment of citizens, as well as negatively affect the proper functioning of state institutions.

    The regulations of the Act of 21 August 1997 on limitations related to conducting businesses by persons who perform public functions, comprise a set or anti-corruption provisions. One of them sets out that it is forbidden to own more than 10 per cent of stocks or a share that represents more than 10 per cent of the seed capital in commercial companies. A breach of this ban can result in termination of the mandate or termination of employment without notice, with consequences set out in Article 52 of the Labour Code. The article presents the scope of the said ban, as well as the application of sanctions for breaching this ban. Although ratio legis of the legal solutions is to prevent situations that might tempt to abuse public functions, the analysis made shows that this aim has not been achieved. Moreover, it seems that the regulation currently in force does not provide for too many situations in which a conflict of interest may appear (understood as financial interest in the company performance). The bans introduced have been analysed as for their compliance with the Constitution of Poland. Although they are compliant with the Constitution, some court rulings modify, on the basis of concrete situations, sanctions applied for breaches of anti-corruption acts.

    Rozwiązania przyjęte w ustawie z 11 września 2019 roku – Prawo zamówień publicznych (dalej także Pzp) zakładają zwiększenie swobody zamawiających. Przejawia się ona m.in. odformalizowaniem postępowań poniżej wartości tzw. progów unijnych, zniesieniem prymatu trybów przetargowych czy też oczekiwaniem szerszego wykorzystywania kryteriów pozacenowych. Elastyczność postępowania niesie jednak ryzyko nasilenia mechanizmów korupcyjnych. Było to widoczne w momencie uchwalenia tzw. specustawy covidowej, która zniosła obowiązek stosowania przepisów Pzp do postępowań związanych z zapobieganiem i zwalczaniem pandemii. Potwierdziło to potrzebę rozważenia zmian rodzimych regulacji. Celem powinno być zagwarantowanie spójności systemu, polegającej z jednej strony na utrzymaniu swobody zamawiających, z drugiej zaś na uszczelnieniu regulacji sensu largo dotyczącej zapobiegania i zwalczania korupcji. Pomocna może się tu okazać analiza komparatystyczna i przyjrzenie rozumieniu zjawisk korupcji oraz mechanizmom jej zwalczania w porządkach prawnych innych państw.
    Effective spending of public funds calls for basing regulations related to public procurement on solid grounds stemming from, among other, the principle of fair competition and transparency. The role of public procurement, seen through the prism of contemporary challenges, is to support innovativeness and promotion of ecological and social solutions. The solutions adopted in the Act of 11 September 2019 – Public Procurement Law provide for increasing the freedom of the ordering party. This is evidenced, among other, in less formalised proceedings below the so called EU thresholds, abolishing tender primacy, or broader consideration of non-price criteria. However, the flexibility of proceedings brings a risk of increased corruption mechanisms. It was visible at the time of the adoption of the so called covid law, which abolished the obligation to comply with the regulations of the Public Procurement Law in the proceedings related to pandemic prevention and counteracting. This confirmed the need to consider changes in the national regulations, aimed at strengthening corruption prevention and counteracting, especially in the light of new legal regulations. The article describes the reasons for corruption prevention and fighting in public procurement, the understanding of the notion of corruption in the international and Polish law, the importance and occurrence of the so called red flags in public procurement proceedings, and examples of mechanisms for corruption prevention and fighting in the American and German regulations.
