The main objective of the article is to clarify and broaden knowledge on the organisational and legal conditions that are of importance from the perspective of concrete managerial processes and decisions which we meet in practice. In the article, the results of research are also presented that mainly consisted in analysing the provisions of the anti-corruption act, and assessing various cases where these provisions are not complied with. The utilitarian objective has been also set, namely paying attention to significant aspects of the interpretation of some cases of breaching the anti-corruption act and the excessive salary act (Polish: ustawa kominowa).

The article is a response to the text published in Issue 4/2015 of Kontrola Państwowa, entitled “Need for Amendments in the Act on Control in Government Administration – de lege ferenda Comments”, written by Monika Nowikowska and Janusz Cieślak. The polemicist refers to the provisions that the two authors found problematic due to certain inaccuracies, gaps and deficiencies of the Act of 15 July 2011 on Control in Government Administration. In this article, the author recalls not only theoretical legal analyses of individual regulations, but also examples from his own audit experience gathered in the Ministry of Internal Affairs and Administration.

In his article, the author discusses organisational and legal aspects related to the ban on combining functions in supervisory bodies of several commercial law companies. These issues are analysed in relation to audits of compliance with the law in the field. The author presents the mutual relations between two legal acts (the so called chimney act and the anticorruption act) whose application is sometimes unclear. Later in his article, the author discusses the understanding of the notions of appointment versus designation of a candidate for a supervisory board, identifying basic differences that are of crucial importance from the perspective of compliance with the anticorruption act. Furthermore, the author discusses the consequences of breaching the provisions of the chimney act, and the issue of responsibility for decisions taken.

The basic legal act that regulates the management of cemeteries is the Act of 31 January 1959 on cemeteries and burial of the dead, which sets forth that the maintenance and management of municipal cemeteries lies with the respective mayors or governors of the towns and cities where cemeteries are located. NIK auditors examined whether self-governments met their duties in this respect. The detailed audit objectives comprised the evaluation of the regularity of the organisation of tasks related to management and maintenance of municipal cemeteries, the regularity of setting, collecting and accounting for payments for graves, and the regularity of expenditures related to cemeteries maintenance.

In his article, the author presents an analysis of the provisions of Article 11a of the Act on the Supreme Audit Office. This regulation sets forth the right of legislative inspiration, namely a normative construct that allows to inspire other bodies in the area of legislative activities. The article presents the essence of legislative inspiration, especially as compared to other notions related to launching of legislative works. It also discusses the provision of Article 11a of the Act from the perspective of the way in which it allows for influencing a potential legislative process. The article depicts two aspects: the formal aspect (that refers to the proceedings aimed at formulating a legislative proposal) and the material aspect (that refers to the subject matter of the outcome of the activities that constitute the execution of the right of legislative inspiration).

Amendments to Article 76 of the Act on the Supreme Audit Office – Periodic Qualifying Evaluation of Nominated Auditors The Act of 22nd January 2010, amending the Act on the Supreme Audit Office, limited the right of nominated auditors of the Supreme Audit Office to appeal against periodic qualifying evaluation. The article attempts to contribute to the discussion on the role of periodic qualifying evaluation of nominated auditors of the Supreme Audit Office, after the amendments to the Act. The author of the article tries to answer the question on whether, in the light of the present legal regulations, qualifying evaluation can have another role apart from nominated auditors’ preparedness to continue work at NIK, what should be the scale of evaluation, whether efforts made in the evaluation process and the engagement of several persons is indeed beneficial to NIK and has an impact on the professional development of employees, or whether it is just a mere implementation of an unwanted legal obligation.

The article is dedicated to how search is regulated in the Act of 16th February 2007 on competition and consumer protection. Ustawa o Krajowym Systemie Cyberbezpieczeństwa zdefiniowała tworzą ce go podmioty, w szczególności operatorów usług kluczowych, nakładając na nich obowiązek przeprowadzania regularnych audytów bezpieczeństwa systemu informacyjnego. Jednocześnie podkreśliła wagę wypracowania metody umożliwiającej ujednolicone podejście do raportowania wyników, minimalizujące tym samym subiektywizm oceny, sama jednak jej nie wskazując. Metodyka audytu bezpieczeństwa informacyjnego po winna spójnie łączyć wymogi ustawowe z normami i dobrymi praktykami. W artykule podjęto próbę usystematyzowania metod i standardów zarządzania cyberbezpieczeństwem, wykorzystując doświadczenia audytorów.
The Act on the National Cybersecurity System (Polish: Krajowy System Cyberbezpieczeństwa, KSC), which is the first regulation that provides legal and or ganisational basis for a cybersecurity system, was signed by the President of Poland on 1 August 2018. The adoption of the Act is a response to the obligatory implemen tation of the Directive of the European Parliament and of the Council on security of network and information systems (the NIS Directive). The objective of the Act on KSC is to establish an effective information technology system at the national level. It defines the entities that constitute the system, especially key services operators, and obliges them to conduct regular audits of IT systems security. At the same time, the Act emphasises the importance of providing a method for unified reporting on audit results, in this way minimising subjectivity of evaluations – yet the Act itself does not define the method. The methodology for IT security auditing should combine, in a comprehensive manner, legal requirements and standards with good practices in the area. In his article, the author has attempted to summarise the methodologies and stan dards for cybersecurity management, taking into account the experience of auditors.

The provisions on the disciplinary responsibility are set forth in legal acts, while lower level regulations cannot provide for the rules of proceeding, much less the rules of deciding on guild and punishment for deeds considered as disciplinary offence. In the previous legal act – after the Constitution of Poland of 2 April 1997 came into force – this rule was not obeyed. The provisions of the Act on the Supreme Audit Office of 23 December 1994 set out the rules of responsibility in a limited way. The amendments to the Act on NIK resulted in significant changes in the disciplinary proceedings. A new chapter has been added to the Act – Chapter 4a – that sets forth the rules of disciplinary responsibility of nominated auditors. The regulations in the field comprised in the Act are in accordance with the constitutional standards. Simultaneously, the Act has introduced several modifications that should improve the proceedings in disciplinary cases.

The intention of the article is to start a discussion aimed at defining a set of necessary changes in the regulations of the Act on auditing, as well as at explaining interpretation doubts, and to indicate solutions that will improve audit proceedings. In his article, the author presents the data anonymization procedure introduced in the Act of 15th July 2011 on audits in the government administration. He discusses the issue from numerous aspects, analysing anonymization of data on persons who give evidence, explanations or provide documents during the audit proceedings. This is a very useful tool, however, due to the lack of comprehensive legal regulations in the area, it has not been applied in this kind of proceedings. This situation may be changed if regulations based on European laws are introduced.
