Interesy prawne państwa, zwłaszcza Skarbu Państwa, długo nie były odpowiednio chronione. Posłużyło temu dopiero utworzenie w 2005 r. Prokuratorii Generalnej Skarbu Państwa, a następnie – od 2017 r. – poszerzenie jej zadań jako Prokuratorii Generalnej Rzeczypospolitej Polskiej. Ustalenia kontroli NIK1 wskazują, że spraw nie przystąpiła do wypełniania nowych obowiązków, jednak część podejmowanych działań wymaga usprawnienia, głównie jeśli chodzi o prowadzenie ewidencji mienia Skarbu Państwa. Potrzebne są też dalsze zmiany legislacyjne.
In 2005, with a view of protecting the legal interests of the State, the General Counsel to the Republic of Poland (Polish: Prokuratoria Generalna Rzeczypospolitej Polskiej, PGRP) was established. And in 2017, its mandate and scope of activity were broadened. This came as an inspiration for the Supreme Audit Office to conduct, in 2019, the audit on the performance of PGRP. The audit covered the PGRP as well as the Chancellery of the Prime Minister (Polish: Kancelaria Prezesa Rady Ministrów, KPRM) that super vises PGRP on behalf of, among other, the Prime Minister. The objective of the audit was to examine whether PGRP provided an effective system for legal services for legal persons, and for performance of its tasks in the new, broader scope. Simultaneously, in order to get acquainted with the environment in which PGRP operates and to ver ify some other data, NIK applied for information and documents related to several selected entities whose legal representation was entrusted to the PGRP. - Źródło:
